ABSOLVED,
WHEREAS, the Broad Street Realty Co., a Maine Corporation, has contracted
with the Bangor Urban Renewal Authority to purchase Parcel B-14, as de-
picted on Plat dated June 12, 1971, and recorded in Penobscot Registry of
Deeds, Plan Book 27, Page 70;
WHEREAS, certain title problems concerning said Parcel have arisen whereby
the City of Bangor and those who claim through the City of Bangor may have
an interest insaid Parcel because of the discontinuance of a portion of
Broad Street, West Market Place and the former passageway known as Hatch's
Alley;
WHEREAS, a separate Plat entitled "Plat 7 - Taking by Eminent Domain"
"Corrective Action For Plat of Parcel B-14" dated November 9, 1971,
has been prepared depicting the aforesaid Broad Street, West Market Place
and Hatch's Alley;
WHEREAS, Title 30, Section 4807 (2), Mdine Revised Statutes Annotated
conditions the taking of property by eminent domain from a municipality
by requiring the consent of said municipality
WHEREAS, the Bangor Urban Renewal Authority proposes to acquire the
interest of the City of Bangor and those who claim through and by the
City of Bangor by an eminent domain proceeding;
HOW, THEREFORE, be it resolved that the City of Bangor in accordance
with Title 30, Section 4807 (2), Maine Revised Statutes Annoted hereby
consents to the eminent domain action to be instituted by the Bangor Urban
Renewal Authority against the City of Bangor.

Broad Street Realty Co - Merchants National Bank
Gentlemen:
Bob Miller suggested I write aring letter i conjunction
with the disposal of Parcel B-14 to Broad Street Realty Co.
This parcel is to be the site of the new Merchants National Bank.
The urban renewal law requires the approval of an eminent domain
action against ancipality by requiring the consent of the
municipality be fore the action is commenced. Although the City
has discontinued a portion of Broad Street and West Market Place
by council order and authorized the execution of a quit -claim deed
by John Field, Treasurer, in favor of the Authority, a formal
resolution, in my opinion, is necessary to comply with Title 30,
Section 48M (2).
All legal work has been completed by the Authority and the filing
of the documents in the Registry of Deeds and in the Superior Court
awaits the formal consent.
Of c , the argument may be made that because the City has
relieved itself of any responsibility as to that portion of Broad
Street and West Market Place by execution of the deed in favor of
