(PrUrr----.Laying out and Taking of Property for Sewage Pumping Station By toe City Canty off1w City of Rancor; ORDERED, TBA%, WHERRAS, the City of Bangor is contemplating the con- struction of an interceptor sewer and sewage treatment plant facil- ity, end, WHEREAS, a pumping station will be required in the vicinity of the outlet of the %enduskeag Stream as a part of the proposed system, and, WHEREAS, it has been recommended that the pump station be located on the southerly side of Washington Street near Broad Street on land presently owned by the Springer Realty Company, now therefore, be it ORDERER, that the City Engineer, acting for and on behalf of the municipal officers according to law, be and hereby is directed to lay out land for said pump station, said land more fully described as follows: Beginning at a point at the intersection of the southerly line of Washington Street and the easterly line of Broad Street; thence east along the southerly line of Washington Street for a distance of one hundred eighteen and twenty-two hundredths (118.22) feet to a point; thence south at right angles to the last-deeoribed line and parallel to the line of Broad Street for a distance of forty-one and eighty-one hundredths (41.81) feet to a point on the northerly line of land owned by Swift & Company; thence west at right angles to the last -described line and along said northerly line of Delft & Company property for a distance of one hundred eighteen and twenty-two hundredths (118.22) feet to the easterly line of Broad Street; thence north along the easterly line of Broad Street a distance of forty-one and eighty-one hundredths (41.81) feet to the point of beginning. The above-described parcel contains approximately four thousand nine hundred and forty (4940) square feet, being the same land and subject to the same rights as conveyed to said Springer Realty Company by Albarney Webber by deed dated February 21, 19489 and recorded in Penobscot Registry of Reeds, Vol. 1297, page 43. There met at the time and place set for the meeting Mr. Paul Rudman and Mr. David Fuller, attorneys representing the Springer Realty Company, and J. T. Frawley, City Engineer. They were In- formed of our Intent to construct a sewage pumping station at the above-mentioned location to serve as a part of the proposed Kendus- keag Stream and Penobscot River interceptor sewer system. They were further informed that, based upon two appraisals of the property, the City Engineer would recommend acquisition payment of twenty-five thousand dollars ($25,000) for the property. Mr. Rudman and Mr. Fuller indicated that the recommended payment was insufficient, end that an appraisal made by their organization indicated a value of thirty -Your thousand five hundred dollars ($34,500). A study was made of appraisals of comparable properties in the adjacent Urban Renewal area in an attempt to determine a comparison to the value of the above-mentioned property. There appeared to be quite a variance in the Urban Renewal land appraisals, however, and, in the opinion of the City Engineer, no definite comparisons could be made. Mr. Fuller pointed oat, however, that the description of the property as stated in the notice did not include the tide flats on the Kenduekeag Stream side of the property, and further stated that previous deeds had carried certain rights as to the use of said flats. It was pointed out that the description in the notice referred to the property as being the same as conveyed to the present owners as iden- tified by deed reference and that any additional rights to the property would be as previously conveyed. Both Mr. Rudmandand Mr. Fuller were reminded of their rights to appeal the recommended acquisition payment, and were assured that the City Mugineer would cooperate in arranging further negotiations.
