By the aty Cmaimil ofdw 04 ofBeweorr THAT, WHEREAS, the reconstruction of Westland Avenue for a distance of approximately three hundred (300) feet west of Onion Street is contemplated, and, WHEREAS, the proposed reconstruction would re -align the road- way so as to require the widening of the existing right of way of Westland Avenue, now therefore, be It ORDERED, that the City Engineer, acting -or and on behalf of the municipal officers according to law, Is directed to lay out by metes and bounds a new right of way line on the northwesterly side of Westland Avenue, the new right of way line to provide sufficient widening for the re -alignment of :he roadway, and be It further ORDEEED, that the City Engineer, acting 'or and an behalf of said municipal officers, proceed to give written notice of such Intentions of said municipal officers by posting such notices for seven (7) days in two public places end in the vicinity of the proposed widening, and the City Engineer is further ORDERED, to make a written return of said proceedings con- taining bounds and ad -measurements of said widening and the damages allowed to the person or persons for the land taken, all in accordance with the laws of the State of Maine, said report to be made a part of this order. One on Westland Avenue at Union Street One on Westland Avenue at Gate 5 and also gave notice by musing the name to be published in the BAmmen DAILY News, mewl= nerespaperaprinted in said city, for one week prior th the_9th. deg Of Oct., ,1,9.641,. ,copy of said order and notices, so posted and published, in hereto amexed and made part of this report. And that the said City Engineer met at the time and place of meeting specified in Lha notims end proceeded to lay out said widening as follows: 208-R -3 Description of Widening Beginning at a point formed by the Intersection of the westerly right of way line of Union Street and the northerly right of way line of Westland Avenue; thence in a northwest direction along the westerly side line of Union Street for a distance of thirty (30) feet; thence southwest along a line at right angles to the last described line for a distance of sixty-three and thirty-eight hundredths (63.38) feet to the northerly right of way line of Westland Avenue; thence south- east along the northerly right of way line of Westland Avenue for a distance of seventy and thirteen hundredths (70.13) feet to the point of beginning. The above described area contains nine hundred and thirty (930) square feet and forme a part of a lot owned by Bearl Moores Heirs. The total recommended damages to be paid for the above described land are one hundred and thirty-five dollars (5135.00). There appeared at the time and place set for the meeting Mrs. Zelma Moores and Mr. Desmond Moores, heirs of the above described property. They were informed of our intentions for the widening of Westland Avenue and were advised of the damages recommended for the taking as well as their rights under the law to appeal the recommended damages. Mr. Moores felt that the tak- ing of thirty (30) feet of frontage from the property would de- crease Its value substantially and he stated that he felt that the City of Bangor should buy the entire property. It was pointed out to Mr. Moores that the frontage remaining on the property after the taking will be sixty (60) feet and that the depth of the lot will not be changed, which still leaves the property suitable for residential development and In conformance with the requirements of the City of Bangor Zoning Ordinances. It was pointed out to Mr. Moores that the parcel of land being taken is triangular in shape as that the extent of its benefit to the remainder of the property Is questionable. Mr. Moores felt that the recommended damages were not equitable and requested that they be reviewed. It is recommended that the above described widening be es- tablished to permit the proper reconstruction of Westland Avenue.
