By the City Loumst of tb City of Bangor: ORDERED, THAT WHEREAS the City of Bangor has entered into an Agreement dated June 9, 1960, with Lydia A. Gadsoe relative to the assessments for the construction of Perry Road and WHEREAS a portion of these lands covered by said agreement have been taken by the State Highway Commission for highway purposes, NOW THEREFORE, be it ordered, that the City Manager be and is hereby authorized to enter into another agreement with Lydia A. Ceara providing that said Lydia A. Godsoe is released from 6o much of said assessment as relates to the property acquired by the State of Maine, a copy of said agreement is attached hereto. In duped and £ilea by cowrumnn AGREEMEEIi KNOW ALL MEN BY THESE PHE SENT S, THAT WHEREAS Lydia A. Godsoe, of Camden, County of Knox, and State of Maine, is the owner of certain lands situate on Parry Road in Bangor, County of Penobscot, and State of Mainel WHEREAS Lydia Godsoe has entered into an agreement with the City of Bangor dated June 9, 1960, resulting from the construction of raid Perry Road by the City of Bangor and its assessment upon Lydia Godsoe as an abutting landowner of a portion of the cast, Mich agreement, among other things, Provides in substance that the assessment may he collected When lots are sold Or built on; WHEREAS a Subordination Agreement dated March 27, 1961, supplementing the agreement of June 9, 1960 was executed by Lydia Godsoe and recorded in Volume 1762, Page 167 of the Penobscot Registry of Deeds. WHEREAS a portion of these lands has been taken in 1964 by the State of Maine by condemnation proceeding for highway purposes by taking, identified as Federal Aid project No. U-026-2 (6)i and WHEREAS Lydia Godsoe and the City of Bangor both agree that the said taking by the State of Maine does not constitute a sale within the meaning of said agreements. NOW THEREFORE In consideration of these presents, and in consideration of One Dollar ($1.00) and other valuable considerations, raid by Lydia Godsoe to the City of Bangor, the receipt whereof is hereby acknowledged, the City of Bangor does hereby release Lydia Godsoe tram so much of said assessment as relates to the Property acquired by the State of Ma fne by said condemnation proceeding.
