State Highway Commission Re: Stillwater Sewer Extension

ORDERED,
THAT, WHEREAS, a sewer is presently being constructed by Clifford
Bailey to service a section of Stillwater Avenue and,
WHEREAS, the City of Bangor is a party in this construction in as much
as it is contributing a share of the cost to pay for a larger sewer pipe than
would otherwise be installed and,
WHEREAS, the City of Bangor will became the owner of the sewer upon
completion and,
WHEREAS, it is necessary to acquire from the State Highway Commission
a right of way across a portion of land which was acquired by said Highway
Commission for the construction of Interstate Route 95, now
THEREFORE, be It ordered that the City Manager be and is hereby
authorized to enter into an agreement with the State Highway Commission
Re obtain the necessary easement over the land owned by due State Highway
Commission for the proper construction of the sewer.

THIS AGEMM NT entered into this day of in the year of
our Lord we thousand nine hundred and sixty-five, by and between the State of Maine, acting
by and through its State Highway Commission, duly authorized by the Iowa of the State of Maine
and hmroLufter "famed to as 'the State', and the City of Burger by its City Manager, duly
authorised thereto by vote of the City Council, and hereinafter referred to as 'the City',
witnesseth:
'Me State' agrees as follows:
1. That in consideration of the agreements by'the City' as hereinafter set forth
it does hereby grant a revocable easement to 'the City' as follows, to wit:
The right to enter upon land outside of the controlled access limits
of Interstate Highway 1195n in the City of Ranger acquired by Us State'
from Kwood K. Grant aha Havel A. Grant by Warranty Deed recorded in
Penobscot County Registry of Deeds in Book 16p1, Page 122, and as shown
on a Right of Way Map, State Highway 95, Conger, Federal Aid Project
I-95-8(17), dated July 1958, S.H.C. File No. 10-ll3, and recorded in
said Registry in Plan Book 21, Page 63, a print of which is attached
hereto, for all purposes necessary and incidental to the laying o
installation of and the future maintenanes of a ewer pipe line, amid
easement to be fifty (50) feet in width and lying twenty-five(25) feet
on either side of the ewer pipe line.
2. That said easement will not be revoked until and unless the land crossed by
said casement and the ewer pipe line shall be found and determined by 'the
State' to be necessary and required to be used for use, expansion, or maintenance
of the highway.
3. That it will give Rhe Citytwelve (12) months notice of its intention to utilize
the land for such use, expansion, or maintenance.
'The City' agrees as follows:
1. That it will use the granted easement only for the puricuee specified.
2. That it will restore the land area within the granted casement to a condition
equal to that new elating upon completion of the installation of the sorer pipe
line or at any time in the future upon the completion of any maintenance operations
requiring disturbance of the area.
3. That on receipt of notice from 'the State' of its intent to utilize the land for
the use, expansion, or maintenance of the highway, it will either remove the ewer
pipe ]nine from the land or relocate it in a manner to he determined by the
requirements of and as established by 'the State' within twelve (12) months
following receipt of each notice of intent.
