L38 -X the Bangor City Council adjudged the ell or structure attached to the rear of the building located at 26 Market Street, Bangor, Maine am owned by Lem Kirkpatrick, 87 Eastern Avenue, Brewer, Me fne to be a nuisance and danger s provided in Title 17, MAINE REVISEDSTATUTES ANNOTATED, Section 2851 though 2853, as mended; and WHEREAS, said Council Order No. 138-X has been appealed by said Lean Kirkpatrick to the Penobscot County Superior Court; and WHEREAS, said Leon Kirkpatrick proposes to abate said nuisance on or before September 15, 1970. - NOW, THEREFORE, by the City Council of the City of Bangor, it is ordered that. Subject only to the follow4g conditions Council Order No. 138-x is hereby repealed; 1. Lean Kirkpatrick, owner of the building or structure located at 26 Market Street, Bangor, Maine, shall dismiss on or before July 15, 1970 his appeal of Council Order No. 138-X to the Penobscot County Superior Court (Civil Action Docket No. 9684); and 2. Before September 15, 1970 said Leon Kirkpatrick shall construct rete foundation under the ell attached to said building at 26 Market Street, Bangor, Maine and shall rehabilitate said ell in conformity with the Laws and Ordinances of the City Of Bangor; and 3. In the event said Leon Kirkpatrick fails to so rehabilitate said ell, he shall cause it to be demolished on or before September 15, 1970 in conformity with the Lava and Ordinances of the City Of Bangor. Kirkpatrick Dear John: I have today entered an appeal from the order of City Counsel elative to condemnation of the building at 26 Market Street, Bongor, Mr, Kirkpatrick has a:ready jacked up the front end P the building preparatory to placing a ecnerete foundation under it and upon completion of that portiCn, he Will do the same to the rear end. As I understand, he attempted to obtain the services of a contractor but was unable to obtain guarantee of performance within a reasonable time. He intends to m e the building comply in all respects to the code provisions. Booed upon his representations to me, Would you consider introducing on order to reconsider the order of May 27th, with the understanding that the order which you introduce may be conditioned on withdraw' of our appeal, establish a final date by which all code provisions will bane been completed, allowing animum of 90 days for completion and provided that unless completed within said 90 days, the building will be demolished.
