ORDERED, THAT Inasmuch as the State HSgway Commission is planning to reconstruct Union Street from the Interstate Highway to the Davis Road and WHBREAS, the City Manager has been authorized to enter into an agreement with the State Highway Commission relative to this project by Council Order #99-R, part of which agreement Includes obtaining various grading, elope and drainage easements, now therefore, be it ORDERED, that the City Engineer, acting for and on behalf of the municipal officers according to law, be and hereby Is directed to lay out land for elope easements, temporary grading easements and drainage easements between station 54 + CO and station 144 + 25 as outlined in said agreement and as shown on Maine State Higway Commission Right of Way Hap SHO File N 10-154, sheets 1 through B of 8, and be it further ORDERED, that the City Engineer proceed to hold a public hearing for the taking of said easements in accordance with the Laws of the State of Maine and to make a report of his findings together with a list of recommended damages, said report to become a part of this order. 134-R RECEIVED 1361 JUL-2 "3:37 0R DER CITY. It Is intended that all of the above easements shall release the City of Danger and the State of Maine from all claims, demands and causes of action which may now exist or which may hereafter arise by virtue of said easements. There appeared at the time and place set for the meeting the following people: Mr. Ronald C. Taylor, representing the Mobil Oil Co., Nay C. Hollis, Harold Worthen, John H. Jameson, Douglas Dunnett, H. Rankin Great, Stuart Deane, representing the State Highway Commission, J. T. Frawley, City Engineer and R. C. Furber, Assistant City En- gineer. Most of those present were generally in favor of the pro- posed reconstruction of Union Street. Mr. Worthen amd Mr, Jameson however, were die turbed by the fact that it would be necessary to remove a considerable number of trees for the construction and asked if any steps were being made to replace the trees to be re- moved. He was informed that the Department of Public Works has 134-R - 11 a regular tree planting program and that trees would be planted at the request of the property owners. Mr. Worthen sad Mr. Jamesan also questioned the need for widening Union Street inasmuch as they felt it was sufficiently wide at the present time. They were informed that the design work was performed by the State Highway Commission with the approval of the Bureau of Public Roads and that extensive preparation and evaluation what into the design, Including traffic counts, which apparently stowed the need for the widening. It is recommended that the easements as outlined above be established and that the above-mentioned damages be paid for the easements taken. An accurate set of plans accompanies this report.
