Amending Chapter 265, Solid Waste, to allow for discontinuance of waste collection service for residents who
rent an additional waste container and do not pay the annual invoice
Summary
This ordinance will amend City Code Chapter 265, Solid Waste, to allow the Director of Public Works to
discontinue waste collection service to a resident if the resident does not pay the invoice for the annual fee to
have an additional waste container.
Additional waste containers may be rented by residents for an annual fee of $260, which covers the cost of
pickup and disposal of waste that container will hold. When the container is rented, the resident pays a pro-
rated fee to cover the balance of the fiscal year. The following year an invoice is generated to assess a $260
fee to cover disposal costs for the next fiscal year.
If a resident fails to pay the invoice within 30 days, or fails to make arrangements for the additional waste
container to be returned to the City, the Public Works Director shall have the right to terminate collection
services to the additional container(s) until the resident contacts Public Works to make arrangements for
payment of the invoice or return of the additional waste container(s). The Public Works Director would also
have the right to terminate collection services to all containers if the resident fails to pay the invoice within 60
days or fails to make arrangements for the additional waste container(s) to be returned to the City.

ORDINANCE, Amending Chapter 265, Solid Waste, to allow for discontinuance of waste collection service for
residents who rent an additional waste container and fail to pay the annual invoice
WHEREAS, some residents have a need to rent additional waste containers for disposal of waste that will not
fit in their primary waste container;
WHEREAS, the annual fee for an additional waste container is $260, which covers the City's cost of pickup
and disposal of waste in that container;
WHEREAS, Public Works has experienced difficulty collecting payment of the annual fee from residents for
the cost of the additional waste container(s) and has expended considerable administrative time attempting to
collect payment;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR AS FOLLOWS, THAT
Chapter 265 of the Code of the City of Bangor is amended as follows:
§ 265-5 Violations and penalties; costs to City; appeals.
B. Penalties.
(1) Initial violations of this chapter, other than violations covered by Sections 265-5(A)(4) and 265-5(B)(4)

(4) The Director of Public Works shall have the authority to terminate collection services for non-payment
of annual invoice for additional containers as outlined in 265-3(E)(2). Termination of service to the
additional container( will not take place until at least 30 days after issuance of the annual invoice
for the additional container(s). Termination of service to all containers at the address will not take
place until at least 60 days after issuance of annual invoice for additional container(s). Collection
service will be restored on the next regularly scheduled collection day after the invoice is paid or after
the additional container(s) is/are returned to Public Works.
