r CITY OF BANGOR
(TITLE.) Mribtra ._Amending Welfare. Guidelines
Wk@RPAS, on April 23, 1973, the City Council adopted "GUIDELINES FOR THE
AMINISTRATION OF GENERAL ASSISTANCE IN THE CITY OF MKOR, MAINE"g and
WHEREAS, recent statutory no rulmente to Title 22 of the Revised Statutes
require modification of these Guidelines,
NOW, THEREFORE, Ey the City Council of the City of Bangor, be it ORDERED
THAT the welfare Guidelines adopted on April 23, 1973 be amended as follows:
(1) The first sentence of the second paragraph, Page 1, is hereby
repealed and replaced with the following:
"Persons needing relief have been narrowly defined a "paupers",
.,the poor", "poor persons", "Lndigents", "pe[eone In distress",
and "persons dependent upon the municipality for their support."
(2) The second sentence of the third paragraph, Page 1, is hereby
repealed add replaced with the fall wing:
"Whether a person qualifies for such assistance is a question of
fact to be determined inaccordance with these Guidelines by
employees (caseworkers)ofthe Public Welfare Bepar tment at the
time the relief is requested,"
(3) The first sentence of the first paragraph, Page 2, is hereby
repealed add replaced with the fol Lowi ug:
"The City of Bangor administers a program of general assistance
available t0 all persona present in the City of Bangor, as defined
herein, in keeping with its responsibility to provide assistance to
those in need."

(4) Subsection P through I, inclusive, under DEFINITIONS on Page 3 are
hereby repealed and replaced with the following:
F. Director Of Public Welfare. Themunicipal official designated
tareceive applications, make decisos concerning clients'

right to assistance, and to preparerecords and communications
concerning granted assistance. The Director of Public Welfare
may delegate such tasks to ether employees of the Welfare
Department (caseworkers).
G. Minor Child. Any person who has not at rained the age of 18 years.
N. Persons Dependent Upon the Municipality for their Support. Pei
present in the City of Bangor who eligible to receive generals
assistance in accordance with these Guidelines.
I. Persons Present in the Municipality. Persons who are physically
present in the City of Bangor and who also have a true, fixed abode
in which they intend to stay within the City. For pu[poa as of these
Guidelines, the [ "persons present In themunicipality" shall not
include those per who voluntarily move to the City, or who are
transported to the City by others, for the sole purpose of obtaining
services provided by the Public Welfare Department.
(5) The first sentence of subsection C (L), Page 7. is hereby repeated
and replaced withthe fallowing:
"l. Right to Apply. Any person has the tight to apply for general
assistance. He my do so by appearing in person, or if incapacitated,
through a duly authorized representative, before the caseworker
worker by
expressing a desire to receive general a nand by completing
written application form together with other forms as may be required
by the Public Welfare Director."
(6) Subsection C (2), (i -j), Page 7, is hereby repealed and replaced with
the following:
the City of Bangor's rights and remedies for reimbursement from
the applicant's relatives pursuant to 22 M.R.S.A. 94467, which
in part states as follows:
"The father, mother, grandfather, grandmother, children and
grandchildren, by consanguinity, living within the State and
of sufficient ability, shall support persons chargeable In
proportion to their respective ability. A than, .. , having
Incurred expense for the relief of such pauper, may complain
to the Superior Court The court may and apportion
reasonable upon (such kindred) as are found to be of
sufficient ability for the support of such pauper The court

J. the applicant's personal resporm ibilities for r imbursement
to the City of Bangor under 22 M.R.S.A. 14501, which states:
"A municipality or the State which has incurred expense for
the support of an indigent person may recover the full
amount expended for such support either from the person e
relieved or from any person liable for his support, their
executors or administrators, in a civil action."
(7) Subsection C (5), Page 8, 1s hereby repealed and replaced with the
following:
"5. Actions on Application. Unless an application is withdrawn,
the caseworker must make a decision concerning the applicant's
eligibility add if eligible css furnishing relief within
my -Four (24) hours after the date of submission of the signed
and completed application together with all other forme required
by the Public Welfare Director.
6. Withdrawal. An application is considered withdrawn if:
(1) the caseworker i sable to complete the interview, i.e.,
if [heapplicant refuses to cooperate with the caseworker; or
(2) the applicant dies before general assistance is furnished; or
(3) the applicant avails himself of another service which makes
him ineligible under these Guidelines; or
(4) the applicant requests, in writing, that his application be
withdrawn; or
(5) the applicant fails to complete or sign the application or
any other form required by the Public Welfare Director.
]. Notice of Action. Any action relative to the grant, denial, o
denial in part of relief must be communicated, is writing, to the
applicant, and shall include:
(a) the specific reason of reasons for such action; and
(b) that the person affected has the right to a hearing."
(8) Subsection D (2), Page 9, is hereby repealed and replaced with the
fallowing:
"Present in the Municipality. only persons present in the municipality
s defined herein shall be eligible for general assistance
istance in the City
of Bangor. Persona stranded in the City of Baagorehall be eligible for
temporary emergency assistance as provided herald."

(9) The first and second sentences of the third full paragraph, Page 14,
are hereby repealed and replaced with the following:
"Burial services will only be provided in those instances where there
is no other person or agency available to perform the function.
(10) Subsection H (1), Page 16, is hereby upended by adding the following:
'Mo impending action to suspend, terminate or reduce previously

granted general assistance shall be carried out until the review
process has been offered or held, and written notice of the decision
has been given. Nothing herein shall require the granting of such
general assistance not previously approved during the pendency of
ansuch review.
(11) The first sentence of Subsection H (2) (A) is hereby repealed and
replcaed with the following:
"A. To initiate the review process the claimant need only make a
clear expression to the caseworker within two (2) working days after
a
notice of the c orker'sdecision on the application that he i
dissatisfied with the decision and desires a review of the same by
the Public Welfare Director."
NOPE: The purpose of these amendments is to update our Welfare Guidelines
in accordance with recent statutory changes The Welfare Director i
presently working onadditional amendments to be submitted at same later date.
These additional amendments will be proposed for purposes of expediting and
making the operation m efficient and to better et the needs of applicants
for general assistance.
