Inntro�d�ucee-d and filed by .........� l.=_.:..� Co 115-R - 2 CITY OF BANGOR, MAINE Engineering Department June 17, 1964 To: The Municipal Officers Pursuant to an order of the City Council, Order N92 -R, passed May 25, 1964, directing the City Engineer to lay out land for slope easements on Dartmouth, Bates, Yale, Birch, Fern and Daytona Streets, the City Engineer begs leave to report: That of his intention to lay out land for the above purposes, the City Engineer gave written notice by notices attached to copies of said order posted for seven days prior to the 4th day of June, 1964, in two public places in the City of Bangor and in the vicin- ity of said street, to wit: One on Bulletin Board at City Hall One on Dartmouth Stresv One on Hamlin Avenue and also gave notice by causing the same to be published in the Bangor Daily News, newspaper printed in said city, for one week prior to the 4th day of June, copy of said order and notices, so posted and published, is hereto annexed and made part of this order. And that the said City Engineer met at the time and place of meeting specified in said notices and proceeded to lay out land for said slope easements which shall grant the right unto the City of Bangor and its agents for the duration of the construction period to enter upon the land Outside of the right of way limits for all purposes necessary to grade said land (to include any necessary excavating, placing of fill material, looming, seeding, and other incidental work) to conform to the adjacent construction, as follows: DARTMOUTH STREET The following easements shall be within the limits defined by the grade limit lines shown on City of Bangor Plan OR 786A, sheets 1 and 2 of 16. There appeared at the time and place set for the meeting Mr. John Thomas, Isla Ifill representing H. 0. Cimbollek, Russell R. Knox, David J. Cahoon, Carroll Lamson, Rimer Delaney, Clarence Dwelley, Mr. and Mrs. Eugene Murphy, James R. Hackett, Ruth Nevins, Roscoe Doughty, J. T. Kesnnn,Mr. Harold Thurlow, Urban Renewal Director, Mr, liana Giggy, Relocation Officer for Urban Renewal, Edward Heldman, Engineer and John Frawley, City Engineer. All present were informed of the proposed changes and required easements in front of their respective properties and all spoke in favor of the prc;cet. Mr, Carroll Lamson spoke in behalf of Marion Healey with regard to her property on Dartmouth Street which he felt was somewhat lower with relation to the raised road grade. Mr. Lamson was informed that it was felt that this situation could be corrected by regrading the front of the property, The City Engineer also received calls from various people who were not able to attend the hearing, including Ada Silverman, Bernice Cowing, Ernest Shaw, Mrs. H. E. Dyer, Mr. G. N. Chebba and Maude Berry. Mrs. Silverman and Mrs. Dyer who both live at the corner of Birch Street and Mount Hope Avenue were concerned with the raise in grade of Birch Street which they felt would tend to drain more water onto their properties which are somewhat lower than Birch Street, They were both Informed that the actual change in grade of Birch Street at their property is only five inches and that the new construction will provide a better ditch line than presently exists so as to drain the water to Mount Hope Avenue. Mrs, Cawing felt that due to the cut slope in front of her house as a result of the new road that a new set of steps would have to be provided. She was informed that this would be investigated when grading work was complete and steps would be provided if required. All persons were in- formed of their rights under the law to appeal the recommended damages in case they were not satisfied. It is recommended that the easements as described above be established and that the recommended damages be accepted. A plan showing the properties in question accompanies this report. By the City Council of the City of Bangor: ORDERED, THAT, 4JEEREAS, various streets are being reconstructed within the Still- water Park area as a part of the Urban Renewal program ad, 4H@tgAS, the grades of said streets are Being changed to the extent that certain a sting property frontages will have to be regraded, now there - fare, it is hereby CHEERED, That the City Engineer, acting for add on behalf of the mu :icipal officers of the City of Bangor, is hereby directed to lay out land for slope easements and grading easements as required for the reconstruction of Dart- mouth Street to apoint one thousand four hundred and fifty feet (1,4501) north of Mount Hope Avenue; Bates Street between Dartmouth Street and Yale Street; on Yale Street to a point six hundred feet (6001) north and to a point three hundred feet (300:) south of the center line of Bates Street; on Fern Street between Mount Hope Avenue and Stillwater Avenue and on Birch Street between Mount Hope Avenue and Berlin'Ava:; and on Daytom Street between Birch Street and Fern Street, as shown on City of Bangor Plan number UR 786-A, sheets 1 through 16, and be it further ORDERED, that the City Engineer, acting for and on behalf of said moni- cipal officers, proceed to give written nation of such intention of said muni- cipal officers by posting notices for seven (7) days in two public places in the City of Bangor and in the vici:uty of the proposed construction, add the City Engineer is further ORDERED, to mesa a written return of said proceedings containing bounds and ad -measurements of all land taken for slope and grading easements together with a list of damages allowed to each person for all land so taken or for any benefits resulting to the property owners as assult of the new conatruct- iono all in accordance with the Laws of the State of Maine.
