gentlemen:
Planned be advised that the Planning Board has he --d a public hearing on
the above request as well as a number of additional specific requests
relative to changes in the sare area.
The Planning board and previously recommended a - n this proposal,
but because this order andseveral othaxe were referred back to the
Bawd, the Planning Board met on June 6, 1974 to reconsider these orders
as well as several on which public hearings were held on June 3, 1974.
'Te Planning Board has given careful consideration to this area, to the
needs of the community, to the problems which affect the area, ato specific
proposals for parts of the area and to creating a unified proposal for

After considerable discussion the Planning board evolved ased zoning

Gentlemen:
Please be advised that the Planning Board held a public hearing on
Monday, Simon 18, 1944 to consider the proposals for changing the zoning
in the Ohio Street area.
The Board continued their deliberation until April 1, 1974 at which
time the following action was taken.
Based on the consideration for zoning the area
n Ohio Street as
presented by the two proposals, Council Orders 88AB and 89AB, the Planning
Board after considerable discussion approved several amendments to Order
88AB.
The Planning Board then voted 3-2 to seccommendi rezoning the area
based on the definitions of Order 88AB as amended.
A plan of the recommendation approved by the Planning Board in
attached.

Gentlemen;
Pending on tonight's agenda are three ordinance proposals relative
to possible rezonj on of certain land areas
off Ohio Street. The pro-
posals have been designated as Councilordinance Nos. 23 AB, 88 AB and
89 AN.
Ordinance NO. 23 AB has been on the agenda for several weeks, and
has already been reviewed by the Planning Board. The Board held a
hearing several weeks ago n the proposal and has ended against
the change (Agricultural to Residence C). In addition, and quite
properly, the Planning Board has also recommended several z changes
which v net considered in the original proposal. Adoption of the
Board's recommendation would, in my judgment, be a material modification
Of Council Ordinance No.. 23 AN.
A question has arisen as to whether the Council nmy amend pending
Ordinance proposal by adapting all or a substantial portion of the
Board's recommendations, without further public hearings. There appears
to be an
nmiry of opinionc
that the recommendation meets at least some
if the cuds'and desires of the Owners ofthe properties n question,
and also residents of the neighborhood.

Second, the
referral by the Council to the Planning Board and the notices for the
Board's public hearing appear on [heir face to be limited only to
nsideration of the amendment from agricultural to Residence C zoning.
In other words, the Board's authority appears to have been limited to
the change, as proposed, and persons atr
ending the hearing w not given
any notice of suggesting that anything but Residence C zoning would be
considered.
I believe 1[ admirable that the Board not only considered the
on
proposal, but after finding it not feasible, we step further and
outlined what It fel[, under the < should be adopted for the
area. How o
, there may be interested parties who had n strong feelings
tnthe Residence C zoning, and therefore may have elected not to attend
he hearing. However, they may object to the Board's recommendation, or
any other zoning that my be considered for the area.
if the Council is not willing to accept Council Ordinance No. 23 as
originally proposed, I suggest that it be indefinitely postponed. In
addition, since [here appears to be strong feelings cn favor of the Board's

I believe this appr each will overcome any procedural due process
problems that may arise

e by virtue of substantial changes any future zoning
proposals. 1[ should s also [ eliminate the need for additional public
hearings when rec commendations are derived which differ materially from the
original diaft.
