Dear Nr. Waymouth:
We are forwarding herewith a Wit -claim Deed running from
the City of Bangor to Railway Express Agency Incorporated.1n At the
time Railway Express Agency Incorporated acquired property in the
Industrial Park in Bangor, it was acquired subject to a Subordination
Agreement recorded in Volume 1622, Page 115 of the Penobscot Registry
of Deeds, which encumbered the property to the extent of such sewer
assessments a might be lawfully a ssed by the City of Bangor.
Wehave now been informed by 3ailway Express Agency Incorporated
that the assessment was paid 'Sy check dated October 8, 1966 in the
amount of 81,.24.
The purpose of this dead i rely to remove the encumbrance
from the record title, add is similar to a deed executed by the City
of Bangor running to C. H. Rice Company for the same Purpose. If you

City of Bangor, a Municipal Corporation, within the County of Penobscot,
State of Maine, in consideration of One Dollar (81.00) and other valuable
considerations paid by Railway Express Agency Incorporated, a Delaware corporation
having a place of business in New York, County of New York and State of New York,
the receipt whereof it does hereby acknbwl edge, does hereby remise, release, bargain,
sell and convey, and forever Quit -claim unto the said Railway Express Agency
Incorporated, its successors a assigns forever, all its right, title and
interest in and to the following described real estate situated at Bangor, in the
County of Penobscot, and State of Maine and more particularly described as follows,
to wit,
A certain lot or parcel of land situate on the northerly side of
Perry Road in Bangor, County of Penobscot, State of Maine, bounded
and described as followsi Beginning at a bolt in the northerly
sideline of Perry Road seven hundred two and thirty-six hundredths
(702.36) feet westerly by and along said sideline of said Perry
Road from a granite monument at the intersection of the said
northerly sideline of Perry Road with the westerly sideline of
Thatcher Street, said point of beginning also being one hundred
nineteen and eighty-three hundredths (119.83) feet westerly of a
granite monument marking the first angle in the northerly sideline
of Perry Road, westerly of Thatcher Streets thence continuing
westerly by and along said northerly sideline of Perry Road two hundred
eighteen and sixty-six hundredths (210.66) feet to a by It; thence
deflecting to the right 410 51' and running northeasterly four
hundred ninety-eight and fifty-five hundredths (498.55) feet to a
bolt in the southerly sideline of the new Location of Route IA -Ramp
"A" as shown an the State Highway Commission Right of Way Plans
designated as Federal Aid Project M-026-2(8)5 thence deflecting to the
right 870 07' and r ing northeasterly by and along said sideline
of said Route LA -Ramp "A" one hundred twenty and three tenths
(120.3) feet to a point; thence by a curve to ;he right with a
central angle of 470 56' 51" and a radius of eight hundred (800)
feet, aong ordi to said State Highway Commission Plan, thirty-
four and o a tenth (34.1) feet to a bolt; thence southeasterly
by and along the southwesterly line of land of the Maine Hamilton
Corporation six hundred sixty and five tenths (660.5) feet to
the point of beginning. Containing 2.05 acres.
By virtue of a Subordination Agreement entered into by the
City of Bangor with Katandin Council Incorporated, Boy Scouts
of America, being dated April 25, 1558, and recorded in the
Penobscot Registry of Deeds, Volume 1622, Page 115, it wag
acknowledged that title to certain land, including that described
herein, was encumbered to the extent Of such sewer assessments
s lawfully assessed by the municipal officers of the City of
Bangor, in accordance with said agreement.
The above described property has now been purchased by the
grantee herein, the sewer
assessment a referred to in
said agreement has been paid ifull, and by these presents the
City of Bangor hereby acknowledge the discharge of the encumbrance
as set forth in said Subordination Agreement, insofar as the same
relates t0 the property described herein.
TO HAVE AND TO HOLD thea Bove described premises,with all the privileges
and appurtenances thereof to the said Railway Express Agency Incorporated, its
successors and assigns forever) so that neither the said City of Bangor, nor its
successors Or any other person or persons claiming from cr under it or them, or
in the name, right or stead of it or them, shall or will, by any way or means,
have, claim or demand any right or title to the aforesaid premises, or their
appurtenances, or to any part or parcel thereof, forever.
IN WITNESS WHEREOF, the said City of Bangor has caused this instrument
t0 be sealed with its corporate seal and signed in its ccrporate name by Ralph
L. Weymouth, its Treasurer, thereunto duly authorized this day of
A.D., 1965.
