THAT, WHEREAS, the general public interest indicates that a new roadway
will be required to connect Ohio Street to Valley Avenue, now therefore, be it
ORDERED, that the City Engineer, acting for and on behalf of the municipal
officers according to lar, lay out a way for street use from Ohio Street at a
point opposite the end of Fourteenth Street, extending easterly toward Valley
Avenue a distance of appmdmately one thousand three hundred (1,300) feet.
Beginning at a point foamed by the extension of the centerline of the exist-
ing 14th Street with the northeasterly sideline of Ohio Street; theca northeast
along a projection of said centerline of 14th Street and on a bearing of N530-15�
a distance of 427.0 feet more or lose to the beginning of a curve to the right,
said curve having a radius of 852.50 feet; thence along the above-mentioned curve
a distance of 664.22 feet to a point; theme continuing along a tangent to the
last escribed curve, am on a beerdng of S �0-06t-3WE, a distance of 237 feet
or leas to the westerly property line of lame M. Potter. Said sny, is laid
out 66 feet wide measuring from the above-described centerline, except that it
is wldecI 10 feet more to the right at the easterly end of the curve, and the
widening increases urriformly to the right along the last tangent to a width of
59 feet right of the centerline at the intersection of the southerly line with
the northerly line of Holland Street; axd the last 0 feet along the northerly
line is widened to coincide with the easterly property line of S. A. Maxfield
Co., Inc.
The above-described way contain 2.08 acres and is shown on City of Bangor
Plan No. 764 which is on file in the offiche of the City Engineer, and be it further
ON=, that the City Engineer proceed to give notice of Such intention of
said municipal officers according to law, by posting such notices for seven (7)
days in two public places In the City of Bangor and in the vicinity of the proposed
way and the City Engineer is further
ORDERED, to make a written return of said proceedings containing the bounds
and ed-meaaur®ante of said way am the damages allowed to the person or persons
for the land taken, all in accordance with the laws of the State of Maim, said

Meaning to describe a strip of land generally sixty-six (66)
feet wide and approximately thirteen hundred (1300) feet long ex-
tending northeast from Ohio Street toward Valley Avenue. The above-
described any contains two and eight hundredths (2.08) acres and is
a part of the same premises conveyed to the Raman Catholic Bishop
of Portland by Edward McSweeney as recorded in Penobscot Registry
of Deeds, Volume 659, page 23, on September 3, 1908; and
Mary Garrity, at ale as recorded in Penobscot Registry of Deeds,
Volume 929, page 309 on December 9, 1920.
There appeared at the time and place set for the hearing
Judge Edward P. Murray, representing the Roman Catholic Bishop of
Portland, J. R. Coupal, Jr., City Manager and J. T. Frawley, City
Engineer. Judge Murray referred to previous discussions which had
been held with regard to the settlement of damages for the land to
be taken and stated that the owners of the land would have no so-
7ectlon to the taking provided that damages be paid in the amount
of fifteen thousand seven hundred dollars (015,700), and further
provided that the City of Bangor convey a quit -claim dead, with
reservations, to the Roman Catholic Bishop of Portland for the City's
right to an existing sewer easement across the land owned by the
Roman Catholic Bishop of Portland.
The recommended damages of fifteen thousand seven hundred
dollars (015,700) are the result of as appraisal done on behalf of
the City of Bangor by Mr. Paul E. Atwood dated January 1, 1965 and
s amended February 15, 1965. A copy of said appraisal report is
attached.
The quit -claim deed would convey to the Roman Catholic Bishop
of Portland a sewer easement which was granted to the City of Bangor
by Moses G. Ries dated May 4, 1886 and recorded in Penobscot Regis-
try of Deeds, Volume 566, page 172; said quit -claim deed would
reserve the right of the City of Bangor to continue to occupy and
use said easement as prescribed in the above-mentioned recording
until such time as the existing sewer is abandoned or relocated by
said City of Bangor, said time not to exceed a period of twenty
(20) years from this date. A copy of the quit -claim deed to the
Roman Catholic Bishop of Portland is attached.
It is recommended that the above-described way be accepted a
a public way and added to the official map to be known as Fourteenth
Street.
It is recommended that the damages and that the conveyance of
the deed as described above be accepted. no above described layout
Is shown on City of Bangor Plan $764, dared February, 1965, which is
on file 1n the office of the City Engineer.

of Ohio Street; thence N 570-00'-30" W along the northeasterly
sideline of Ohio Street for a distance of thirty-five and seventeen
hundredths (35.17) feet to a point; thence N 539-15'-0" E for a
distance of four hundred thirty-nine and nineteen hundredths (439,19)
feet to the beginning of a curve to the right having a radius of
eight hundred eighty-five and fifty hundredths (885.50) feet; thence

the City Manager's Office, the following request was made:
Refigure the report on the assumption that n "Paths -
are to be located between graves. The attached revised paragraphs
indicate a corrected estimate of $14,000 as against $13,700 in the
report.
Owners' representatives contended that the eat imate of
oats to develop e.1. roads, etc., at $10.50 per lot was excessive.
Assume that the costs were $5 less; then the final estimate would
amount to $15,700 as attached.

PROPERTY DESCRIPTION
This property consists of two parcels of land on the northerly
side of Ohio Street, in Bangor, Maine, and extends from Ohio Street
generally to Kenduskeag Stream. Ron -access Interstate highway,
I-95, bisects the property about midway between the east and west
Property lines.
The mildly rolling cleared terrain extends downward and
northerly from Ohio Street to the high banks of the Stream. The
steep stream banks are heavily wooded and, without unreasonable
expense, are not suitable for burial sites at presentLe
The areas involved:

A set of frame buildings are located on Ohio Street.
This property has been acquired and expanded over many years
and is a well-established cemetery in use about 100 years or more.
A system of City sewers has been Installed acros the easterly
part Of the property from 1886 to 1961 period. The extent of any
existing easements or contractual rights 1 not known to your
appraiser. The locations are shown on the accompanying plan. This
report assumesn encumbrance by the sewer lines to the extent of a
Strip of land fifty feet In width and extending free Ohio Street to
450' northerly. Allowance is also made for the severance damage
r loss of utility to parts Of the property due to the location of
the sewer lines.

present Owner.

PROPOSED TAKING AREA
A strip or parcel of land sixty-six feet in width and extending
from Ohio Street northeasterly and easterly to Holland Street and
lands of others. This parcel will physically sever two areas
the easterly part of the property. One, a triangular parcel of
.30 acres abuts Ohio Street, and the other an irregular shaped
parcel abutting in part on Holland Street. The area taken is
2.081 acres, and In part includes sever occupied land.

VALUATION OF LASS OR DANAGe
The past experiences In sales, size of family plots, maintenance
costa and yield per acre are used as the basic data.
The current prices charged, the gross income estimate extended
for the probable aeonoeic life of the rams inders Is discounted to
allow for costs of sales and development.
The net estimated stream of income attributed to the parts
taken or damaged is treated as a annuity and discounted to the
present lump sum worth of future net incomes.
The detailed data is attached. The sales and prices are
supplied through the City of Bangor. The plot sizes and land use
is free survey of the existing developed areas.

oration, located in Penobscot repairs State of Raine, in consideration of one
dollar ($1,00) and other valuable consideration, Paid by the Semen Catholic
Bishop of Portland, a corporate soles located in Portland, Cumberland County,
State of Wioe, its successors and assigns, the receipt whereof is hereby ack-
Bowlegged, Mas hereby quit -claim unto the said Boman Catholic Bishop of Portland,
its successors and assigns fcrever, the existing sewer easement, which the City
of Bangor new has acro @ the property located on the Northeast side of Ohio Street
in said Bangor and more commonly knows as the Nowt Pleasant Cemetery in said
Bangor, said cement being recorded in Beed from Noses G. Rice to the City of
Sextants dated say 4, 1886 and recorded in Penobscot Registry of needs in Volume
566, Page 173, reserving to the City of Unger alt of its present rights in and
to the aforesaid sever easements until such time as the existing sewer easement
is either abandoned or relocated, however, in no event shall such time exceed a
period of Twenty (20) years from the date of this deed.
TO MVS AND To ROhO the above described premises, with all the privileges
and appurtenances thereof, belonging to the said somn Catholic Bishop of Portland,
its successors and assigns forever.
