MrMnMlited pf tnp....Ordinances of he city ....... of Bangor - public Be if ordained By the City CoappoU of the City ofBaayot, "thUbtoe: — THAT Chapter I of the Ordinances of the City of Bangor be amended by the addition of Article 8 as follows: CHAPTER I Article 8 - Public Proceedings Sec. 1 Declaration of Policy. The citizens of. Bangor find and declare that public proceedings exist to aid in the Conduct of the people's business. It is the intent and policy of the citizens of Bangor that all proceedings, except as provided herein,of any administrative or legislative agency o body of the City of Bangor be open to the public at all times add that the deliberations of such body of agency be conducted openly. Sec. 2 public proceedings. For purposes of this Ordinance the term "public proceedings" shall mean the trans- actions of any functions affecting any or all citizens of the City of Bangor by any administrative or legis latfve body of the City of Bangor, with which function it is charged under any ordinance, statute, or under any rule or regulation of Such administrative or legislative body or agency. Sec. 3 Open Meeting$. All public proceedings shall be open to the public, and all persons shall be permitted to attend any such meetings of these bodies or agencies, and any minutes of Such proceedings a required by law shall be promptly r tided and open to public inspection, except as otherwise specifically provided by ordinance or statute. Sec. 4 Executive Sessions. Nothing in this Ordinance shall be construed as preventing or prohibiting any body or agency of the City of Bangor from holding executive sessions; provided that such sessions shall not be used to defeat the purposes of this incidence orthe policies declared therein; and provided that no ordinance,order, rule, resolution, regulation, contract, appointment or other official action shall be finally approved at such executive asand provided further, that such sessions may only be called by a majority vote of the members ofsuch bodies or agencies and only for one or more of the following reasons, the specific reason to be stated in a written public record; a Matters dealing with individual personalities, including, but not limited to, discussions of current and prospective municipal employees; appointments to boards, co®itteas, or commissions, welfare clients; or I. Discussions subject to the attorney-client privilege; or c. Matters concerning negotiations which require confidentiality n the public interest, including, but not limited to, collective bargaining; economic development; proprietary functions. Sec. 5 Separability. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held valid o unconstitutional by any court of competent jurisdiction, nch Portion shall be deemed a separate, distinct and independent prom talon and such holding shall not affect the validity of the remaining portions thereof. Sec. 6 Violation. Any public proceeding conducted by any administrative r legislative body of the City of Bangor in violation of this Ordinance is hereby deemed null and void. d.
