THAT the City Treasurer is hereby authorized to accept
the attached dedication from Sampson-Hipley. Inc. for a strip
of land along the southerly line of the Federal Bailding property,
said strip of land being approximately two feet three inches
(2' 3" ) wide and extending from Harlow Street to %enduskeag
Stream, to be used as part of a right of way for the construction
of a street, said construction to be contingent upon the receipt
of two thousand dollars (62,000.00) from the United States of
America.

KNOW ALL MEN BY THESE PRESENTS, That, SAMPSON-RIPLEY
INC., a corporation duly organized by law and having its
Principal place of business in Bangor, County of Penobscot
and State of Maine,. hereby petition the Municipal Officers
Of the City of Bangor, County of Penobscot and State of
Maine to ley out the following town way:
Next Southeasterly adjacent and contiguous to
the easement granted by the United State, of
America On October 29, 1965 to the City of
Bangor, of a passway from Harlow Street to
Kenduakeag Stream, known as Sibley Court, Ten
(10) feet in width, its Southeasterly bound
being a copper pin in the Southwesterly line of
Harlow Street and extending in a Southwesterly
direction 900 20t 7"; the herein offer of
dedication Is from said line to the Northwesterly
face of the brisk building on that lot or parcel
Of land conveyed to the herein petitioner by
John Atwood, et els by warranty deed dated July 16,
1958 and recorded in the Penobscot Registry of Deeds
at volume 1644, Page 49 to which reference is hereby
made for more particular description; the offer of
dedication being for the purpose of widening said
Ten (10) foot way approximately two feet three
Inches (21 3").
An 'approval ofthis petition by the Municipal Officers
shall be an acceptance of the offer of dedication, whereby
said Municipal Officers shall install and maintain a street
on said Sibley Court and the strip herein offered.
IN WITNESS WHEREOF the said Sampson -Ripley Inc., has
Caused this instrument to be sealed with its corporate seal
and signed in its corporate name by Richard Sampson, its.
President, thereunto duly authorized this sixteenth day of

FERN STREET
The line of Fern Street near its northerly terminus Is
altered as follows:
Beginning at a point on the existing center line of Fern
Street located 1875.75 feet north from the northerly sideline of
Mt. Hope Avenue, said center line having a bearing of N 100 331
17" W; thence deflecting westerly an a curve having a radius of
120.00 feet for a distance of 106.76 feet to a point; thence
W 610 31142" W for a distance of 293.23 feet to the southerly
sideline of Stillwater Avenue.
The new right-of-way was laid out 66 feat wide measuring
at right angles to the above-described center line, with the
sidelines extended or shortened to meet the sidelines of inter-
secting streets.
Fern Street Grade
The existing grade of Fern Street between Mt. Hope Avenue
and Stillwater Avenue has been altered as follows:
Beginning at the northerly sideline of Mt. Hops Avenue at
elevation 152.00; thence ascending on a grade of 6.0% for a
distance of 100 feet to elevation 158.00; thence an a 100 -Toot
vertical curve having an external of .35 feet to elevation 162.68;
thence continuing to ascend on a grade of 3.36,5 for a distance of
100 feet to elevation 166.04; thence on a 200 -Toot vertical curve
having an external of .70 feet to elevation 169.92; thence con-
tinuing to ascend on a grade of 0.5225 for a distance of 380 feet
to elevation 171.39; thence on a 160 -foot vertical curve having
an external of .10 feet to elevation 172.97; thence continuing
to ascend on a grade of 1.469,5 for a distance of 90 feet to

radius of 550.00 feet for a distance of 339.06 feet; thence
N 680 33' 23" W for a dist soca of 423.01 feet; thence deflecting
northerly on a curve having a radius of 400.00 feet for a dis-
tance of 298.60 feet; thence N 250 47' O6" W for a distance of
503.20 feet; thence deflecting westerly on a curve having a
radlgs of 806.46 feet for a distance of 466.83 feet; thence
N 58 57' 06" E for a distance of 334.84 feet to the southerly

Said right-cf-way has been laid out 70 feet wide measuring
at right angles to the above-described center line, with the
sidelines lengthened or shortened to meet the sidelines of inter-
secting streets.
Howard Street Grade
Beginning at the northerly sideline of Mt. Hope Avenue at
elevation 142.87; thence ascending on a grade of 1.020,4 for a
diatance of 80 feet to elevation 143.69' thence on a 140 -foot
vertioal ourve having an external of .9A feet to elevation 149.37;
thence continuing to ascend on a grade of 6.6334 for a distance

The existing right-of-way of Birch Street between Mt. Hope
Avenue and Stillwater Avenue has been altered and extended as
follows:

Beginning at the easterly sideline of Birch Street at

line of Juniper Street. The right-of-way, has been laid out
50 feet wide measuring at right angles to the above-described

The grade of the existing portion of Bates Street is
altered and is extended along the new portion of the right-of-

146.10; thence ascending on a grade of 1.26% for a distance of

thence ascending on a grade of 0.44% for a distance of 335 feet
to elevation 148.74; thence along a 100 -root vertical curve
having an external of .20 feet to elevation 148.40; thence
descending on a grade of - 1.156% for a distance of approximately
130 feet to the center line of Juniper Street at elevation

HARVARD STREET
The existing right-of-way of Harvard Street 1s altered and
extended from the new Dartmouth Street right-of-way to the new
Bates Street right-of-way, as follows:
Beginning at a point on the northerly sideline of Bates
Street located 466.76 feet west from the westerly sideline of
Dartmouth Street; thence deflecting northerly along a curve
having a radius of 237.54 feet, the tangent of which is perpen-
dicular to the sideline of Bates Street, for a distance of
124.84 feet; thence W 100 39' 55" W for a distance of 899.51
feet to the southerly sideline of Dartmouth Street.
The right-of-way has been laid out 50 feet wide measuring
at right angles to the above-described center line, with the

The existing right-of-way of Yale Street has been altered
so as to extend to Harvard Street at its northerly terminus
and so as to extend in a southwesterly direction to Pearl
Street near its southerly terminus, as follows:
Beginning at a point on the easterly sideline of Pearl
Street located 324.06 feet n8rth from the northerly line of
Mt. Rope Avenue; thence W 79 261 43" H for a distance of
212.74 feet; thence deflecting northerly along a curve having
a ragius of 900.00 feet for a distance of 356.26 feet; thence

There appeared at the time and place set for the meeting
City Solicitor Abraham J. Stern, City Engineer John Frawley,
and Judge Edward P. Murray, representing Ella M. McCann. It
was noted by the City Engineer that no damages were recommended
as a result of the proposed laying -out inasmuch as it was felt
that the new street Sines and grades would benefit the adjacent
properties. Judge Murray indicated that he did not agree with
the recommendation of no damages insofar as the Ella McCann
property on Pearl Street was concerned, but he did not indicate
his opinion as to the reason for damage or the extent of damage.
It is recommended that the above-described streets be laid
out and accepted as town ways and that said streets be added to
the Official City Map.
