TO: The Municipal Officers
Reference is made to Council Order No. 115-R, passed
June 22nd, 1964, establishing slope and drainage easements
in the Phase "A" area of the Stillwater Park Orb= Renewal
Project. The report which was attached to the above-mentioned
Order listed the easement areae together with the trees which
would have to be removed, together with a list of recommended
damages for the easements.
During the subsequent construction operations, it was
determined that certain privately -owned trees which were
originally intended to be saved were too close to construction
limits and required removal to permit the completion of con-
structlon. It Was also determined that certain revisions
would be required in the temporary grading easements snecified
and that the following additional damages would result:
(1) On land owned by Clarence E. Dixon, 298 Fern Street,
certain additional trees had to be removed and damages are
recommended as follows:
Removal of 1 - 14 -inch Oak.................$50.00
Removal of 1 - 11 -inch Elm ................. 50.00
Removal of 1 - 18 -inch Maple ............... 75.00
Removal of 2 Bushes ........................ 50.00
Total recommended damages .................. 225.00
The removal of the above-mentioned trees was found to be
necessary inasmuch as their root structure extended into the
area of the proposed sidewalk.
(2) On land owned by Lurline M. Karam, 138 Mt. Rope
Avenue, it was found to be necessary to remove one 10 -inch
maple tree, the roots of which extended into the sidewalk area
on Pam Street. Recommended damages for said tree are seventy-
five dollars ($75.00).
(3) On land owned by Lawrence Meagher, 299 Fern Street$
temporary grading was found to be necessary between Station
7 f 33 end 8 } 539 covering an area of approximately two
hundred fifty (250) square feet and requiring the removal of
a cluster of rose bushes. Damages are recommended in the amount
Of twenty-five dollars ($25.00) for the removal of the hedge.
200-R -3
The total additional damages as outlined above are
three hundred twenty-five dollars ($32$.00), and the payment
of same is recommended.
Respectfully submitted,
Sohn T. Frawley
