ORDERED, THAT, WHERWB, the City of Bangor is presently undertaking the final design of an interceptor sewer system and sewage treatment facility to abate pollution from the Penobscot River in accordance with State law, and, WHEREAS, it is necessary to acquire property for the con- struction of said sewage treatment plant, now therefore, be it ORDERED, that the City Engineer, acting for and on behalf of the municipal officers according to law, be and hereby Is directed to lay out land fcr said sewage treatment plant, said land being the property owned by the Sohn Cassidy Dewiness, located between Main Street and the Penobscot aver south of land owned by the Bocony- Mobil 011 Company, and, be it further ORDERED, that the City Engineer proceed to give written notice of each intention of said municipal officers by posting notices for seven (7) days 1n two public .places and 1n the vicinity of the above-mentioned property, and the City Engineer is further ORDERED, to make a written return of said proceedings containing bounds and ad -measurements of the land taken for said sewage treat- ment plant, together with a list of damages allowed for the land so taken, all in accordance with the laws of the State of Maine, said report to become a part of this order. And that the said City Engineer and at the time and place of meeting specified in the notirm and proceeded to lay out said lend as follows: Y d/� BCH 00052 134-T - 3 Beginning at a point on the southeasterly right of way line Of Main Street, said point being the intersection of the north- easterly line of a right of way owned by the Bangor Hydro -Electric Company, as recorded in Penobscot Registry of Deeds, Volume 1334, page 482; thence southeast along said line of Bangor Hydro-Blectric land for a distance of two hundred and ninety (290) feet more or lees to the line of mean low water of the Penobscot River; thence fallowing the line of mean low water in a northeasterly direction to the southwesterly line of land owned by the Socony-Mobil oil Company, as recorded in Penobscot Registry of Deeds, Volume 628, page 20; thence northwest along said southwesterly line of the S000ny-Mobil 011 property for a distance of four hundred and twenty- two (422) feet more or less to the intersection of the southeasterly line of the Maine Central Railroad right of way; thence southwest along said Maine Central right of way line for a distance of one hundred and ninety (190) feet more or lees to the Southeasterly right of way line of Main Street; thence southwest along the south- easterly line of Main Street for a distance of one hundred and eighty-five (185) feet more or less to the point of beginning. The above-described parcel contains approximately two and Sixty- eight hundredths (2.68) acres and is the soma premises conveyed to John Cassidy by Joseph L. Sm1 th by deed dated June 13, 1898 and recorded in Penobscot Registry of Deeda, Volume 6830 page 37, and by dead from James A. Missell, dated February17, 1899 and recorded in Penobscot Registry of Deeds, Volume U35, page 263. Said land is subject to the same easement rights of the Maine Central Railroad and the Socony-Mobil 011 Company, as described in said deeds, and to the United States of America= as described in Penobscot Registry of Deeds, Volume 1170, page 240. Said land is currently owned by the John Cassidy Devlseeeo being Mr. John Cassidy, III, Mise Barbara Cassidy, Mrs. Edythe R. Dyer, Mrs, Jane M. Sullivan, Mrs. Roselle M. Myth, and Mrs. Joan C. Stetson. There appeared at the time and place set for the meeting Mae Barbara Cassidy, Mr. John Cassidy, III, Mr. Ralph A. Dyer, II, representing Mrs. Edythe R. Dyer, Thomas Needham, Associate City Solicitor, and J. T. Frawley, City Engineer. Those present were informed of our plane for the use of the property and were advised that payment for the land in the amount of twenty-seven thousand dollars ($27,000) had been recommended. It was further agreed, in accordance with previous negotiations that the city would pay twenty-nine thousand dollars ($29,000 for said land provided that the co-owners would agree to furnish a deed for said land. Mr. John Cassidy and Miss Barbara Cassidy stated that they would agree to furnish a dead for twenty-nine thousand dollars ($29,000) and indicated that those 00 -owners who were not present were also in agreement with that proposal. Mr. Ralph Dyer, however, indicated that the price of twenty-nine thousand dollars ($29,000) was not satisfactory. Those present were than informed that it would be necessary for the city to condemn the prop arty at the original figure of twenty-seven thousand dollars ($27,000). BCH 006553 134-T - 4 It is therefore recommended that the land as described above be established as the site for the proposed sewage treatment plant and that payment in the amount of twenty-seven thousand dollars (427,000) be made for said lend.
