Introduced and feed by Cowc RELEASE AND ABANDONMENT OF EASEMENTS WHEREAS, CLARA B. GRAHAM, widow and unmarried, of Bangor, County of Penobscot, State of Maine, is the owner of the fee in and to the following described premises, viz: A certain lot or parcel of Land with all buildings thereon situate at said Bangor and being bounded and described as follows, v Commencing at an iron holt set in the grouts n the extension in a northerly direction of the westerly line of Summit Avenue, said bolt being at the northeasterly mer of the lot or parcel of land conveyed by said Clara B comer to John R. Graham and Elaine C. Graham by her warranty deed dated April 24, 1364, recorded on April 28, 1964 at Penobscot County Registry of Deeds in Vol. 1944, Page 286, to which reference may be had, said bolt being 200 feet measured northerly along said extension from said Garland Street; thence proceeding northerly along the ex- tension of said westerly line of Sumeit Avenue 31.92 feet, more r less, to a bolt in the southerly line of a parcel of land conveyed by Hugh F. McCloskey, Jr. to John P. Carney by deed dated July 25, 1955, recorded at said Registry in Vol. 1494, Page 57, to which reference may be had; thence proceed- ing westerly along the generally southerly line of said Carney lot 12 feet, more r less, to a bolt set in the ground at the southwesterly comer of said Carney lot; thence deflecting to the right 880 42' and running northerly 72.68 feet, more or less, to a bolt set in the ground; thence de- flecting to the left 60 461 aM running northerly 05.92 feet, morm or lees, to a bolt set in the ground at the narthwe8terly comer of said Carney lot; theme proceeding easterly at right angles with the last described line 87.2 feet, onto or less, to a point in the northeasterly comer of said Carney lot; thence proceeding northerly in the easterly line of the premises herein described 77.98 feet, more or lees, to a iron pipe set in the gmund in the northeasterly comer of the herein described promisee; thence proceeding westerly on and by the northerly line of said herein described premises 337.62 feet, more or lees, to a bolt set in the ground in the extension in a northerly direction of the westerly line of Bellevue Avenue; thence proceeding southerly on and by said line of said extension 345.98 feet to an iron holt set in the Second at a point 150 feet measured northerly along said extension from the northerly brand of Garland Street; thence prxeeding easterly parallel and 150 feet northerly of the northerly line of Garland Street a distance of 60 feet, more or lees, to an iron bolt set In the ground in the extension in a northarly direction of the easterly line of Bellevue Avenue which bolt narks the southwesterly corner of the premises conveyed by the aforesaid dead from Clara B. Graham to said John R. Graham at al; theme proceeding northerly along the westerly bound of the promisee conveyed as afore- said to said John R. Graham a distance of 110.3 feat, more or lees, to an imn bolt set in the grouts at the north- westerly corner of said John R. Graham lot; thence proceeding easterly along the nwrtharly bound of said John R. Grahame lot a distance of 216.3 feet, voce or lees, to the point of beginning; being a pert of the sane peeedeas conveyed by said MO F. McCloskey, Jr. to Edward M. Grsbem N Clare B. Groben as joint tenants and not as touanto in comomn by warranty deed dated January 31, 1956, recorded on February 1, 1956 at said " Registry in Vol. 1511, Page 368, to which reference may, be had, amid Edward M. Graham being now deceased, aM WHEREAS, the aforesaid premises of amid Clara B. Graham are OontalM within the boutus of a "Plan of Land on State end Garland Street, Beryee, Maine" surveyed and lotted for Charles V. Stanford and others, said Pin being dated May 1897 and being recorded at Penobscot County Room" of Needs on April 24, 1908 in Plan Book 8, Page 34, to which referovae my be had, and WHEREAS, said recorded Plan divides the area shown thereon into lots or parcels of land lying northerly of State Street at said Bangor and southerly of Mount Nope Avenue at said Bangor, and shows thereon certain areas lying northerly of said Garland Street as being intended for use as streets and for use as a park, end WIEREASI one of said streets shown on said Plsn�and a pert of the area designated as a park on said Plan are contained within the bounds of the aforesaid premises of said Clara B. Graham, and WHEREAS, certain of the lets shaven onsaid Plan have since the re- cording thereof been sold by reference to said Plan, and WHEREAS, by reason of the recording of said Plan the City of Bangor has acquired orre may have acquired certain rights o cents with respect to the use of the s designated on saidPlanas streets, and has acquired or may have acquired certain rights or easements with re- spect to the use of the area shown on said Plan as a park, sort WIEREAS, the exercise of the aforesaid rights or esseaents,ln so far as the same are exercisable upon and with respect -o the aforesaid lend of said Clara B. Graham is concerned, has no value to the City of Bangor But does constitute a cloud on the title of Clara B. Graham to bar land above referred to, I _ NOW THEREFORE, in consideration of One Dollar and other valuable consideration paid by said Clara B. Graham, the receipt whereof is hereby acknowledged, said CITY of BANGOR, a muLLeipal corporation located in the County of Penobscot, State of Maine, for itself, its successors sued assigns, does hereby release and abandon to said Clara B. Graham, bar heirs, executors, administrators and assigns, all rights and easements of wbatso- ever sort which it has acquired in and to the use of such portion of the park shown on said Plan and such portion of any and all streets shown on said Plan as are contained within the bounds of her aforesaid promisee. Meaning and intending that all of the aforesaid rights and easements acquired by the undersigned in so far as the aforesaid land of Clara B. Graham 10 concerned shall henceforth cease and be forever terminated. IN WTNESS WNBNIOF, said City of Bangor has caused this Soatrument to be executed Bud its corporate seal to be impressed barren by its duly authorized representative or representatives, this of August, A.D. 1968.
