Ch. VI: Art. 9 Sec. 4 Sec. 4. Permission to Occupy the Sidewalk or Other Portions of the Right -of -Way. No person shall o cupy, block, ob- struct, or otherwise use any portion of a city sidewalk, esplanade, or street for the storage of materials, erection of staging, ladders, scaffolding, or other building equipment, including machinery and vehicles, without first obtaining a license from the City Engineer covering the period of said occupancy. 4.1 Licensee to Assume Risk. Any person who acquires a permit for the use of any portion of the sidewalk or street as outlined above shall so occupy said sidewalk or street at his own risk, and shall be responsible for any property damage or bodily injury caused by his operations. 4.2 Pedestrian Safety to be Assured. All operations within a right- of-way shall be conducted in such amanner s to insure the safe passage of pedestrians around the occupied area. Suitable precactions shall be taken, as may be directed by tke City Engineer, to protect the public from possible falling objects, and a suitable walkway shall be provided around the area occupied. A pedestrian walkway at least five (5) feet in width shall be maintained at all times and, where such walkway is located within a street, it shall consist ist of a solid wood platform raised at least four(4) inches above the roadway surface. A suitable handrail shall be provided along both sides of the walkway, and the traffic side of the walkway shall be marked with signs, flags, or lights as may be required. The tempo- rary walkway shall be maintained free of snow or ice at all times. 4.3 Use of Metered Parking Spaces. When the sidewalk cupancy involves a the v of metered parking spaces, the licensee shall notify the Chief of Police, who shall remove or cover the meter heads. Said metered parking Ch. VI; Art 9 Sec. 4 spaces shall not be used by the licensee or any other person for the parking of personal vehicles. 4.4 Notice Of Violation. The licensee shall correct any violation of his use of the right-cf-way within eight (B) hours after notice From the City Engineer or his agent. Failure to make such corrections within that time will re - suit in the revoking of said license and the licen- see be required to vacate the right-of-way immediately. If, because of the extent of his operation, it is impractical or impossible for the licensee to immediately vacate the right-of-way, then said corrections will be made by the city and the cost will be billed to the licensee. 4.5 Pew. Any person, firm, or corporation who shall violate any provision of this Ordinance or fails to comply with any of its re- quirements may, upon conviction thereof, be punished by a fine of not more than fifty dollars ($50.00) for each offense. Each day of said viola- tion or non-compliance shall constitute a separate offense. Any person, firm, or corporation s convicted shall not hereafter be granted a permit to occupy the right-of-way without the prior approval of the City Council. 89-V ORDINANCE Amending Chap.
