And that the maid City Engineer met at the time and plate of meeting specified in Hue urtica and prmweded to IV out said Milfo d Street alteration as follows: LINE Beginning at a point on the northwesterly right-of-way line of Essex Street at the southeasterly property line of land owned by the Congregation of Jehovah's Witnesses, said point being on the northeasterly right-of-way line of Milford Street as previously established by the City Council on September 9, 1929, and recorded n City Road Book No. 4, Page 99; thence in a northwesterly dir- ection, at a angle of 1011-10'-00" with thenortheasterly exten- sion e£ the Essex Street right-of-way, for a distance of 548.96 feet to a point; thence deflecting north at an angle of 330-11'-15" for a distance of 27.36 feet to a point; thence deflecting east at an angle of 331-11'-15" for a distance of 133.33 feet to the southwesterly property line of Mary Snow School; thence deflecting 90P-00'-00" west along the southwesterly line of Mary Snow School for a distance of 50.00 feet to the northeasterly corner of land caned by Eugene and Arline Brown; thence deflecting 900-00'-00" south along the southeasterly line of said Brown property, and continuing along the southeasterly line of land owned by Gordon and Hazel Hope for a distance of 102.39 feet to a point, said point being at the northeasterly corner of land owned by Robert W, Brooks; thence deflecting 661-22'-30" to the southeast for a dis- tance of 588.15 feet to the northwesterly sight -Of -way line of Essex Street; thence deflecting 781-50'-00" northeast along the northwesterly right-of-way line of Essex Street for a distance of 50.96 feet to the point of begining. Meaning and intending to describe a right-of-way having a width of 50 feet, extending be- tween Essex Street and the Mary Snow School property along the approximate lines of the right-of-way shown on a plan made by David S. NdsOn, C. E., dated November 1920, for E. H. Dakin, and recorded in Penobscot Registry of Deeds in Plan Book 12, Page 21. The remaining portion of said Milford Street a shown on said Nason Plan, which extends from the northeasterly end of the above described right-of-way and Broadway is hereby discontinued, to be retained as part of the Mary Snow School property. GRADE The City Engineer proceeded to lay out a grade for said road as follows: Beginning at the intersection of the center line of said road with the southwesterly property line of Mary Snow School at elevation 151.63; thence descending o slope of -3.50,% for a distance of 00 feet to elevation 148.907 thence continuing to descend along a WHEREAS, the Local Public Agency has made studies of the location, physical condition of structures; land use; environmental influences, and social, cultural, and economic conditions of the urban renewal area or areas comprising the Program and has determined that the area is a blighted area and that it i detrimental and aee to the safety, health and welfare of the inhabitants and u s thereof and of the locality at large, because of a predominance of buildings or improvements which, by reason of dilapidation, deterioration, age or obsolescence, inadequate provision for ventilation, light, ar,nutation, or open spaces; high density of population and overcrowding; existence of conditions which endanger life or property by fire and other causes; and the combination of such factors i conducive to ill health or transmission of disease, infant mortality, juvenile delinquency and crime, and is detrimental to the public health, safety, morals or welfare. Said area, by r of a predominance of inadequate street layouts, is insanitary and unsafe conditions, r e to the public health, safety, morals i its present conditions and use, and the members of this Governing Body have been fully apprised by the Local Public Agency and are aware of these facts and conditions; and WHEREAS, there has been prepared and referred to the Governing Body Of the City of Bangor (herein called the "Governing Body") for review and approval an Urban Renewal Plan for the urban renewal area, dated April 10, 1973 and consisting of 22 pages and 5 exhibits; and WHEREAS, the Urban Renewal Plan has been approved by the Governing Body of the Local Public Agency, as evidenced by the copy of said Body's duly certified resolution approving the Urban Renewal Plan, which is attached thereto; and WHEREAS, a general plan has been prepared and isrecognized and used a a guide for the general development of Locality as a whole; and WHEREAS, the Planning Board, which is the duly designated and acting official planning body for the Locality, has submitted to the Local Public Agency its report and recommendations respecting the Urban Renewal Plan for the urban renewal a a comprising the Program and has certified that the Urban RenewalPlan conforms to the general plan for the Locality a whole, and the Governing Body has duly considered the report, recommendations, and certification of the planning body; and WHEREAS, the Local Public Agency has prepared and submitted a program for the relocation of individuals and families that may be displaced as a result of carrying out the Program in accordance with the Urban RenewalPlan; and WHEREAS, there have also been presented to the Governing Body information and data respecting the relocation program which has been prepared by the Local Public Agency as a result of studies, surveys, and inspections in the areas comprising the program and the assembling and analysis of the data and information obtained from such studies, surveys, and inspections; and WHEREAS, the members of the Governing Body have general knowledge of the conditions prevailing in the urban renewal area and of the availability of proper housing in the Locality for the relocation of individuals and families that may be displaced by the Program and, in the light of such knowledge of local housing conditions, have carefully considered and reviewed such proposals for relocations; and WHEREAS, it is necessary that the Governing Body take appropriate official action respecting the relocation program and the Urban Renewal Plan for the Program, in onformity with the contract for financial assistance between the Local Public Agency and the United States of America, acting by and through the Secretary of Housing and Urban Development; and WHEREAS, the Governing Body is cognizant of the conditions that are imposed in the undertaking and carrying out of urban renewal activities and undertaking with Federal financial assistance under Title r, including those prohibiting discrimination because of race, color, creed or national origin; NOW, THEREFORE, BE IT RESOLVED By THE CITY COUNCIL OF THE CITY OF BANGOR 1. That it is hereby found and determined that the urban renewal e comprising the Program i a blighted a and qualifies as an eeligible a under Chapter 168 of the Private and Special Laws of Maine 1957, as amended. 2. That the Urban Renewal Plan for the Program, having been duly reviewed and considered, is hereby approved, and the City Clerk be and is hereby directed to file said copy of the Urban Renewal Plan with the m nutes of this meeting. 3. That it is hereby found and determined that where clearance is proposed that the objectives of the Urban Renewal Plan cannot be achieved through rehabilitation of portions of the urban renewal area comprising the Program. 4. That it is hereby found and determined that the Urban Renewal Plan for the Program conforms to the general plan of the Locality. 5. That it is hereby found and determined that the financial aid to be provided pursuant to the contract for Federal financial assistance pertaining to the Program isnecessary to enable the Program to b, undertaken in accordance withthe Urban Renewal Plan for the area comprising the Program. 6. That it is hereby found and determined that, in addition to the elimination of alone and blight from the urban renewal area, the undertaking of the Program in such area will further promote the public welfare and the proper development of the community by making land in such area available for disposition, for c uses in accordance with the Urban Renewal Plan. 7. That it is hereby found and determined that the Urban Renewal Plan for the urban renewal area comprising the Program wrll afford maximum opportunity, consistent with the sound needs of the locality as a whole, for the renewal of the area by private enterprise. S. That it is hereby found and determined that the Urban Renewal Plan for the urban renewal area gives due consideration to the provision of adequate park and recreational area and facilities, as may be desirable for neighborhood improvement, with special consideration for the health, safety and welfare of children residing in the general vicinity of the site covered by the Plan 9. That it is hereby assured that within asnable time prior to displacement there will available iareas not generally less desirable i regard to public utilities and Public and commercial facilities and at rents or prices within the financial means of the families and individuals displaced, decent, safe, and sanitary dwellings, as defined by the Secretary of Housing and Urban Development,. equal in number to the number of and available to such displaced persons who require such dwellings and reasonably accessible to their places of employment. 10. That it is hereby found and determined that the Program for the proper relocation of individuals and families displaced i carrying out the Urban Renewal Plan in decent, safe, sanitary dwellings in conformity with acceptable standards is feasible and can be reasonably and timely effected to permit the proper prosecution and completion -of the Plan; and that such dwellings r dwelling units available or to be made available to such displaced individuals and families are at least equal in number Co the number of displaced individuals and families, are not generally less desirable in regard to public utilities and public and commercial facilities than the dwellings of the displaced individuals and families in the a comprising the Program, are available at rents or prices within the financial means of the displaced individuals and families in the axes comprising the Program, and are reasonably accessible to theirplaces of employment. 11. That in order to implement and facilitate the effectuation of the Urban Renewal Plan hereby approved, it is found and determined that certain official action must be taken by this Body with reference, among other things, to changes inzoning, the vacating and removal of streets, alleys and other public ways, the establishment of new street patterns, the location and relocation of sewer and water maims and other public facilities and other public action, and accordingly, this Body hereby (a) pledges its cooperation in helping to carry out the Urban Renewal Plan, (b) requests the various officials, departments, boards, and agencies of the Locality having administrative responsibilities in the premises likewise to cooperate to such end and to exercise their respective functions and powers mannerin a consistent with the Urban Renewal Plan, and (c) standsready to consider to take appropriate action upon proposals and measures designed to effectuate the Urban Renewal Plan. 12. That financial assistance under the provisions Of Title i of the Housing Act of 1949, as amended, is necessary to enable a the land in the a comprising the Programto renewed i accordance with the Urban Renewal Plan for the Program, and accordingly, the Proposed Program and the second annual increment are approved and the Local Public Agency is authorized to file an application for financial assistance under Title I. Exhibit "A" 1. Description of NOP Urban Renewal Area Boundary A. Anundaries of the Urban Renewal Area as Shown on Mao NO 401-1. Tne Bangor NDP Renewal area is situated in the City of Bangor, County of Penobscot, State of Maine, bounded as follows, Beginning at the northwest corner of the intersection of Pine and State Streets; Thence in a southerly direction along the west sideline of Pine Street to the northwest corner of the intersection of Pine and York Streets; Thence continuing in a southerly direction to said lines inter- section with the southwest corner of the intersection of Pine and York Streets; Thence southerly along the west line of Pine Street to said lines intersection with the Kenduskeag Stream Urban Renewal Project (Maine R-7) Boundary line; Thence easterly, following along said Renewal Project boundary line to a point, said point being one hundred forty seven (147) feet more or less easterly and distant from the northwest corner of Pine and Hancock Streets; Thence at about right angles to Hancock Street and continuing along said boundary line in a Southerly direction across Hancock Street and following the east boundary line of that land now o formerly owned by the Urban Renewal Authority of the City of Baryor, four hundred fifteen (415) feat more a or less to the northerly sideline of Washington Street, said Point being one hundred ten (110) feet more or less est of the northeast corner of the intersection of Pine and Washington Streets; Thence continuing along said renewal boundary line fifty (50) feet more or less to an angle Point in the southerly side of Washington Street; Thence easterly following along said renewal boundary line, said line also being the southerly line of Washington Street three hundred twenty (320) feet more or less to the northeast corner of land now or formerly owned by the Urban Renewal Authority of the City of Bangor; .hence southwesterly along the east line of said property and its extension to said lines intersection with the centerline of the Penobscot River. Thence in a generally easterly direction along said centerline to said lines intersection with east sideline of Newbury Street extended; Thence rthwesterly along said east sideline and its extention to said lines intersection with the northerly sideline of State Street; Thence south- westerly along the northerly sideline of State Street returning to the point of beginning.
