Be U ordained by the City Cattail of the City of Bangor, m(oHowm:
THAT Chapter % of the Ordinances of the City of Bangor is hereby amended by
deletion of the existing provisions and replacing them with the following:
Sec. l BCCA Basic Housing -Property Maintenance Code Adopted. Ia accordance
with 30 MRSA
92156 the "BOCk Basic Housing -Property Maintenance Code" (Second
Edition,. 19)0), an emended in 1971, Published by the Building
Officials and Cade Administrators International, Inc., formerly
known as the Building Officials Conference of America, is hereby
incorporated In this Ordinance and adopted by reference in full as
the Housing Code for the City of Bangor, except as follows:
1.1 Section H430.0 is deleted.
1.2 Section H-130.3 is deleted and replaced with the following:
H-130.3 Notice: Notice of the declaration of any building
under this code as unfit for human
occupancy and order to v it shall be in a formas provided in Section H-130.rm
32 and served In
accordance with Section B-130.33 of this Ordinance.
1.3 Section H-140.3 in deleted and replaced with the following:
H -M.3 Penalty for Violations: Any person, firm or
corporation who shall
violate any provision of this code shall, upon
eviction thereof, be subject to a fine of not
less than $10 v e than 9100. Every day that
Violation continues after due notice has been
staged, in accordance with the c and provisions
hereof, shall be deemed a separate offense.
1.4 Section H-141.0 is deleted and replaced with the following:
Section H -L41.0 RIGHT OF APPEAL
Any owner
r person who is aggrieved with a ruling o
decision of the Zoning and Cade Enforcement Administration
Officer in any mannar
relative to the interpretation or
enforcement of any of the provisions of this code may
appeal such ruling or decision.
H-141.1 Housing Appeals Board Established: A Housing
Appeals Board
is hereby established in the City of Bangor. The
term "Beard" when used in this section shall be
construed as the Housing Appeals Board. The
Board shall consist of five (5) members who shall
be residents of the City of Bangor and appointed
by the City Council. All members serving onsaid
Board at the time this Ordinance is adopted shall
amain on said Board until their terms expire.
The Board may adopt from time to time such rules
and regulations as it may deem necessary to rry
into effect the provisions of this Ordinance. All
meetings of the Board shall be open to the public.
The Board shall keep minutes of its proceedings,
recording the vote of each member upon each question
and indicating the absence or failure to vote of
any member. The final disposition of appeals shall
be recorded by resolution indicating the reasons
of
the Board thereof, all of which ahall be apublic
record.
H-141.2 All appeals from the ruling or decision of the
Zoning and Code Enforcement Administration Officer
under this Ordinance must be filed in the Inspection
Office, City Hall, Banger, Maine, in writing, within
n (10) days of the date of receipt of such ruling
or decision.
Upon receipt of said appeal, the Zoning
and Code Eafoz evenAdministration Officershe Ll
notify the Chairman of the Housing Appeals Board who
shall set a time and place for hearing as aid appeal
and shall give the petitioner notice thereof in the
vner prescribed in Section H -L30.33 of this Ordinance.
At such hearing the petitioner shall be given a
opportunity to be heard and to show why said decision
or interpretation should be modified or
reversed. The
hearing will be cc®euced not later thantendays
after the date on which the appeal was filed;
provided, that upon application of the petitioner
or the Code Enforcement Officer said hearing may
be postponed to a date as may be established by
the Chairman of said Housing Appeals Board.
After said hearing the Board shall give notice of

1.5 The definitions of 'Building Official' and "Enforcement
Officer" as provided In Section H-210.0 are deleted and
replaced with the following:
Building Official: Zoning and Cade Enforcement Administration
Officer of the City of Bangor.
Enforcement Officer: Zoning and Code Enforcement Administration
Officer of the City of Bangor.
