Approving Request for Financial, Ass stance to Plan and Develop a Comprehensive City Demonstration Program By Ute City Council of as City of Boston: RESOLVED, WHEREAS the City of Bangor desires to undertake a comprehensive city demonstration program. to rebuild or revitalize large slum and blighted areas and generally improve living conditions for the people who live in such areas; and WHEREAS the Secretary of Housing and Urban Development (hereafter referred to as the "Secretary") is authorized pursuant to Title I of the Demonstra- tion Cities and Metropolitan Development Act of 1966 to make grants to; and contract with, City Demonstration Agencies to pay on to 60 percent of the costs of planning and developing such comprehensive city deraonstration programs; and WHEREAS the Secretary may tender a contract under which the United States of America (herein called the "Government") agrees to make a grant to pay a portion of the costs of planning and developing of a comprehensive city demon- stration program: NOW, THEREFORE, be it resolved by the City Council of the City of Bangor as follows: Section 1. Approval is hereby granted (1) for the submission by the City of Bangor of a request for financial a' istance forthe planning and develop- ment of a comprehensive city demonstrattor. program; (2) for the provision 0f any information or docum cita.ion concerning the preparation and content of such program as may be required by the Secretary; and (3) for the representation by Merle F. Goff, City Manager, or his lawful successor, as the authorized repre- sentat:ve empowered to act on behalf of tan City of Bangor in connection with all matters pertaining to :he request for financial assistance. Section 2, The City of Bangor hereby agrees to comply with the regula- tions of the Secretary effectuating Title VI of the Civil Rights Act of 1969, which provide that no person shall, on Use ground or race, color or national origin, be excluded from participation in, be denied the benefits of, or be subjected to discrimination in the undertaking of any of the projects or activities assisted under Title I of the Demonstration Cities and Metropolitan Development Act of 1966. Section 3. The City Manager, Merle F. Goff,of the City of Bangor is hereby authorized to execute said proposed Contract in three counterparts, and S e City Manager, Merle F. Goff, is hereby authorized and directed to impress and attest the official seal on each such counterpart and to forward such counterparts to the Secretary for execution on behalf of the Government, together with such other documents relative to the approval and execution thereof, as well as to this Resolution as may be required by the Government. Section 4. The City Manager, Merle F. Goff, or his lawful s ssor, s hereby authorized to file requisitions, together with necessary supporting documents, with the Government, from time to time as grant funds a required, requesting payments to be made on account of the grant provided for 1n the said Contract, and to do and perform all other things and zeta required to be done or performed in order to obtain such payments. Section S. The City of Bangor hereby gives its assurance that the necessary non -Federal share of the cost of the planning activities, not to exceed $30,000.00 undertaken pursuant to its application as modified and the grant contract, will be duly provided. The undersigned hereby certifies that: 1. He is the fully qualified and acting City ('clerk of the City of Bangor and keeper of its official records. 2. The foregoing resol,tion is a true and correct copy of the resolution as finally adopted at a meeting of the City Council held on the Bid day of April, 1968, and duly recorded in his office. 3. Goff: You have asked for my opinion as City Solicitor on several questions presented by the Department of Housing and Urban Development in connection with your application (filed with the Department On about April 15, 1968) for a grant under Title I of the Demonstration Cities and Metropolitan Development Act of 1966 for the planning and developing of a comprehensive city demonstration program. I have examined your application and have also reviewed all pertinent Federal, State end local laws. Based upon the foregoing, it is my opinion that: (1) she City of Bangor is a properly and validly created public body. (2) The filing of the application has been approved by the governing body of the City by resolution dated April 8, 1968 and numbered 109-V, and this resolution is the only such resolution pertaining to the application or its subject matter. (3) The City of Bangor possesses the authority under State and local law to undertake the Overall planning and administration of the program including (1) the authority to provide the local share of the costs{ (2) the power to contract with the Federal Covern- na and i and expend Federal funds} and, (3) the authority to adopt theadministrative structure set forth in Part V of the application, in furtherance of purposes set forth in the Demon- stration Cities and Metropolitan Development Act of 1966. Authority for the foregoing is found in Maine Revised Statutes Annotated, Title 30, Chapters 201 to 245.
