ORDERED,
THAT the attached report of the Oity Engineer relative to
the laying out and acquisition of easements from the Maine Central
Railroad for the installation and future maintenance of the Penob-
scot interceptor sewer be and hereby is accepted, and be it further
ORDERED, that said easements be and hereby are established sub-
ject to the Revised Statutes of the State of Maine and my pro-
visions therein pertaining to said establishment,

And that the said City Engineer met at the time and place of meeting mounted in the nerhem
and proeeeded to la wt, said sewer easements within the limits as shown
on City of Bangor Plan S-656, sheets 1 through 3 of 4, end titled
Right of Way Plan Penobscot Interceptor, dated September 22, 1966,
and more specifically described as follows:

Prom Sta, 1 + 64 to Sta. 7 + 10 in a southwesterly direction
from the site of the sewage treatment plant,
From Sta, 0 + 78 in a northerly direction to the southerly
line of land owned by the Barrett Division of Allied Chemical
at Sta. 26 + 43.
From Sta. 32 + 98 at the north line of land owned by
Barrett Division of Allied Chemical and extending in a northerly
direction to Eta, 56 + 60 at the westerly line of land owned by
Bacon & Robinson Company,
From Sta. 57 + 77 to Sta. 58 + 54 at the north line of land
owned by Creiw Corporation,
From Sta. 70 + 10 on the northerly right of may line of Union
Street to Eta, 70 + 58 on the easterly line of Broad Street.
From Sta, 6 + 03 on the southwesterly line of Railroad Street
on the Davie Brook Interceptor connection In a westerly direction
to Sta, 7 + 25,
The Barkersv111e interceptor connection extending northwest
from Sta, 10 + 32 on the main interceptor for a distance of ap-
proximately 240 feet,
All of the above-described easement lines are located on
property of the Maine Central Railroad as shown on Plans No,
V3/54 and V3/55 and titled Right of Way and Track Map Maine
Central Railroad and dated June 30, 1916,
The Intent of the laying out is to permit the installation
and future maintenance of the interceptor sewer and appurtenant
structures in the above-described location.
There appeared at the time and place set for the meeting
Mr, J. W. Wiggins, Archie Knowles, Legal Counselor, Jerome Knowles,
Jr„ Appraiser, and Arnold Veague, Attorney, all representing
the Maine Central Railroad; Paul Atwood, Appraiser, Thomas Needham,
Associate City Solicitor, J. T. Frawley, City Engineer, representing
the City of Bangor. The intent and purpose of the proposed laying
out was made known to those present and the question of damages
was discussed. Representatives of the Maine Central Railroad fin-
ally agreed that they would not contest the laying out as indicated
subject to the payment of twenty-five thousand dollars ($25,000)
damages, It was further understood that the sewer easement would
not prohibit the installation of tracks or other surface structures
within the easement area or any other structure which would not
prevent the proper and convenient maintenance of the sewer in the
future. The responsibility of the city and the contractor pertain-
ing to track removal and crossings was also discussed and those
present were Informed that representatives of the Railroad had
previously reviewed the construction plans and specifications and

had Indicated their approval as to the methods of construction
control.
It is therefore recommended that the easements be established
as described above and that peymant of damages in the amount of
twenty-five thousand dollars (j25,000) be made to the Maine Central
Railroad,
