Of the Cry of Brew. as follows: that Chapter li, Article 35 be amended by adding the following eectiona: Sec. ] AIRCRAFT OPERATIONS. 7.1 Rules and Regulations 1. No person shelf navigate any aircraft, land aircraft upon, fly aircraft from, or conduct any aircraft operations on or from the Airport, otherwise than in conformity with the ur current Federal Aviation Administration, Civil Aeronautics Ward, Maine State Aeronautics Department, and the Airport Department's Rules and Regulations. 2. The Manager chair have the complete authority to deny the use of the airport to any aircraft or pilot violating the rules and regulations of the Bangor International Airport, Maine Aeronautics Department, or Federal regulations, regardless of where such violations occur. 7.2 Aircraft Requirements 1. No aircraft may land Or takeoff at the airport unless it is equipped with brakes and a functioning radio capable of two- way communication with the Control Tower on appropriate frequencies in use, except In the case of an emergency. 2. No motorleea aircraft may land or be towed for takeoff at the airport without permission. 3. No experimental aircraft may land or takeoff from the airport unless previous permission for the operation Of that particular type has been Vented by the Manager, or in case of emergency. Aircraft landing at the airport shall make the landing runway mailable to others by leaving the line of traffic as promptly as possible. Z. No air -carrier or supplemental shall practice aircraft landing or takeoff at the airport wiahoot permission. 3. No aircraft shall use any part of the landing areas considered temporarily unsafe for landing or taking off, o which is not mailable for any cause: such areae to be suitably marked and described by NOTAM, 4. Aircraft shall remain o marked hard surfaces of runways, taxiways and ramps only, 5. The pilot or other person aboard engaged in the operation of any aircraft (except when subject to the direction .of control for ground movessent purposes, of the Federal Aviation Admin- istration or like Federal Agency) being operated on the surface of any landing eyes, ramp and apron area or aircraft parking and storage ost at all timescomply with any lawful order, signal or direction of an authorized representative of the Bangor International Airport. When operation of such aircraft is controlled by lights, signs, signals and markings such signals, etc., shall be obeyed unleas an authorized representative of the airport directs otherwise. 6. No aircraft shall be operated on the surface of a landing area, amp and apronaircraft parking and storage a in a carelessnegligent r in disregard of the right and afety of others, q without or caution and circumspection, or r at a speed omanner which endangers unreasonably, person or r property, o while thepilot, o other aboard controlling any part of theoperation thereof, is under the influence of Intoxicating liquor, o any narcotic or habit-forming drug, r if such aircraft Is nstructed, equipped or loaded as to endanger unreasonably person or property. ]. Every aircraft parked on a ramp orapron area, shall have its arming lights lighted during the hours between sunset arta sunrise unless the Airport Manager specifically approved otherwise. 8. Aircraft dump valves shall be tested only in those areae designated for that purpose by the Manager. 9. The pilot oroperator of itinerant aircraft landing at the airport shall register at the Airport Operations Office or the Fixed Base Operations Office if $o designated, immediately after landing: he shall also check out at such Operations Office Immediately before departure. 10. No person shall park, store, aarvice o repair a aircraft or leave en the a standing i a landing a amp, apronaircraft parking and storage area at the airport, except at such places as may be prescribed or permitted by the Manager. 11. No aircraft shall be taxied at the airport unless a certified pilot certificated to operate that particular type of aircraft or a certified A68 mechanic properly qualified to taxi that particular type of aircraft shall be attending the controls. In the cde of helicopter$, only a certified helicopter pilot shall attend the controls. 12. All aircraft which are being taxied, towed or otherwise moved at the airport shall be under full control and move or be moved at reasonable speed. whenever any aircraft is being taxied, towed or othetwlae moved an the landing area, there shall be a person attending the controls of the aircraft who shall monitor by radio the transmitting frequency in use by the Control Tower. In the event the aircraft radio is inoperative, the persons moving the aircraft shall obtain vehicular radio guidance or obtain prior approval from the Control Tower for visual means of communication. 13. All aircraft being taxied, towed or otherwise moved at the airport shall proceed with running lights on during the hours between sunset and sunrise. 14. No aircraft shall be taxied into or out of a hangar under its our power. 15. Helicopters shall not be taxied, towed, or otherwise moved with rotors turning at the airport unless there is a clear aCeof at least fifty (50) feet from the outer tip of each rotor. No helicopter shall be operated within two hundred (200) feet of any areas on the airport where unsecured light aircraft are parked. 16. No jet or turbo -prop aircraft shall be started, run-up, or taxied at the airport where the exhaust blast may cause e injury to persona r do damage to property. If it i impossible to start or taxi such aircraft without compliance Of the above then the engine must be shut off and the aircraft towed to desired destination. 17. No aircraft shall be started or run at the airport unless a certified pilot certified to operate that particular type of aircraft or a certified A&E mechanic qualified to start and run the engines of that particular type of aircraft shall be attending the controls. Wheel blacks shall always be placed at the front and rear of each main landing wheel and the brakes of the aircraft shall be on and locked before the engines are a started except in c where in the opinion of the Manager other procedures are equally safe. 18. Wherever possible, engines shall not be operated on the airport in such a position that other aircraft, hangars, other buildings or spectators shall be in the path of the propeller slipstreams or Jet exhaust bleats. 19. No Jet or turbo -prop aircraft engine shall be runup except on sermup pads or in other areae authorized by the Manager. 20. In the event of spillage or drippings of fuel, ail, grease, or any other material which may be unsightly or detrimental to the pavement in any area of the airport, the same shell be removed immediately. Me responsibility for immediate removal of such fuel, oft, greesother material shall be caned by the operator of the equipment causing the same or by the tenant or ire responsible for phe deposit thereof on the cconcessionaire 21. Except upon leased premises, the cleaning of or otherwise maintaining aircraft shall be accomplished in areae designated for that purpose by the Manager. 7.4 Aircraft Fees 1. No person shall land or takeoff an aircraft on or from a landing area, or use a r amp o apronarea, sept upon payment of such fee at charge, a may from time to time be prescribed by the City of Bangor, unless such person Is entitled tonesuch area under a lea amnspecial agleNo per shall refuse to pay o vada or attempt to evade the payment of such tariff or charge. 2. All fees or charges due the City of Hanger for use of landing ®p and apron a and aircraft parking and storage areas by itinerant aircraft shall be payable in cash, unless credit arrangements satisfactory to the City of Bangor have been made in advance or permission has been secured for payment by check to the exact amount of the fee. 3. The fees or chargee prescribed by the City of Bangor for aircraft occupying ramp and apron areas aircraft parking and storage on shall c neitute a offer by the City of Bangor to extend only the privilegeto occupy said apace for parking or storage. Said offer shall not include nor shall it imply an offer by or any obligation upon the City of Bangor to exercise any duty toward the care, safekeeping or security of the user's property. 7.5 Moving of Aircraft Equipment If posing an operational problem or in order to facilitate funcremoval, sweeping operations o other necessary maintenance tions, and at the direction of the Manager, the pilot or operator of any aircraft and the Owner of any aircraft Servicing equipment parked o o stored at the. airport Shall m said aircraft or equipment from the place where it is parked or stored to any other designated place at the airport if the pilot or operator refuses to promptly comply with such direction, no Manager may tow or remove said aircraft or equipment to such deaignatyd place,and at the pilot's or operator's expense and without liability for dMan Be which may result In the course of such moving. 7.6 Disabled Aircraft 1. The pilot or operator thereof shall be responsible for the prompt disposal ofwrecked or disabled aircraft and parts at the direction of the Manager; in the event of his failure to comply, wrecked on disabled aircraft and parte may be removed by the Manager at the operator's and/or o expense and without liability for damage which may result In the course of such removal. 2. In order to restore flight service, the Manager may remove demage.d a aircraft from the landing a amp and apron of the airport at the expense of the operator and/or owner and without liability for damage which may result in the course of such removal. 7.7 Accidents The pilot or operator of any aircraft involved in any accident, using personal injury or property damage at the airport, shall make a prompt and full report of said accident to the Airport Police or an authorised representative of the Manager. 7.8 Authority to Prohibit Operations Except for emergency landings, the Manager may prohibit aircraft landing and takeoffs at any time, and under any circumstances, which he deems likely to endanger persons and property. Sec. 8 SAFETY AND FIRE PREVENTION. 8.1 General 1. The rules and regulations pertaining to safety and fire prevention as promulgated by the Airport Department of the City of Bangor shall - be implemented and enforced by the Airport Manager. 2. During the courseof actual incidence on the airport, involving fire r threat of fire which may endanger life or property, the Fire pawtment, Officer shall be in charge of fire prevention, "fire fighting and rescueoperations. �qo- !1(P 9 3. All rules regulations and recommended practices pertaining to safety and fire prevention contained in the National Fire Codes published by the National Fire protection Association or pro- mulgated by the National Board of Fire Underwriters and Fire Insurance inducer iters shall be adopted, whether or not specifically provided herein. 8.2 Safety and Fire Prevention Requirements 1. No person in or upon the airport shall do or omit to do any act if the doing or omission thereof endangers unreasoably or is likely to endanger unreasonably persona or property. 2. Ali persona at the airport shall exercise the utmost care to guard against injury to persona or property by fire or otherwise. 3. Detected fire, or safety hazards, shall be imeediately reported to the Fire Prevention Officer. 4. No person shall smoke or carry lighted cigars, cigarettes, pipes, matches or any naked flame in or upon any fuel storage area, landing area, ramp at apron aircraft parking and storage area, or any open deck, gallery or balcony contiguous to and overlooking any such area, in any other place where smoking Is specifically prohibited by signs, upon any open apace within fifty (50) feet of any fuel servicing vehicle which is not in r motion, o other place at the airport under such circumstances as may or might be likely to endanger persona or property. 5. No person shall conduct any open flame operations, operate an acetylene torch, electric arc or similar time or spark producing device on any part of the airport except in areaswithin leased premises designated for such use by the Manager, without first obtaining permission in writing from the Manager, who may require that s permit be obtained. No such permit will be issued for such operations within an aircraft hangar or within any fuel storage area r fuel parking area,unless the work is required for the repair and maintenanceof said hangars or areas. Should the Fire Department Officer dee "fire guard'e to be necessary, such shell be provided by and at the expense of the agency responsible for the existence of the fire hazard. 6. No person shell without prior permission of the Manager, keep, transport, handle or store at, in or upon the airport any cargo of explosives t other danger articles which is barred from loading inor transportation by civil aircraft In the United States under the current provisions of Part 49 of the Civil Aft Regulations promulgated by the Civil Aeronautics Board. Any waiver of such regulations or of any part thereof by the Civil Aeronautics Board or by any other competent authority shell not constitute or be construed to constitute a waiver of this rule s n implied permission to keep, transport, handle or store such explosives or other dangerous articles at, or upon an air terminal. Advance notice of at least twenty-four (u) hours shall be given the Manager to permit full investigations and clearance of any operation requiring a waiver of this rule. y. No person shall store, keep, handle, use, dispense or transport at, In or upon the airport any Claes A or Class B explosives (as defined in the Interstate Commerce Commission Regulations for Transportation of explosive and other danger articles), dynamite, nitroglycerine, black powder, fireworks, blasting cape o other explosives, gasoline, alcohol, either liquid shellac, kerosene, turpentine, formaldehyde, or other flammable or ombustible liquids, ammonium nitrate, sodium chlorate, wet here, powdered metallic magnesium nitrocellulose film, peroxides, or other readily inflammable solids or oxidizing materials, hydrochloric acid, sulphur is acid or other corrosive liquids, prussic acid, phosgene, arsenic, carbolic acid, potassium cyanide, tear gas, lewisite or any Class A poisons (as defined in the Interstate Commerce Commission regulations for transportation of explosives and other dangerous articles), orany compressed gas any radioactive article, substancematerial, at such time or place or In such manner ondition a endanger onably per r property.Me c e to unrerm eon o 0 Manager may require that a petal[ for the storage of all such materials ch be obtained from Me City of Bangor, to be conspicuously Materials a[ each location and ed jn a to annual the inspection and renewal. The heating of engines at the airport shall be done only by the use of steam, hot water, hot air or approved electric heaters. 10. Aircraft shall be parked on ramp and apron areas ss to permit free access of fire apparatus to all sides oftheaircraft at any time. 11. No aircraft, vehicles, mobile equipment, power unite, ramps o associated equipment, shall be located so as to prevent free access to and the normal use of fire hydrants, Sates, doors or passageways. 12. Fire extinguisher equipment at the airport shall not be tampered with at any time or used for any purpose other than firefighting or fire prevention. All such equipment shall be inspected in conformity with the National Board of Fire Underwriters' regulations. Tags showing the date of the last such inspections shall be left attached to each unit. 13. The lessee of a building equipped with sprinkler systems shall assign qualified employees to make weekly inspections of the systems to insure their in-service status. 8.3 Housekeeping practices 1. Highly inflammable, volatile liquids or solutions shall not be used for cleaning purposes unless authorized by the Fire R'evention Officer. 2. No person shall use volatile liquids for cleaning purposes unless such cleaning operations are conducted Ina outat eand remote m r in a r building specifically set aside for such operations, which to= r building shall be properly ventilated, fireproofed and equipped with adequate readily accessible fire extinguishing apparatus in accordance with the rules of the National Spend of Fire Nnderwr iters. 3. Discarded inflammable liquids shall be properly contained and labeled as may be required and shall be removed by-ipe-Lxeear from the airport each day. 4. Lessees of hangars or other aircraft servicing o maintenance r buildings, terminal buildings o other Ar shall provide suitable metal receptacles with self-closing lids for the storage of oily wastes, rags and all other combustible rubbish r trash. All such materials shall be disposed of by the leasee off of the airport each day. 5. All lessees on the airport shall keep the floors of hangars or other buildings free and clearof oil, gra and other inflammable materials.The floors of hangars and other buildings shall be cleaned daily and kept free of raga, waste material or other trash. 6. Any person, causing overflow or spillage of excess oil of grease on any apron area shall be responsible for cleaning such areas. J. No petroleum products or objectionable industrial waste matter shall be damped or be permitted to drain into drainage ditches, gutters, bodies of water or into sever syntax$ or storm drains. 8.4 Fuel Transfer Handling 1. All fuel transfer handling shall be done out of doors. All aircraft shall be positioned so that the vents and fill opening of its fuel tanks are not lees than fifty (50) feet from the terminal or any ocher building. 2. All fuel servicing vehicles and equipment used In the transfer of engine -operating fuels shall be maintained in a safe operating condition and shall be inspected daily by authorized and qualified Personnel. Individual records of each inspections shall be maintained and readily available on each unit. Therecord will indicate Identify of units, dates and extent of the inspections, the nam¢ of the inspector and the company he represents. 3. During fuel transfer handling In connection with any aircraft, n person shall operate any radio transmitter or receiver in such aircraft, or switch electrical appliances off in such aircraft, r shall any person do any act 0 any material which is likely to cause a spark within fifty (50) feet of such aircraft. 4. During all fuel transfer handling operations in connection with any aircraft at the airport, the aircraft and the fuel dispensing o draining apparatus shall be grounded by wire to a point or pointe Of zero electric potential to prevent the possibility of static ignition of volatile liquids. 5. During fuel transfer handling in connection with any aircraft, n passenger or passenger, shall be permitted to remain in such aircraft unless cabin attendant is at the door and a passenger ramp is in position if the same is required for the safe and rapid debarkation of passengers. Smoking is prohibited in or about such aircraft during fuel transfer handling. Only personnel engaged in the fuel transfer handling, or in the maintenance and operation of the aircraft being fueled or defueled shall be permitted within fifty (50) feat of the fuel tanks of such aircraft during the fuel transfer handling operations. 6. No airborne radar equipment shall be operated or ground tested o the ramp and aprons or any a wherein the directional beam n high intensity radarto within three hundred (300) feet or the low intensity beam (lees than OW output) is within one hundred (100) feet of another aircraft, an aircraft fuel transfer handling operation, an aircraft fuel servicing vehicle or aircraft fuel or Reparable liquid storage facility. The parking brakes of fuel servicing vehicles shall be set in the wheel lock position prior to and during fuel transfer operations and remain so until all connections heve been disengaged. I 10 ]. During fuel transfer handling operations in connection with any aircraft at the airport, at least two (2)CO2 fire extinguisher$ (20 IDS. or larger) oi other type fire extinguisher acceptable to the Manager, Shall belaonediately available for use in connection therewith. 5 S. No person shall atart the engine n engines of any aircraft when there is gasoline o any type of fuel on the ground under the aircraft. In the event of spillage of gasoline o any type 0£ fuel, no person shall start the aircraft engine in the area in which the spillage o red, e n though the spillage may have been flushed, until permission has been granted for the Starting of engines in the area by the Fire Chief. �yGdcu>im GA�c.., s� 9. Fuel transfer handling is prohibited while the engine of the aircraft being fueled or defueled is running or Is being heated. Fuel shall be delivered or drained through hose and connections approved by the National Board of Fire Underly iters. /r 10. Perengaged in aircraft fuel transfer handling shall exercise every precaution to prevent overflow of fuel. /L 11. The transfer of bulk aircraft or commercial fuel from one fuel servicing vehicle into another is prohibited within the boundaries of the airport. r 12. Fuel transfer handling Operations shall be conducted only in such areas authorized for this purpose by the Manger and never within fifty (50) feet Of any building. Fuel transfer handling operations shall not be conducted unless fully trained and qualified employees are available, one of whom must be stationed at all times immediately adjacent to the fuel servicing vehicle In use. 13. Fuel servicing vehicles shall be parked only in approved and designated areas in a manner to permit rapid r e removal, accessibility of fire apparatus and spaced at least twenty (20) feet apart. Parking elsewhere is permitted only during actual fuel transfer handling operations or for short periods with r a driver in the vehicle. At no time shall a fuel servicing vehicle be perked within fifty (50) feet Of any building. 8.5 Fuel 9oillaee 1. Any person or agency causing any fuel spillage during fuel transfer operations or otherwise, shall be responsible. for all consequences arising therefrom. 2. Persona responsible for large fuel spillage (six (6) feet or core in diameter) shall Immediately notify or cause to be notified with the least delay, the Emergency Crew Headquarters. Upon notification, srrective action will be immediately initiated at the discretion of the Fire Chief and at the expense of the responsible person or agency. 3. Conditions within large fuel spill areas shell be left undisturbed pending the arrival of the Airport Emergency Crew apparatus, and all personnel shall immediately leave the fuel spill area. 4. Persons responsible for small fuel spillage (Sees than six (6) feet in diameter) shell cause a fire quard to be posted and the spill to be promptly cleaned up using techniques recommended by the National Fire Protection Association. 5. No person shall proceed with any operation which is likely t result in fuel spillage without prior approval of the Fire Depart.. t Officer.
