Councilman AGREEMENT KNOW ALL MEW BY THESE PRESENTS, THAT, WHEREAS, the City Of Bangor is presently constructing a primary sewage treatment plant located near the Hampden town line, and, WHEREAS, the Town of Hampden has contemplated the construction of a similar plant within close proximity to the town line, and, WHEREAS, it has been found to be both financially and geographically feasible for the Town of Hampden to extend its interceptor sewers to deliver its sewage to the Bangor plant for treatment in lieu of constructing its own sewage treatment plant, now therefore, it is proposed that such joint use be made of the Bangor sewage treatment plant subject to the following conditions: The City of Bangor agrees: 1. To furnish primary treatment of all domestic sewage and all existing industrial waste delivered to the Pollution Abate- ment Facility by the Town of Hampden. 2. To operate and maintain all sewage pumping stations owned by the Town of Hampden. 3. To grant to the Town of Hampden the necessary sewer ease- ments required for the Town of Hampden to install the interceptor sewer connections across City of Bangor property to the treatment plant. �. 4. To construct and maintain secondary sewage treatment additions to the existing Pollution Abatement Facility of suffi- cient additional capacity to treat the sewage flow from the Town of Hampden, when such facilities are required by law. The Town of Hampden agreesi 1. To install and maintain at its own expense the necessary interceptor sewer extension to connect to the City Of Bangor sewer system at the manhole located on the west aide of the Maine Central Railroad tracks and approximately 200 feet southwest from the operations Building. 2. To maintain all sewer lines within the town limits of Hampden. 3. To insure that all sewers connected to the interceptor sewer are restricted for sanitary sewage, only, and that all improper connections, excessive leakage, storm water, roof drains, cellar drains and cooling water is eliminated from said sewers. 4. To reimburse the City of Bangor for a portion of the construction cost of the Pollution Abatement Facility, said portion to be in the ratio of the Hampden design flow to the Bangor design flow, or 9.45 percent said costs shall be based upon the final coat to the city of Bangor of the Pollution Abate- ment Facility and related appurtenances, ad identified by Item No. 1 on the BID FORM of Contract No. 66-1 between the City of Bangor and Cianchette Bros., Inc. of Pittsfield, Miner also, a proportionate share of all other related Costa of said Pollu- tion Abatement Facility including site acquisition, design, super- vision of construction, survey and layout, administrative, legal, fiscal, and contingency, shall be included in the reimbursement to the City of Bangor. - 2 - S. To reimburse the city of Bangor for a proportionate share of the costs of secondary treatment facilities, including those related costs as outlined in Item q above, when such facilities are completed as required by law. 6. To reimburse the City of Bangor for the direct costa of operating and maintaining any or all pump stations within the Town Of Hampden, including allowances for overhead expenses in accordance with the standard billing procedures of the City Of Bangor. 7. To restore all areae disturbed by the installation of the interceptor sewer on the property of the City of Bangor to its original condition, subject to the approval of the authorized representative of the City of Bangor. B. To reimburse the City of Bangor for a proportionate share of the coats of maintenance and operation of the Pollution Abatement Facility, including the appurtenant buildings, structures, grounds, and the pipes below the Town of Hampden's connectioN said reimbursement shall be made quarterly, based upon the ratio of the total quarterly sewage flow of the Town of Hampden to that of the City of Bangor. 9. To insure that no additional industrial wastes are Con- nected to the system without the written consent Of, and under the conditions set forth by the authorized representative of the City of Bangor. - 3 -
