ORDERED,
TEAT the attached petition from the Bomarc Corporation for
the acceptance of a right of way extending west from Burleigh
Road to the Bomarc property be and hereby is received, and be it
further
CRDERED, that the City Engineer, acting for and on behalf of
the municipal officers according to law, be and hereby is directed
to lay, out by metes and bounds and to establish a grade for said
street in accordance with the description in the deed accompanying
said petition, and be it further
ORDERED, that the City Engineer, acting for and on behalf of
said municipal officers, proceed to give written notice of such
intentions of said municipal officers by posting notices for seven
(7) days in two public places in the City of Bangor and in the
vicinity of the proposed laying out, and the City Ragineei is
further
CRDERRD, to make a written return of said proceedings containing
bounds and ad -measurements for said street, together with a list of
damages allowed to each person for all land so taken or for any
benefits resulting to the property owners as a result of the
laying out, all in accordance with the laws of the State of Maine,
said report to become a part of this order,

Beginning at a point on the northerly right of way line of
Burleigh. Road, said paint being opposite a point an the centerline
of Burleigh Road located 1316,83 Peet southwest from the centerline
of Essex Street; thence at right am. lea to said northerly line of
Burleigh Road on a bearing of N 39°48'03" W along a line hereinafter
referred to as Tangent A for a distance of 1236,00 feet to a point;
thence E 25028'38.2" W along a line hereinafter referred to as
Tangent B for a distance of 1368.19 feet to a point; thence contin-
uing along a line which is parallel to but 10 feet northeasterly
from Tangent B for a distance of 334 feet to a point; thence de-
flecting 5030100" to the left for a distance of 96.00 feet; thence
deflecting 5030"00" to the right and continuing on a bearing of
N 25°28'38,2" W for a distance of 826.00 feet to the end. The
above-described line represents the centerline of a right of way
which is laid out to a width of 82 feet along Tangent A for a width
of 66 feet along Tangent B and for a width of 60 feet for the re-
maining distance. The above-described right of way is a portion
of Tracts A 107 and A 103, and all oI Tracts A 108 and A 109 as
conveyed t0 Peter Schwartz at als by the United States of America
by deed dated July 13, 1966 and recorded In the Penobscot Registry
of Deeds, Volume 2062, page 338.
The City Engineer proceeded to establish a grade for said road-
way as follows:
Beginning on the northerly edge of the travel way of Burleigh
Road at elevation 243.90; thence ascending on a 40 foot vertical
curve to elevation 244.35; thence continuing to ascend on a grade
of 1.43% for a distance of 100 feet to elevation 245.78; thence
ascending on a 100 foot vertical curve having an external of .05
feet to elevation 247.03: thence ascending on a grade of 1.07% for
a distance of 300 feet to elevation 250.24; thence descending along
a 200 foot vertical curve having an external of .57 feet to elevation
250.20; thence descending on a grade of -1.10% for a distance of
100 feet to elevation 249.10; thence descending on a 100 foot verti-
cal curve having as external of05 to elevation 248,21; thence
descending on a grade of -0.68% for a distance of 150 feet to sleva-
tioa 247.27; thence ascending along a 200 foot vertical curve having
an external of 48 Peet to elevation 247,75; thence ascending on a
grade of 1.25,E for a distance of 450 feet to elevation 253.37; thence
ascending along a 100 foot vertical curve having an external of
06 feet to elevation 254.87; theme ascending on a grade of 1.72%
for a distance of 600 feet to elevation 265.18; thence ascending
an a 100 foot vertical curve having an external of 08 Peet to
elevation 267.21; thence ascending on a grade of 2.368 for a die-

distance of approximately 150 feet to the end of said roadway at
elevation 287.28. The above-described elevations refer to U..S,G;S.
Datum, which is 9.65 feet lower than City of Bangor Datum,
The above-described line and grade are shown on City of Bangor
Engineering Department Plan No. 810 entitled "Line and Grade of
Bomarc Road" dated December 1, 1966 which is on file in the office
of the City Engineer,
There appeared at the time and place set for the meeting
Mr. Peter Schwartz, representing the Bomarc Corporation which
has dedicated the land for the above-described right of way:
Mr, Norman Palmer, owner of land adjacent to said right of way,
and J. I. Frawley, City Engineer, It was pointed out to those
present that no damages would be recommended for the proposed lay-
ing out. It was agreed that the city would accept and maintain the
right of way as well as the existing roadway and attendant drainage
structures within said right of way in exchange for the dedication
of the right of say. Neither person objected to the laying out.
It is therefore recommended that the right of way as described
above be accepted as a public way to be named and known as Bomarc
Road, It is also recommended that all existing private utilities
which are located within said right of way be subjected to the
same conditions of maintenance, renewal or relocation as outlined
in the Statutes of the State of Maine for utilities in a public
right of way.

Gentlemen
The Planning Board and staff have been unable to act on the pro-
posal as submitted by Pr. Peter Schwartz and his a ociates for the accep-
tance of the proposed Public Way from Burleigh Road to the present entrance
fence of the Senate facility due to the need for conformation of the pro-
posed legal description of such right-of-way by the City of Bangor Enginee-
ring Bepartment. Conference last week revealed new monuments not reflected
in the present proposed deed to the city.
The Planning Staff continues to work actively with the owners to
locate and define the extent of the Public Way beyond the entrancefence.
It presently appears that a 60' wide Public Righbof-Way is feasible within
the site.
The Planning Board will render its final decision as soon as the
remaining engineering work is done.

Dear Mr. Coupal:
A description of a roadway on the Bomarc property is
delivered herewith to you 1n form of a copy of the proposed
deed. The entire parcel acquired by Messrs. Schwartz, Walsh
and Hughes has been conveyed by them to Secure Corporation,
a Mainecorporation organized by them to develop the
propert.
Bomarc Corporatism respectfully requests that the City
of Bangor accept a conveyance by deed of this roadway and
thereafter own and maintain the road as a public way. Should
the City Council or the administrativeoffices require say
information on this project, I shall be pleased to have the
opportunity to assist.
