By the My Coumod of B C19y of Bangor: ORDERED, THAT City Treasurer by and on behalf of the aty of Bangor be hereby authorized to execute the attached deed. NOTE: This deed is given to correct the discrepancy which arose e when the City sold a parcel of land to Hebert E. Boynton by deed dated March13, 1947 and corded in the Penobscot Registry of Bards, Volume 1256, Page 193 which bond was not adjacent to the property which Boynton owned at the time and since has been sold to gathering M. Nadeau. Surveys by Prentiss and Carlisle have indicated the property actually conveyed lies adjacent to the northerly boundary line of the existing right -o£ -way leaving an 18.95 foot separation in the Nadeau property. We are receiving in exchange for this deed from Katherine M. Nadeau e deed to the property actually conveyed by the City as indicated. Goff, City Manager Subject: Deed Discrepancy, Nadeau Property on Broadway It has been called to the attention of this office that a discrepancy exists in a deed for a piece of land formerly owned by the City of Bangor which was sold to Fred Baynton in 1947 and which has since been sold to Kathleen Nadeau. The land con- isted of a parcel measuring 24 feet by 76 feet deep on the east side of Broadway, afportion of which lies within a dedicated right -o£ -way known as North Park Lane. It was apparently assumed by Boynton that the strip of land was adjacert to his property which lies south of the above-mentioned parcel and the a have also assumed this location. This would leave a remaining ning 16.95 foot strip of city land along the north side of the property formerly owned by Boynton connecting Broadway to the Eakin Park property. Surveys by Prentiss h Carlisle have indicated that the property actually conveyed lies adjacent to the northerly boundary line of the axisting right-of-way, thus leaving a 18.95 foot separation in the Nadeau property. It is, therefore, recommended that to clarify the intended sale of land that the city execute a correct deed i exchange for a deed from Nadeau to the property actually conveyed. Frawley ) City Engineer JTF:L Attachment RELEASE DEED KNOW ALL MEN BY THESE PRESENTS, That The City of Bangor, a municipal corporation located in Penobscot County, State of Maine, in consideration of One Dollar ($1.00) and other good and valuable consideration paid by Katharine M. Nadeau of Bangor, Can,',, of Penobscot, State of Mane, the receipt whereof is hereby acknowledged, do hereby remise, release, sell and forever quit -claim unto the said Katherina M. Nadeau, her heirs and assigns forever, the following described parcel of land: Beginning at a point on the easterly rightdof-way line of Broadway located 100.83 feet north from the northerly right-of- way line of North Park Street; said point being on the southerly line of ]and acquired by the City of Bangor from Dacia Poetry Company by tax deed as recorded in Penobscot Registry of Deeds, Volume 1193, page 35; thence east along the southerly line of said City of Bangor land for a distance of 76 feet; thence north at right angles to the above-described line a distance of 24 feet; thence west on a line parallel to and 24 feet distant from the first described line a distance 76 feet to the easterly right- of-way line of Broadway; thence south along said easterly right- of-way line of Broadway for a distance of 24 feet to the point of beginning. The above-described parcel contains =824 square feet. Being all and the same a part of the premises acquired by the City of Bangor from the Dakin Realty Company by tax deed dated February 21, 1941 and recorded in the Penobscot Registry of Deeds, Volume 1193, page M. This conveyance is made pursuant to an order of the City Council of said Bangor passed June 24, 1968. TO HAVE AND TO HOLD the above released premises, with all the privileges and appurtenances thereof, to the said Katharine M. Nadeau, her heirs and assigns forever. TN W MESS WHEREOF, the said City of Bangor has caused this deed to be signed in its corporate deme and its corporate seal affixed thereto by Sohn G. Fields, its Treasurer, duly authorised, this day of A.D. 1968.
