agreement with Metcalf 6 Eddy, Inc. for the preparation of final plans and
specifications for a sewage interceptor and treatment system for the City of
Bangor.

Dear Mr. Frawley:
We submit, for your consideration, the following
proposal for engineering services in connection with: the
sewage treatment plant and outfall; the Penobscot west
interceptor; the Kenduekeag main interceptor between the
existing west interceptor sewer in the Kenduekeag Parking
Plaza and a connection for the Maxfield Mill; the Front
Street interceptor; the Kenduekeag Pump Station and force
main; and the Maxfield Pump Station and force main. These
facilities are to be substantially as set forth in our report
to the City of.Bangor dated March 1964, as indicated therein
1n Stages I and II.
It is understood that the authorization to proceed
with the engineering services of this proposal is subject To
the availability of federal and state money for construction
of the works and the procurement of an agreement with Dow
Air Force Base for contributions towards construction coat
and annual operating expenses.

A. Work of Engineers
We would provide the following services:
1. Prepare detail designs, plane, specifications
and contract documents, suitable for obtaining
proposals from contractors for construction and
for Betting forth the requirements of the
project.
2. Prepare estimates of quantities and coat based
upon the final completed plans.
3. Prepareplans and specifications for borings,
soundings, probings or test holes where needed,
4. Furnish one set of contract drawings rendered
in pencil on cloth suitable for use in making
reproductions.
5. Furnish 25 sets of contract documents,
6. Assist the City in securing, tabulating and
analyzing bids for construo:lon and submit
recommendations relative to award of contracts.
%. Assist the City in obtaining the approval of
governmental agencies for the works designed
by us where such approval is required.
8. Should additional flow measurements or sampling
of wastes be required, we would perform such
engineering services with the assistance Of
personnel of the City Engineer's office. We would
make the necessary laboratory analyses of samples.

9. If requested, we would make site inspections,
layouts and studies of alternate locations for
pump stations, force mains, interoaptoes,
connections, the sewage treatment plant, outfall
sewer and appurtenances.
M.. Work of the Cit
The City would, without cost to Metcalf & Eddy, Inc.:
1, Furnleh all data necessary to the design of
the proposed work including topographic maps
showing the locations of property lines, rights-
of-way, underground structures, and utilities,
2. Make all borings, teat holes, probings, or
soundings required.
3. Make all property surveys in connection with
acquisition of sites, rights-of-way or easements
and undertake all negotiations relative to
` acquisition of land easements or rights-of-way.
4. Assist in making any additional flow measurements
or sampling that may be req¢Sred Including services
of a foreman and laborers, vehicles, tools, lights,
safety ropes, gas masks,utensils, and pumps with
operator, where necessary.

5. Make all reproductions of the final drawings.
6. Pay for all costs of publlshing legal notices
and advertisements relative to the receipt of
bids.
C. Compensation
X. For services for the sewage treatment plant and
outfall sewer, compensation is to be 5 percent of the 5etlmated
cost of construction but not less than $92,000. The said
compensation is to be paid In 6 monthly installments of
$10,000 each, plus a final payment.
II. For services for the intercepting sewers and force
mains, with appurtenances including Intercepting, overflew,
and regulating chambers and connections from existing sewers
to the intercepting sewers except as Indicated in paragraph
C -III, compensation is to be 5.2 percent of the estimated cost
of construction but not less than $72,000. The said compen-
sation is to bepaid in 8 monthly installments of $8,000 each,
plus a final payment.
III. For services for the Kenduakeag Pump Station, the
overflow and diversion Chamber at the west Side of Kenduskeag
Stream South Of Washington Street, the connection thence to
the Said pump Station; the Maxfield Pump Station, but not
including devices, changes or connections in or to she mill,

and the Main Street Ejector Station. and connection with the
diversion chamber, at the existirg 15 -in, outlet sewer located
about 500 ft, southwesterly of the Dow Field trunksewer
outlet, compensation is to be 5.9 percent of the este ma`s.
coat of construction but not less than $35,000. The said
compensation is to be paid in 8 monthly installments of
$3,800 each, pus a final payment.
IV. For services, if regdred, in connection with
flow measurement and sampling, ecmpensation is to be on a
time charge plus expense basis, to be derived by applying a
faster of 2.5 :o the salaries of personnel for time charged
to the work, including travel time, plus the out-of-pocket
expenses for travel and subsistence for such personnel while
away from our Boston office.
V. For laboratory work of analyses of samples of
wastes if required, the fee would be $25.00 Per sample, plus
expenses for transportation and shipment.
VI. For the services outlined. in paragraph A-9,
compensation isvto be on a time Charge plus expense basis,
as indicated above in paragraph C -N.
VII'.I, is understood that preliminary layouts and
outline designs are to be submitted to the City Engineer of
Bangor for his approval before proceeding with the complete
detail designs, contract drawings and documents. If after

approval of the preliminary layouts and outline designs
redesign is required because of changes requested by the City,
compensation for those services in connection with such
redesigns. shall be on'a time charge plus expense basia,ae
indicated above in paragraph C -N.
VIII. If detail designs and contract documents are
required to enable the City to receive proposals for altercates,
the estimated :oats of such alternates shall be included tc the
total estimated costs for determination of the compensation by
application of the percentage values set forth in paragraphs
C -I, C -II and J -III.
IX. (a) The estimated cost of construction referred
to in paragrapis C-1, C -II, C -III and C -VIII shall be as
prepared by Metcalf & Eddy, Inc., upon the basis of the final
designs and the then Indicated costs for construction work,
taking into account the prevailing trend as Shown by the
Engineering Mews Record applicable cost indexes, unless
proposals for oonstruatlon are received within 65 days
following completion and approval of the final designs and
contract documents.
(b) If proposals for construction are received
within 65 days following completion and approval of the final
designs and contract documents, the estimated cost of construction
shall be based upon the computed lowest total of the proposals
of qualified bidders which are intended to be used by the City
as the basis for award of contracts,

D. Time for Completion
The final designs and contract documents are to be
completed with_n 10 months after authorization to proceed,
provided that delays beyond the control of Metcalf & Eddy, Inc,
do not result in delay in completion of the engineering services.
If such delays arise suitable additional times shall be granted
for completion of the servioea, Delays In furnishing suitable
data, 'subsoil information, decisions relative to locations,
and time involving alternate designs or redesigns shall be
considered in connection with additional -time of completion
of the engineering services
E. Construction Contracts
This praposal is based upon the assumption that the
construction of the protect is to be carried out under three
construction oDntracta as follows:
Contract 1. The Sewage Treatment Plant and
outfall sewer.
Contras: II. The intercepting sewer, force mains,
and appurtenances, including intercepting, overflow
and regulating chambers and connections from existing
sewers except as indicated for Contract II1.

Contract III. The Kenduskeag Pump Station, With
the overflow and diversion chamber at the west
side of Kenduskeag Stream channel southerly of
Washington Street, the connection thence to the
said pump station; the Maxfield Pump Station but
not including devices and changes or connections
in or to the Maxfield Mill; and the Main Street
E,ector Station, the diversion chamber at the
15 -in. outlet sewer, and connection thereto.
P Litigation and Additional Work
Nothing herein contained shall be construed to obligate
Metcalf & Eddy, Inc, to prepare for or appear in litigation
on behalf of the City of Bangor, to make investigations or
reports, or to supply engineering services not covered by
this proposal, except in consideration of additional compensation
to be mutually agreed upon.
We appreciate the opportunity of submitting this
proposal and your consideration thereof. We are prepared
to proceed forthwith with the designs, drawings, and documents
in the event that authorisation therefor shall be obtained.
