Addition of Artic1.le 6A.- Residence D Zones

Zoning Ordinance of the City of Bangor, Maine be amended by the addition of
Article 6A _ Residence D Zones as follows:
"Sec. 1 RESIDENCE 0 ZONES. In a Residence D Zone no bjilding, land, or premises
shall be erected, altered, or used except for one or more of the following
sweet
(1) Residence c uses as hereinbefore set out;
(2) Business and professional office building;
(3) Motel, hotel, and social club which meets all the requirements
for residence buildings;
(4) Accessary use customarily incident to any of the above uses.
"Sec. 2 REQUIREMENTS. Building or land erected, altered, or used in a Residence 0
Zone, shell comply with the following requirements:
(1) Residence use. The requirements for residential use
for e C Zane shall apply.
(2) Office uses
(a) Building height limit: Maximum 3 stories but not exceeding
40 feet. (Sea note 1).
Note It Building Height Limit: No building shall exceed three smories

Sire:
Please be advised that the Planning Board has held a public hearing and
given careful consideration to the above changes.
In preliminary action, after the public hearing, they voted to approve
modifications; in the Ordinance as proposed. Thera modifications were suggested by
the Planning Department

Substitute the word "office" for that of "residence" to reed,
"provided that an arrme building etc.-'

These are tmchnl eel changes made to clarify our intent for the controls
and better cover the items.

The Planning Board then gave further consideration to the proposals,
as amended, and Concluded that:
1. Not speech is known an the effects of removing s s

business areas from the Shift in permitted uses.
2. What the results of the Comprehensive Plan will be in
relation to Land use for this a and how this change
would affect--that-future action is uncertain.
3. We don't know enough an how it would effect the existing
character of the area.
0. We are, to effect. only writing a zone change for one
specific use, and would. in the future, be subJect to
Pressure for similar action in other areas.
S. We are, in affect, "spot zoning' for this building and
may be opening avery legal question of ^spot zoning'
with this action, if approved.
Considering these factors, the Planning Board voted to deny all three
proposals.
