Councilman A G A A A M 9 NT TRIS AGREEMENT made at Bangor. Maine on the day of , 1970 by and between the CITY OF BANGOR (hereinafter sometimes referred to as the "City"), a body both corporate and politic located in the County of Penobscot, State of Maine and DAVID R. TIBBETTS (hereinafter sometimes referred to as the "Purchaser"), Of Bangor, County of Penobscot, State of Maine. WI T NE5SA T n: W NAAS, the City is the owner of the property commonly known as the "Old City Hospital", located on the northerly side of Main Street, Bangor, Maine and further described below; and WHEREAS, on April 22, 1970 the finance Committee of the City Council voted to recommend to the full Council acceptance of the Purchaser's proposal to purchase said property for the sum of sixty thousand ($60,000.00) dollars to convert said property for use as a student density. NOW, THEREFORE, the panties hereto mutually agree as follows 1. The City will sell and the Purchaser will purchase the following described lot with the buildings thereon: Beginning at a polar, said point being the intersection of the northerly sideline of Main Street and the easterly sideline of Farm Road; thence North 47°-02'-27' West along the easterly sideline of Farm Road for a distance Of 497.93 feet to a point, said paint being the aOutherly line of property Owned by Downcast Television, Inc., conveyed to same by the City of Bangor and described In Penobscot Registry of Beads, Volume 2014, Page 254; thence South 42--57'-33" West along said property Line for a distance of 264.64 feet to a point, said point being o the southerly right -Of -way of State Highway 395; thence South 49--10'-07' East Along said State Highway tight -of - way for a distance of 149.11 feet to a granite monument; thence South 36--29'-18" East along said State Highway right-of-way for a distance of 164.19 feet to a granite monument; thence southerly along atcular arc having a radius of 202 feet along said State Highway right-of-way for a distance of 113.36 feet to a granite monument; thence .South 12°-26'-56" West along said State Highway right-of-way fon a distance of 158.94 feet to a granite monument On the northerly sideline Of Main Street; thence West 39°-56'-01" East along said northerly sideline of Main Street for a distance of 24 feet more Or lees t0 the point of beginning. I 2. The price shall be sixty thousand ($60,000.00) dollars of which the sum of six thousand ($6,000.00) dollars by way of deposit was paid April 6, 1970 and receipt of which the City acknowledges. The balance of fifty-four thousand ($54,000.00) dollars shall be paid by the Purchaser to the City upon signing this agreement. 3. The City sha1L within thirty (30) days free the date hereof deliver to the Purchaser a Quit -Claim Deed for said property, said Deed to convey t the Purchaser all rights and interests the City may have in said property. Upon payment of the remaining balance, the Purchaser shall be entitled to possession of said land and buildings. 4. The Purchaser further agrees and understands that this agreement is made subject to the following terms and conditions: a. The Purchaser s agre not to c s convey, r sign otherwise may transfer any interest he acquireby this agreementor the conveyance of c said property for a period of five (5) years ncing on the day of 1970, and terminating on the day of ,1975, without the prior written consent of the City of Bangor. b. The Purchaser hereby waives and releases all rights he may have to any real estate tax exemptions as a result of hisrship or any use he may make of said property during the above stated peeriod. a. Upon signing this agreement the City shall furnish t Purchaser a list of violations of the Laws and Ordinances of the City of Bangor found in or about the premises. Purchaser agrees to abate the same by September 1, 1970. 5. Contemporaneously with the signing of this agreement and before the same shall be binding upon the parties hereto, Purchaser shall ascute and deliver t u o City a good and sufficient surety company band in the a of twenty-five thousand ($25,000.00) dollars, which shall beexecuted bye surety company authorised to do business in the $tate of Mine. subject to the approval of the City, conditioned upon and for the faithful performance of all covenants nano and agreements herein expressed upon the part o'- the Purchaser, by the said Purchaser to be kept and performed.
