as established by the Boeing Ordinance of the City of Bangor on January ], 1954, as
amended, be hereby further emended as follows:
Change from Agriculture to General Business Zone a portion of land on the
easterly aide of Hogan Road between Ht. Hope and interstate 95 being more
particularly described as follows:
Beginning at the intersection of she northerly sideline of Mt. Hope Avenue and
the easterly sideline of Hogan Road{
Thence in an easterly direction for a die tante of 793 feet, more or less, to the
southwest corner Of the Mahoney Land.
Thence in a northerly direction by and along the land of Mahaney for a distance
of 3,160 feet, more or Less, to a point which is the northwest corner of the Mahoney
land.
Thence in a westerly direction for a die targe of 300 feet, more or less, to a
point being the northeast corner of she Chadwick -Ba Ross land.
Thence in a southerly direction by and along Chadwick -Ba Rosa east line for a
distance of 400 feet, more or leas, to a point being the southeast corner of Chadwick -
Be Boas land.
Thence in a westerly direction for a distance of 200 feet, sabre or lees, by and
along Chadwick -Ba Roes to a point on the east sideline of the Sun Oil Company.
Thence in a southerly direction along the Sun Oil east line for a distance of
730 feet, more or leas, to a point being the southeast corner of the Sun Oil land.
Thence in awesterly direction along the south lice of Sun Oil for a distance of
200 feet, exact orless, to the east sideline of the Hogan Road.
Thence in asoutherly direction along the east sideline of Hogan Road for e
distance of 2,LSSfeet, more or less, to the point of beginning.
The above being intended to describe part of Lot 11 and all of Lot -4 of Rural
Sheet 70, City of Bangor Assessors Maps.

pay the assessment which will be made againax said
property covering the proportionate share of the coat
of the construction of a new sewer.

amended, be hereby further amended as follows:
Change from Agriculture to General business Zona a portion of land on the
easterly side of Hogan Road between Mt. Hope and Interstate 95 being more
particularly described as follows:
From a point on the easterly sideline of Hogan Road and which is the point
of intersection of the south line of Sun Oil Co. property and the east line of
Hogan Road, southerly 20 feet along the east line of Hogan Road to a point, which
is the point of beginning of this description.
Thence southerly for six hundred (600) feet along Hogan Road to a point.
Thence in an easterly direction add at a right angle to Hogan Road for six
huedred (600) feet to a point.
Thence in a northerly direction and parallel to Hogan Road for six hundred
(600) feet to a point.
Thence in a westerly direction along the proposed right of way for six Hundred
(600) feet more or less to a point, said point on the easterly line of Hogan Road
being the point of beginning.

SUBJECT: City Council Order 100-T - Change from Agriculture to General Business
e portion of land on the easterly side of Hogan Road between Mt. Hope
and Interstate 95
Gentlemen
Please be advised that the Planning Board held a public hearing on
April 25 with respect to Ne above requeaq and took final action on May 2.
The Board gave very careful consideration to the zoning request and its
effect on and relation to our Comprehensive Plan for the development of the city.
In its deliberation, the Board considered factors such as:
1. The Lack of sound control when an area is zoned,
2. Effect of a sizeable change in zoning --in respect to
the Comprehensive Plan Study under way, including a
new Land Use Plan and Zoning Ordinance,
3. Effect of tax loss to the city,
4. Needs of business for new location,
5. Proposal Each too broad, at this time, with little
ides of the type of future development,
6. No guarantee (lack of firm commitment) that proposed
business would be bulli --considering that the Planning
Board previously zoned property w the belief it xaa
for similar use,

on the vocational School development across Hogan Road,
B. Careful consideration must be made for this interchange
area to secure the best development of our last interchange,

After consideration of the proposal, the planning Board voted four to
one to deny the zoning request.

Gentlemen:
As attorney for Ralph A. Byer and John J. Davis, o of the land
described herein below, request i respectfully submitted form rZone change
from Agricultural to General Business.
The land located at Mt. Hope Avenue and Hagan Read is well suited
for business uses. It has not been used for agricultural purposes for a good
number of years,
The area may be defined as.
"Commencing at the intersection of the northerly sideline of Mt.
Hope Avenue and the easterly sideline of Hogan Road; thence a distance of
793 feet, more r less, in a easterly direction on Mt. Hope Avenue to land
of Mahaney; thence northerly by and along Land of Mullaney a distance of 3160
feet to the northerly boundary of Bangor Hydro -Electric Company right of way;
thence westerly to land of Chadwick-BaRoss; thence southerly by and along
Chadwick-BeRoss land 400 feet; westerly 200 feet to land of Sun Oil Company;
southerly by land of Sun 011 Company 1000 feet, more or lees; thence westerly
o Hogan Road; [Fence so"therly by and along Hogan Road to the point of be-
ginning."
Several local businesses are
vitally interested i this land and
prepared to occupy a large portion ofit immediately upon the Zone change.
Time is most important. The land owners will be appreciative of
your prompt attention to this request.
