ORDERED,
THAT I MHEREAS, a petition has been received for the son-
stnrction of a sewer on Essex Street between Lancaster Avenue and
the Interstate Highway and,
WHEREAS, said construction has been approved by the City
Council and,
WHERRAS, said sewer will cross privately owned land, now
therefore, be it
ORDERED, that the City Engineer, acting for and on behalf of
the municipal officers according to law, proceed to lay out a sewer
easement extending east from Essex Street across land owned by
Robert C, and Mary Lou Simpson a distance of approximately four
hundred and fifty (450) feet, and across land owned by Mardis R.
and Janet A, darner a distance of eight hundred and fifty-five
(855) feet, and be it further
ORDERED, that the City Engineer proceed tc give written notice
of such Intention of said municipal officers by posting each
notices for seven (7) days in two public places in the City of
Bangor and in the vicinity of the proposed sewer and the City En-
gineer to further
ORDERED, to make a written return of said proceedings containing
bounds and ad -measurements of said sewer easement and the damages
allowed to the person or persons for the land taken, all in accord-
ance with the laws of the State of Maine, said report to become a
part of this order.

And that the said City Engineer met at the time and place of meeting speafied in the notices
and proceeded to try out aaid easement as fall own:

LAND OWNED BY ROBERT C. SIMPSOR
Beginning at a point on the easterly sideline of Essex
Street and one hundred forty (140) feet north of the northerly
right of way line of Interstate Route I-95; thence east at right
angles to the sideline of Essex Street for a distance of two
hundred fifty-six (256.0) fSat to a point; thence deflecting
northerly at an angle of 40 -26t-30" for a distance of one
hundred ninety-six and five-tenthe (196.5) feet to the southerly
line of land owned by Mardis R. Warner.
The sewer easement is laid out fifty (50) feet wide,
measuring twenty-five (25) feet to either side free the above-
described center line, except that the southerly line of the
first -described tangent shall be laid out a distance of thirty
(30) feet from said line, to conform with the northerly property
line of land owned by Rosa McLeod.
The above-described area contains fifty-two hundredths (.52)
acres, and damages for said easement are recommended in the amount
of two hundred eighty-seven dollars ($287.00).
LAND OWNED BY MARDIS R. WARIER
Beginning at a point on the southerly line of land owned
by Mardis R. Warner, and also being the northerly line of lend
owned by Robert C. Simpson, said point located four hundred six
and one-half (4061) feet east of the easterly sideline of Essex
Street; thence deflecting northeast from said property line at
an angle of 400-26t-30" for a distance of one hundred forty-four
and eight tenths feet to a point; thence deflecting east
at an angle of 26Q -1414;-60)O" from the last -described line for a
distance of two hundred eighteen and seven -tenths (218.7) feet
to a point; thence deflecting southeast at an angle of 22 -00t
from the last -described line for a distance of three hundred
(300) feet to a point; thence deflecting northeast at an angle
of 220-00t from the last -described line a distance of one hundred
thirteen and five -tenths (113.5) feet to the westerly line of
land owned by the City of Bangor.
The sewer easement has been laid out fifty (50) feet wide,
measuring twenty-five (25) feet on either side of the above-
described center line.
The above-described easement contains ninety -nix hundredths
(.96) acres, and damages are recommended in the amount of one
hundred ninety-two dollars ($192.00).
The above-described easements are intended to penult the City
Of Bangor, or its agents, to enter upon land within the above-
described limits at any time for the purposes of installing and
maintaining a sanitary sewer and appurtenant structures.

There appeared at the time and place set for the meeting
Mr. Robert Simpson and Mr. Mardis Warner, owners of the land
required for the easements. Each person was informed of our
intentions to establish the easement as soon as it was certain
that the sewer construction costs would be within the estimate
originally made for the proposed construction.
Mr. Warner expressed concern as to the condition that his
land would be left upon completion of the sewer installation,
and he was informed by the City Engineer that all work would be
limited to the easement area and that the easement area would
be left in a neat condition upon completion of work. Mr. Warner
was also informed that the contractor would not be permitted to
remove fill material from his surrounding land and that the
sewer would be backfilled and machine -graded in a manner which
would not permit the collection or pending of surface water to
an extent greater than exists at the present time.
Mr. Mennen questioned the City Engineer as to most assess-
ment would be made should a house be constructed on his property
which did not front upon the sewer but which required entrance
into the sewer. He was informed that should the house be so
located as to overlap into area fronting the sewer, the assess-
ment would be made for a theoretical frontage of sixty (60) feet,
this being the minimum lot frontage permitted under the present
ordinances. If the house were located so ae not to interfere
with future lot development fronting the sewer, and thus would
not interfere with the proposed frontage assessments, then a
flat fifty -dollar ($$0.00) sewer entry fee would be changed for
connection into the sewer, in accordance with our standard
policy in this respect.
Inasmuch as construction quotations have now been received
which are equitable when compared with the original estimate,
it is recommended that the above-described easements, as well as
the recommended damages for said easements, be accepted. The
easements are shown on City of Hanger Plan No. 5-627, which is
on file in the office of the City Engineer.
