We do hereby agree that we will pay on demand at your office in the City of Bangor the amount of each and all drafts draw against Season College for work completed by you on construction at the site of the new college cp to $50,000.00. We understand that the work consists of the construction of a rcad from genduskeag Avenue and a owner system. Very truly your y 1 Yresi t PSPfdf KNOW ALL MEN BY THESE PRESENTS, that the City of Bangor, a municipal corporation located In Penobscot County, hereinafter called the "City", and Husaon College, a corporation having Its principal place of business in the City of Bangor in the County of Penobscot and the State of Maine, hereinafter called the "College", agree as follows; WHEREAS, the College is presently undertaking the develop- ment of a new campus located in the area between Broadway and Kenduskeag Avenue, north of Bangor Gardens, AND WHEREAS, the City agrees to perform certain services in connection with the construction of said campus, NOW THEREFORE, the City agrees to furnish all labor, plant, equipment, and material and to perform all operations in connection with the construction of an access road extending in an easterly direction from Kenduskeag Avenue for a distance of 2155 feet, the line and grade of said roadway conforming to plans prepared by Whitman & Howard, Inc. and titled "Husson College", Contract #4-103A, sheets 1 through 3 and 3A, dated May 180 1966; said roadway shall consist of a 24 foot wide tar surface on a 24 Inch gravel base with a sod gutter and 11 foot esplanade on the northerly side and a 6 foot wide gravel shoulder and open ditch on the southerly aide, with all attendant grading, top soil, and seeding, and ditch, catch basin, and culvert installation, as shown on City of Bangor Engineering Department drawings C-780, sheets 1 through 4 of 4, dated July 22, 1966. IT IS FURTHER AGREED that the City shall construct a sanitary sewer extending in a northwesterly direction from its existing sewer system on Kenduskeag Avenue to a manhole located on the campus, designated as "SIH#1", as shown on drawings prepared by Whitman & Howard, Inc. entitled "Husson College", contract #4-103A, sheet 2, dated May 18, 19663 said sewer shall be of such capacity and shall Include all appurtenant structures necessary to Inter- cept and transport all sanitary sewage generated by the proposed campus development. IT IS PURIM AGREED that the City will contribute the am Of $50,000 toward the construction of the above-described facili- ties in the form of labor, equipment, and materiel necessary to Paris= the aforesaid work, IT IS FURTHER AGREED that the College will pay any excess cost between the actual completed coat and the Cityta contribution as aforesaid; said actual completed cost will be based upon the direct expenditures of the City for the aforesaid labor, equipment, and material. IT IS FURTREH AGREED that prior to the start of construction of the abovedeseribed facilities, the College will submit to the City a letter of credit from the Eastern Trust & Banking Company of Hanger, Maine, which will insure credit of not less than $50,000; prior to December 31, 1966, the College will deposit the am of $50,000 in place of said letter of credit in a City of Bangor account to be used toward the construction of the above- described facilities. IT IS FURTHER AGRE&0 that the City of Bangor will maintain at its own expense that portion of the sanitary sewer system which lies within the right of way limits of Eenduskeag Avenue, and the College will maintain the remainder of the sanitary sewer and the access road at Its own expense.
