THAT the City Manager be and is hereby authorized to
enter into an agreement with Metcalf & Eddy, Inc, for the
preparation of final plans and specifications for the Kenduskeag
Stream interceptor sewer and the Penobscot East interceptor sewer
In accordance with their proposal dated July 11, 1967, A copy

Dear Mr. Frawley:
We submit, for your consideration, the following proposal
for engineering services to connection with: the Penobscot east inter-
ceptor from the Hancock Street connection to and including a connection
for the Woodlawn trunk sewer near Cascade Drive, located about 500 ft.
Westerly of the Bangor Dam; the Kenduskeag main interceptor from the
existing west interceptor sewer in the Kenduskeag Parking Plaza to and
including a connection for the Blanchard Street sewer; the Maxfield
Pump Station and force main; and the Kenduskeag east interceptor. These
facilities are W be substantially as set forth in our report to the City of
Bangor dated March 1964, including the required stream crossings, con-
nections, and appurtenant intercepting and over -flow structures.
A. Work of Engineers
We would provide the following services:
1. Prepare detailed designs, plans, specifications, and contract
documents, suitable for obtaining proposals from contractors
for construction and for setting forth the requirements of the
project.
3. Prepare estimates of quantities and cost based upon the com-
pleted designs.
3. Prepare plans and specifications for borings, soundings,probings
or test holes as required.

4. Furnish one set of contract drawings rendered in pencil on
cloth suitable for use in making reproductions.
5. Furnish 25 sets of contract documents, except contract
drawings.
6. Assist the City in securing, tabulating, and analyzing bids
for construction and submit recommendations relative to
award of contracts.
7. Assist the City in obtaining the approval of governmental
agencies for the works designed by us where such approval
is required.
8. Should additional flow measurements or sampling of wastes
be required, we would perform such engineering services with
the assistance of personnel of the City Engineer's office. We
would make the necessary laboratory analyses of samples.
9. If requested, we would make site inspections, layouts, and
studies of alternate locations for the pump station, force main,
interceptors, connections, and appurtenances.
B. Work of the City.
The City would, without cost to Metcalf & Eddy, Inc.:
1. Furnish all data pertinent to the design of the proposed work
including suitable topographic plans showing the locations of
property lines, rights-of-way, existing buildings, underground
structures, streets, watercourses, exposed ledge rock, stream
or river front structures, dams, bridges, and utilities.
2. Make all borings, test holes, probings, or soundings as required.
3. Make all property surveys in connection with acquisition of land,
easements or rights-of-way.
4. Assist in making any additional flow measurements or sampling
that may be required including services of a foreman and
laborers, vehicles, tools, lights, safety ropes, gas masks,
utensils, and pumps with operator, where necessary.

5. Make all required reproductions of drawings.
6. Pay for all costs of reproductions of drawings and of pub-
lishing legal notices and advertisements relative to the receipt
of bids.
C. Compensation
1. For services indicated in paragraphs A-1 to A-7 inclusive,
in connection with the intercepting sewers, the Maxfield
Pump Station and force main, with appurtenances including
stream crossings, intercepting, overflow, and regulating
chambers and connections from existing sewers to the inter-
cepting sewers; but not including devices, changes or con-
nections in or to the Maxfield Mill, compensation is to be
4.90 percent of the estimated cost of construction, but not
less than $75, 000. The said compensation is to be paid in
8 monthly installments of $8, 000 each, plus a final payment.
2. For services, if required, to connection with flow measure-
ment and sampling as indicated in paragraph A-8, compensation
is to be on a time -charge plus expense basis, to be derived by
applying a factor of 2.2 to the salary cost of personnel for
time charged to the work, including travel time, plus expenses
as defined hereafter and for travel and subsistence. for such
personnel while away from our Boston office.
Salary cost is defined as salary and wages paid to personnel,
plus a percentage covering allowances for sick leave, vacation,
and holiday pay; taxes and insurance premiums based upon pay-
roll; and medical and retirement benefits. The salary cost
for principals of Metcalf & Eddy, Inc. will be taken as $100
per day. Reimbursable expenses shall include out-of-pocket
expenses for long-distance telephone calls, supplies, repro-
ductions, and the use of automobiles at 10 cents per mile.
3. For laboratory work of analyses of samples of wastes if re-
quired, the fee would be $25 per sample, plus expenses for
transportation and shipment.
4. For the services outlined in paragraph A-9, compensation is
to be on a time -charge plus expense basis, as indicated above
in paragraph C-2;.

5. It is understood that preliminary layouts and outline designs
are to be submitted to the City Engineer of Bangor for his
approval before proceeding with the complete detailed designs,
contract drawings and documents. If after approval of the prelim-
inary layouts and outline designs redesign is required because
of changes requested by the City, compensation for those services
in connection with such redesigns shall be on a time -charge
plus expense basis, as indicated above in paragraph C-2.
6. If detail designs and contract documents are required to enable
the City to receive proposals for alternates, the estimated
costs of such alternates shall be included in the total estimated
costs for determination of the compensation by application of the
percentage value set forth in paragraph C-1.
7. (a) The estimated cost of construction referred to in paragraph
C-1, shalt be as prepared by Metcalf & Eddy, Inc., upon the
basis of the completed designs and the then indicated costs for
construction work, taking into account the prevailing trend as
shown by the Engineering News -Record applicable cost indexes,
unless proposals for construction are received within 65 days
following completion and approval of the final designs and con-
tract documents.
(b) H proposals forconstructionare received within 65 days
following completion and approvalof the final designs and
contract documents, the estimated cost of construction shall
be based upon the computed lowest total of the proposals of
qualified bidders which are intended to be used by the City as
the basis of award of contracts.
D. Time for Completion
The final designs and contract documents are to be completed within 10
months after authorization to proceed, provided that delays in completion of
the engineering services beyond the control of Metcalf & Eddy, Inc. do ngresuh.
If such delays arise suitable additional times shall be granted for completion
of the services. Delays in furnishing suitable data, subsoil information,
decisions relative to locations, and time involving alternate designs or redesigns
shall be considered in connection with additional time of completion of the
engineering services.

E.. Construction Contracts
This proposal Is based upon the assumption that the construction of the
project is to be carried out under not more than two general contracts for
construction.
F. Litigation and Additional Work
Nothing herein contained shall he construed to obligate Metcalf &
Eddy, Inc. to prepare for or appear in litigation on behalf of the City of
Bangor, to make investigations or reports, or to supply engineering services
not covered by this proposal, except in consideration of additional compensation
to be mutually agreed upon.
We appreciate the opportunity of submitting this proposal and your
consideration thereof. We are prepared to proceed forthwith with the de-
signs, drawings, and documents in the event that authorization therefor
shall be obtained.
