Holland and 14th Street By iAe City Cmewnl oft MY of Baxter: ORDERED, TEAT inasmuch as the connection of Holland Street to the w Fourteenth Street extension would result in a hazardous inter- section, and, HHEREAS, the limited amount of traffic on said Holland Street does not warrant said connection, new therefore,be it ORDERED, that the City Engineer, acting for and on behalf of the municipal officers according to law, be and hereby i directed to acquire the necessary right-of-way at the intersection of Holland Street and Fourteenth Street extended to permit the construction of a 100 foot diameter cul-de-sac, said additional right -o£ -way consisting of a triangular piece of land located on the northwesterly side of Holland Street and the southwesterly side of Fourteenth Street extension, measuring approximately 175 feet On Holland Street and 120 feet on Fourteenth Street extension, and be it further ORDERED, that the City Engineer, acting for and on behalf of said municipal officers, proceed to give written notice Of such intentions of said municipal officers by posting notices for seven (7) days in two public places in the City of Bangor and in the vicinity of the proposed laying out, and the City Engineer is further ORDERED, to make a written return of said proceedings con- taining bounds and ad -measurements for said street, together with a list of damages allowed to each person for all land so taken or for any benefits resulting to the property owners as a result of n the laying out, all i accordance with the laws of the State of Maine, said report to become a part of this order. ^�CENED 1968 JUL 13 pM 3: 42 .CITY CI ERIK S OFFICE j.r 9F or* OR. And that the said City Engineer met at thetime and place of meeting� specified in the notices and proceeded W lay out. said right-of-way as £allows: Beginning at a point formed by the intersection of the westerly line of Holland Street and the southerly line of Fourteenth Street extended; thence N 761-44'-22" W along said southerly line of Fourteenth Street for a distance of 120 feet; thence S 00-46'-40" W for a distance of 155.92 feet to the westerly line of Holland Street; thence northeast along said westerly line of Holland Street for a distance of 175 feet to the point of beginning. The above-described parcel contains 0.21 acres and is part of the same premises conveyed to the Boman Catholic Bishop of Portland by Edward McSweeney asre- corded in Penobscot Registry of Deeds, Volume 659, page 23 September 3, 1908; and Mary Garrity et al as recorded i Penobscot Registry of Deeds, Volume 929, page 309 on December 9, 1920. There appeared at the time and place set for the hearing Father James Keegan, representing the Roman Catholic Bishop Of Portland and Mrs. Mary Hunt Of 61 Holland Street. It was explained that it was the intent of the proposed acquisition to provide sufficient area to permit the construction of a cul -de - see on Holland Street located south of the new Fourteenth Street crossing, thereby discontinuing Holland Street as a through street. Father Keegan was opposed tO the acquisition inasmuch as it involved land which wasintended for the future expansion of Mount Pleasant Cemetery. Mrs. Hunt was opposed t0 the dis- continuance of Holland Street as a through street since taxis would refuse to provide service to her property during icy weather, because of the steepreturn grade to Ohio Street. The City Engineer explained chat the elimination of the connection of Holland Street to Fourteenth Street won do away with a potentially dangerous in - rsection because of the steepness of the approach. The City Engineer did agree, however, to conduct additional studies Of alternate locations act the connection i an attempt to improve the grade. Further nvestigation revealed that an intersection grade of less than 7 per cent w not pos- sible and both Mrs. Hunt and Father Keegan were informed of our intent to lay out the land for the cul-de-sac as originally in- tended. n-tended. Father Keegan was also informed that damages in the amount of $1280 were recommended for the taking, based upon damages previously paid for the acquisition of the Fourteenth Street right-of-way. it is, therefore, recommended that ti=_ acquisition be laid out as described shavesas a part of Holland Street and that the recomended damages be paid.
