the City of Bangor as established on January ), 1954 as amended be hereby amended
as follows:
Change from Residential "A" Zane to Residential "C" Zone a portion of land
south of Hammond Street and east of Boa AFB, being more particularly described as
followa:
Beginning at a point 104.88 feet south of the south aide line of Hammond
Street and on the vest side line of the Sawyer property.
Thence in an easterly direction for a distance of 171.26 feet more or less
to a point on the east side line of a proposed rlght-of-way known as Carmen Avenue.
Thence in a southerly direction and along the east side line of proposed
Carmen Avenue for a distance of 14 feet more or less to a point.
Thence in an easterly direction for a distance of 106.5 feet more or less
to a point.
Thence in a southerly direction for a distance of 1,125 feet more or less
to a point.
Thence in aorthwesterly direction for a distance of 425 feet more or less
to a point being on the east Side line of Bow ABA.
Thence in a northerly direction along the east side line of Dow AFB for a
distance of 891.89 feet more or less to the point of beginning.
Thus describing a tract of land containing Parcels B then 45 of the Assessors
Nap. No. 2 of the City of. Bangor containing 8 acres more or lees.

RE: Council Order 5IV - Zoning Change
A few weeks ago, 1 had the occasion to check a umber of deeds i the
subject subdivision off Banmond Street. Although my search was not exhaustive,
I found no restrict'ans of any nature in the eight or ran deeds that I checked.
The only possible restriction or encumbrance upon the remaining land which Mr.
Sawyer has purchased is Me fact that the recorded plann shows a extension of the
street plan in the a which has never been constructed. Thisitself, would
n
not necessarily prohibit a change in land use for tha remaining undeveloped portion
of thesubdivision.
The whole area regarding deed restrictions or plan restrictions involves
one f private rights, so it does not seem necessary for the Planning Board to
attempt to resolve the question of the nature and extent of such
rights when a
rude change requested. Sin any action that the Planning Board takes would have
no effect whatsoever onsuch private rights, if they do exist, then such rights
only represent another hurdle which the developermust overcome In order to
effectively devote the land to a use other than that envisioned in the sub-
division plan.
The question of whether or not the zone change requested is appropriate
should act be determined by the existence or -existence of any private rights,
but rather should be made upon the basis of whether or the requested change
represents anappropriate a of such land and is in conformity with the master
plan adopted by the Planning Board.

problemvolves the rights of private individuals, they are certainly free to
seek a legal determination of this for themselves.
