ORDERED, TUB WHEREAS, new street construction is being contemplated for the Mesa B portion of the Stillwater Park Urban Renewal project, and, "wIMMAS, the new construction will require the alteration of aide elopes on certain existing properties, now therefore, be it ORDERED, that the City Engineer, acting for and on behalf of the municipal officers according to law, is hereby directed to lay out land for slope easements and temporary grading easements as required for the construction of Phase B roadways as shorn on City of Bangor Plan No. UR 786-B, sheets 1 through 24, and be it further ORDERED, that the City Engineer, acting for and on behalf of said municipal officers, proceed to give written notice of such intention of said municipal officers by posting notices for seven (7) days in two public places in the City of Bangor and in the vicinity of the Proposed construction, and the City Engineer is further CRDERED, to make a written return of said proceedings containing bounds and ad -measurements to all land taken for slope and grading easements together with a list of damages allowed t0 each person for all land so taken or for any benefits resulting to the property owners as a result of the new conativ.Otlon, all in accordance with the Laws of the State of Maine. No damages recommended. 199-R - 5 The above-described areas shall be established as tem- porary grading easements which shall grant the right unto the City of Berger and its agents for the duration of the construc- tion period to enter upon said land within the described limits for all purposes necessary to grade said land (to include any necessary excavating, placing of fill material, looming, seeding and other incidental work) to conform to the adjacent construe - tion: all as BOOM On City of Bangor Plan No. UR -786B, which is on file in the offl ce of the City Engineer. There appeared at the time and place set for the meeting Mr. Charles L. Ramsey, Mr. Errol Cleveland, Mr. F. Norman Webb and Mr. and Mrs. Lester LeBlanc. 911 persons present reviewed the place as they pertained to their individual properties and were informed of their rights to protest the recommended damages If they wished to do so. Mone of the persons present protested the recommended damages. It is recommended that the easements as described above be established and that the recommended damages be accepted. Respectfully submitted, John JTF:C Frawley City ty Engineer 201-R -3 The total cost of this installation is estimated at twelve hundred fifty dollars ($1,250.00). It was recommended by the Public Works Committee that fifty per cent of the coat of this installation, or six hundred twenty-five dollars ($625.00), be assessed against the adjacent property owners In proportion to their frontage. The estimated assessments would be as follows: ESTIMATED NAME FRONTAGE ASSESSMENT Leroy Cole 150 Feet $312.50 Sohn Porter 60 " 125.00 Ernest waded 90 ^ 187.50 Total Assessment $625.00 The above-named persons were contacted by letter and informed of the proposal and were requested to indicate their approval or opposition to the proposal. Mr. Sohn Porter indicated his opposition to the proposal by letter to the City Engineer dated September 13, 1964, in which he Indicated that it was his feeling that the drainage problem was created by Leroy Cole and its correction should be paid entirely by him; and Mr. Porter felt that his property would neither benefit by the sewer installation nor be adversely affected by the lack of said installation. Mrs. Doris M. Nason also indicated her opposition to the proposal by a letter to the City Engineer dated September 12, 1964 in which she indicated that there was no serious drainage problem in front of her property, and if they were to be assessed for the installation, then all neighborhood property owners should also be assessed. Mr. Leroy Cole stated in a telephone conversation on September 25th that he was in favor of the installation as outlined above. It is felt that the problem can only be corrected by the above-mentioned installation, and it is recommended that the assessment for said Installation be made as outlined above.
