Dear Mr. Frawley:
Pursuant to your telephone request as confirmed by your letter
of February 22, 1971, we submit for consideration the following proposal
for furnishing engineering services consisting of:
1. Preparation of preliminary plans, cost estimates and a report
containing basic design data for secondary treatment facilities
for the sewage of Bangor, Hampden and Veazie; and
2. Preparation of final designs, construction drawings, and contract
documents for the project.
I. Engineering Services
A. We would review existing pertinent reports relative to the
sewerage system of Bangor.
B. Prepare a report which would include population projections,
water consumption, sewage sod waste characteristics and
estimates of flows, treatment requirements, and design criteria

for the principal units of the plant, with recommendations.
Twenty copies of the report would be furnished to the City.
C. The report would also contain preliminary layout plans,
flow diagrams, preliminary estimates of cost of construction
and estimates of costs of operation and maintenance for the
recommended works.
D. Assistance relative to State and Federal aid grants which may
be obtained for construction of the works.
E. Prepare drawings and specifications for borings or soundings
_. and furnish a qualified boring inspector.
F. Following approval of the design criteria for the secondary
treatment works, if directed, Metcalf & Eddy, Inc, is to
prepare final designs, construction contract drawings and
documents, all suitable for use in obtaining bids for the works
and for use during construction. Twenty sets of contract
drawings and documents are to be furnished to the City of
Bangor.
G. Assist the City of Bangor if requested, in obtaining and
analyzing bids for construction.
H. Upon completion of the final construction contract drawings
and documents, Metcalf & Eddy, Inc. is to prepare an up-to-
date estimate of quantities and items, and cost estimates for
the works.
H. It is understood that the City of Bangor will undertake to provide and
furnish to Metcalf & Eddy, Inc. information relative to the following,
without charge therefor:
A. All pertinent available data relative to city and town planning,
population projections, water consumption, sewage flows,
wastes, existing sewage treatment plant records, underground
conditions, site boundaries and use of adjacent properties.

B. Field surveys and underground explorations with data
pertaining thereto in suitable form and plotted to scale.
C. All negotiations relative to obtaining land and easements
including land under water and water rights or other required
uses as necessary for construction, maintenance, and operation
of the works.
D. Confer with personnel of Metcalf & Eddy, Inc. as may be
required and assist in obtaining pertinent data.
E. Obtain permits as may be required to enter upon properties
in connection with surveys, underground exploration, and
inspection.
F. Statements in writing relative to inclusion of sewage from the
Towns of Hampden and Veazie for treatment at the City of
Bangor primary plant and at the proposed Bangor secondary
facilities.
III. Payment
A. For the services indicated in paragraphs IA to ID inclusive,
the report,payment is to be the sum of $25,000 payable in four
monthly installments of $5,000 each plus a fifth installment of
$5,000. The fifth installment is to become due after SO days
following approval of the report by the State of Maine Environ-
mental Improvement Commission.
B. For the services indicated in paragraphs IE and I G in connection
with drawings and specifications for underground explorations,
field inspection of boring operations, assistance in obtaining and
analyzing bids, for furnishing additional copies of the report or
for additional sets of contract documents, and drawings, payment
is to be on atime-charge plus expense basis, payable monthly as
accrued, the sum of the following:
Salary cost times a multiplier of 2.25.
Nonsalary expenses.
It is suggested that $4,000 be budgeted for these services.

C. Salary costs are defined as salary and wages paid to personnel
for time chargeable to the project plus a percentage. covering:
allowances for sick leave, vacation and holiday pay; tares and
insurance premiums based on payroll; and medical and retire-
ment benefits.
D. Nersalary expenses include such typical expenses as cost of:
transportation and subsistence; long-distance telephone and
telegraph; printing and reproductions; identifiable supplies;
testing by commercial laboratories and charges by reviewing
authorities.
E. For services indicated m paragraphs IF and IH in connection
with final design, preparation of construction contract drawings,
contract. documents and estimates of quantities and costs,
payment is to be four and one-half percent (4. 5%) of the cost of
the facilities, appurtenances, and work as determined from the
bids of bidders with whom construction contracts are to be
executed, but not less than $225,000. The fee shall be payable
in four installments of $56,250 each, Jus a fifth installment
should four and one-half percent (4. A) of the cost exceed the
amount of $225,000. The first installment is to be due 90
calendar days after the beginning of the design work, the
second and third installments are to be due 180 days and 270
days respectively following the beginning of design work,
and the fourth installment within 30 days following approval of
the plana and specifications by the State of Maine Environmental
Improvement Commission. The fifth installment, if any, shall
be due after 60 calendar days from the date of receipt of bids or
as set forth in Paragraph III F.
F. If bids for construction are not received within 90 days following
approval of the plans and specifications by the State of Maine
Environmental Improvement Commission, the cost of the work
shall be taken as the cost estimate prepared by Metcalf & Eddy,
Inc. based upon the completed design, plans and documentsand
the balance of four and one-half percent (4. 6%) of the said coat,
if any, shall become due.

IV. Time for Completion
A Services indicated in paragraphs IA to I E inclusive, are to
be completed within 180 calendar days after authorization to
proceed therewith, and receipt of information and data to be
furnished to Metcalf & Eddy, Inc. by me City of Bangor.
B. Services indicated in paragraphs IF, IG, and IH are W be
completed within 360 calendar days following receipt by
Metcalf & Eddy, Inc, of written authorization to proceed
therewith.

C. In case completion of the services referred to in paragraphs
IVA or IVB shall be delayed by circumstances which are
beyond the control of Metcalf &. Eddy, Inc. , suitable additional
time shall be granted for completion.
V. Construction Contract
This proposal is based upon the premise that the contract documents
and drawings are to be prepared for construction and completion of
the works under one general contract.
VI.. Litigation and Additional Work
Nothing herein contained shall be construed to obligate Metcalf & Eddy,
Inc. to prepare for or appear in litigation on behalf of the City of Burger,
to make investigations or reports, or to supply engineering services not
covered by this proposal, except in consideration of additional compensa-
tion to be mutually agreed upon.
