Gbapterlofthe Crdinamessoftis.Citp of Banger - Establishment at a 2oard of Appeals Be it ordained by Wee City Coamotl of the City ofBanper, as toRowa THAT the Ordinances of the City of Bounce are hereby amended by Adding Article 9 as follows: ARTICLE 9 - NAM OF APPEALS Sec. 1 Board of Appeals Established. In accordance with 30 MRSA 9 2411, aid acts amendatory thereto, there is hareb} established a Hoard of Appeals in and for the City of Bangor. Me word 'Roars," when used in this Article, shall be construed to mean the Board of Appeals. Sec. 2 Organization. 2.1 Membership. The Board shall consist of five (5) members who az residents of the City of danger and who shall be appointed by the City Council. Mere shall also he three (3) associate members who shall be residents of the City of leader and appointed by the City Council and who shall serve as deacgnwted by the Chairman in tem- porazy absence of any member at am proceeding before said Boazd. Neither a City Councilor nor his spouse, during the term for which said Councilor waa elected, shell serve as a member or associate member of said Board. 2.2 Term of Office. The term of office for each member and associate ember shall be for a period of tRee years commending on the effective date of this ordinance; provided however, in the first instance, two members shall be appointed for a term of three years, two members for a term of four yeaos; and one member for a term of five years. Each associate member shall appointed in the firs-, instance for a term of three years. 2.3 Vacancies. In the event avancy arisesv the membership of the Board, the City Council shall appoint a new member or associate member to fill that unexpired term. 2.4 Dismissal for Cause. A member arciate member of the Board as may be dismissed for cause by the City Council before the ex- piration of his term, 2.$ Conflict of Interest. Any question of Wether a particular issue wolves a conflict of interest sufficient to disqualify amember, or fate counter i ember's absence, shell be decided by a majority vote of the members, except the member who is being challenged. 2.6 Compensation. Members and associate members of the Bound shall not receive any compensation for their services. Sec. 3 Procedure. All proceedings of the Bound shall be conducted as provided in 30 MRSA A 2411 (3). Seo. 4 Jurisdiction. The City Council hereby seats in the Beard the power and jurisdiction to hear any appeal by any person, affected indirectly o directly, from any decision, order, rule or failure to act of the Zoning and Code Enforcement Administration Off-cer under the following City Codes and ordinances: (1) housing Code (2) Building Code (3) zoning Ordinance (4) Mobile Home Ordinance WE ORDINANCE 1' ( TITLE,) Amend.
