Amending Chapter vr1 Article s section 1 - Curfew Be u ordained by the My Coamdd oft1w CfAy ofBamyor, as foll eu That Chapter VII, Article 5 of the revised City Ordinance=., as amended, be further amended by repealing Section 1 in its entirety and replarung it with the following new Section 1 - Curfew: Section 1: 1 .1 It shall be unlawful for any person under the age of 14 years to be on or present in any public street, sesame, alley, park or other public place In the City of Bangor between the hours of 9:30 P.M and 5:00 o'clock A.M. of the following day, official city time, unless accompanied by his or her parent or guardian, or person having lawful custody and control of his or her person, or unless there exists a reasonable necessity therefor. The fact that said child, unaccompanied by parent, guardian, or other person having legal custody, is found upon any street, alley or public place after 9:30 P.M, or before 5:00 o'clock A.M. of the following day, shall be prima facie evidence that said child is there unlawfully and that no reasonable excuse exists therefore. 1.2 It shall be unlawful for any person under the age of 18 years and over the age of 14 years to loiter, loaf or Idle on or about any public street, avenue, alley, park or other public place in the City of 131-T ,FT- CEEVED ORDINANCE 1966 mol('q Ai+11f(jP,) Amending Chao. IN CITY COUNCIL June 13, 1966 C CLERK This ordinance Having received two readings, being properly certified as correctly engrceeed, was finally PASSED by the following yes and no vote: Councilors voting yes: Baldacci, Barry, Brountas, Brown, Houston, Hughes, Hart, Mins'p, Porter. -2 - (TITLE) ORDINANCE, Amending Chapter VII, Article 5, Section 1 - Curfew Bangor between the hours of 9:30 P.M. and 5:00 o'clock A.M. of the fallowing day, official city time. 1.3 Unless a reasonable necessity exists therefor, no parent, guardian, or other person having the legal custody of any minor under eighteen years of age shall allow or permit such minor to be or remain upon any street, alley, or lane or in any public place, restaurant or saloon, in this City, nor shall any restaurant or saloon -keeper or person In charge therefor for the time being, allow or permit such minor to be or remain in or upon his premises within the hours prohibited in the preceding section. 1.4 Sale of Cartridge to Children Under Sixteen. No person shall sell to any child under the age of sixteen years, without the written consent of a parent or guardian of such child, any cartridge of fixed ammunition or blank cartridge, or any gun, pistol or other mechanical contrivance arranged for the explosion of such cartridge. Note: The effects of this amendment are threefold 1. Whereas at the present time the entire curfew provision pertains to children "under sixteen", this amendment pertains to children "under fourteen" in which case being upon a public street, avenue, alley or park is prima facie evidence of "loitering, loafing or Idling" and a child between 14 and 18 which provides merely that it shall be unlawful for such people to "loiter, loaf or idle." 2. This amendment specifically Includes "parks" as an area within which it shall be unlawful for children under 18 to be during the hours prescribed. 3. Whereas the present ordinance says only that it shall be unlawful for them to be In these places "after 9 o'clock In the afternoon" this new provides a specific time period "9:30 p.m. or before 5 o'clock a.m."
