The above-described elevations refer to U..S,G;S. Datum, which is 9.65 feet lower than City of Bangor Datum, The above-described line and grade are shown on City of Bangor Engineering Department Plan No. 810 entitled "Line and Grade of Bomarc Road" dated December 1, 1966 which is on file in the office of the City Engineer, There appeared at the time and place set for the meeting Mr. Peter Schwartz, representing the Bomarc Corporation which has dedicated the land for the above-described right of way: Mr, Norman Palmer, owner of land adjacent to said right of way, and J. I. Frawley, City Engineer, It was pointed out to those present that no damages would be recommended for the proposed lay- ing out. It was agreed that the city would accept and maintain the right of way as well as the existing roadway and attendant drainage structures within said right of way in exchange for the dedication of the right of say. Neither person objected to the laying out. It is therefore recommended that the right of way as described above be accepted as a public way to be named and known as Bomarc Road, It is also recommended that all existing private utilities which are located within said right of way be subjected to the same conditions of maintenance, renewal or relocation as outlined in the Statutes of the State of Maine for utilities in a public right of way. Peter Schwartz and his a ociates for the accep- tance of the proposed Public Way from Burleigh Road to the present entrance fence of the Senate facility due to the need for conformation of the pro- posed legal description of such right-of-way by the City of Bangor Enginee- ring Bepartment. Conference last week revealed new monuments not reflected in the present proposed deed to the city. The Planning Staff continues to work actively with the owners to locate and define the extent of the Public Way beyond the entrancefence. It presently appears that a 60' wide Public Righbof-Way is feasible within the site. The Planning Board will render its final decision as soon as the remaining engineering work is done. The entire parcel acquired by Messrs. Schwartz, Walsh and Hughes has been conveyed by them to Secure Corporation, a Mainecorporation organized by them to develop the propert. Bomarc Corporatism respectfully requests that the City of Bangor accept a conveyance by deed of this roadway and thereafter own and maintain the road as a public way.
