ORDERED, THAT WHEREAS the City of Bangor has entered into an Agreement dated June 9, 1960, with Katandin Council, Inc. (Boy Scouts of America) relative to the assessments for the construction of Perry Road, and WHEREAS a portion of these lands covered by said agreement have been taken by the State Highway Commission for highway purposes, NOW THEREFORE, be it ordered, that the City Manager be and is hereby authorized to enter into another agreement with Katandin Council, Inc. (Boy Scouts of America) providing that said Katandin Council, Inc. PA m oducedend filed by 00 Councilman Lail£€gill KNOW ALL MEN BY THESE PR ES ENTSo THAT WHEREAS Katandin Council Incorporated, Boy Scouts of America, a Maine corporation having a place of business in Bangor, County of Penobscot, State of Maine (and hereinafter referred to as Katandin) is the owner of certain lands situate on Perry Road in said Bangor WHEREAS Katandin has entered into an agreement with the City of Bangor dated June 9, 1960, resulting from the construction of said Perry used by the City of Bangor and its assessment upon Katandin as an abutting land— owner of a portion of the cost, which agreement, among other things, Provides in substance that the assessment may he collected when lots are sold or Wilt on; WHEREAS a portion of these lands has been taken in 1966 by the State of Maine by condemnation proceeding for highway purposes by taking, identified as Federal Aid Project No. U-026-2 ($)i and WHEREAS Katandin and the City of Bangor both agree that the said taking by the State of Maine does not constitute a sale within the meaning of said agreement. NOW THEREFORE in consideration of these Presents, and in consideration of One Dollar ($1.00) and other valuable considerations, paid by Katandin to the City of Bangor, the receipt whereof is hereby acknowledged, the City of Bangor does hereby release Katandin from so much of said assessment as relates to the property acquired by the State of Maine by said condemnation proceeding. IN WITNESS WHEREOF the City of Bangor causes its name and seal to be hereunto affixed by_ thereunto duly authorized.
