Introduced and filed by C Haan AGREEMENT BETWEEN THE BANGOR WATER DISTRICT AND THE CITY OF BANGOR FOR SERVICES RELI:TIVE TO THE FX%H)WKEAG STREAM URBAN RENEWAL PROJECT, PROJECT NO. Me. R-7 WHEREAS, the city of Bangor is presently engaged in various site clearance and project improvement work in the downtown area as a part of the Eenduskeag Stream Urban Renewal Project, Project No. Me. R-7, and WHEREAS, said project will require the removal, relocation, abandonment, or extension Of portions of the existing water system, NOW THEREFORE, the Bangor Water District, hereinafter referred to as the District, and the City of Bangor, hereinafter referred to as the city, hereby agree to the following: 1. The District agrees to install, relocate, abandon, or otherwise adjust the water supply facilities in accordance with Bangor Urban Renewal Authority Plan No. 802-A13, dated February 6, 1968, as may be revised by the City Engineer. 2. The District agrees to make routine adjustments in the line and grade of hydrants, valves, and curb stops to conform to the new line and grade of existing streets or sidewalks which are to be reconstructed, at no cost to the City. 3. The City agrees to reimburse the District for the work under Item 1, said reimbursement to be based on the actual labor, material, equipment, and overhead costs. Th=- total cost excluding ledge removal, isestimated, but shall not be limited to $47,000. Payments will be made as the work progresses but in no case shall payments be made more than once a month. 4. If, with -n 10 years from the date of this agreement, the annual rate o- water sales in the proj cc= area exceeds the annual rate at the inception of this project. the District will refund to the City 10 times the amount of the increase in accordance with the policies of the Maine Public Utilities Commission. Reim- bursement by the District would be only to the extent of payments received from the City under the terms of Iten 3. 5. All Work shall be scheduled so as to coordinate with the progress of the installation of other utilities and the work being performed by the city.
