Laws and Ordinances of the City of Badger - General Business Zone Beit ordained by the City Commit of W City of Bangor, ae follows: WHER&1S, the City Council of the City of Bangor has previously resolved that It is desirable and in the public interest to undertake projects which eliminate spaces and blight from certain port -ons of the City of Bangor; and CMSRZAS, pursuant to declared desire to eliminate almost and blight the City Council approved an urban renewal program designated as Nan<ock-York NDP No. He A-4} and wHEBEAS, in said approval, the City Council found and determined that certain official action mush be taken by the City Council with reference to changesing, and pledged its Cooperation in the effectuation of such changes and MAMAS, the City Council subsequently authorized the City Manage[ to execute a cooperative agreement, In which the City of Bangor agreed to change modify zoning regulations to the extent necessary or desirable permit pemi[ [he carrying out of said Project, x NOW, THEREFORE, Be it ordained by the City Council of the City of Bangor THAT Chapter VIII, Article 8, Section 2(&) of the Laws and Ordinances of the City of Bangor (Zoning Crdimnce) beamendedby repealing the existing subsection and replacing it with the following: (c) Other Requirements. After careful consideration of the order, its produce and effect, the Planning board approved unanimously the following motion: In view of the persuasive language in the preposed Council Order, the Planning Hoard recommends the Zoning, ordinance be amended to achieve the desirable results outlined in the Order: however, the proposed languages in the view of the Planning Board, does net achieve the noble end which the Council Order seeks to achieve and would suggest rather than amending Art. 8, Sec. Respectfilly submitted, r�9� Posc Carl J. hearted Planning Director CJK:lm Me Planning Hoard held a meeting on Tuesday, April 16, 1974 at 7:30 P.M - in City Hall. Those present were Mr. Schiro, Mr. Rudman, Mr. Soucy, Mrs. McEvoy, Mr. Pierce and Mr. gets (who abstained from voting daring the evening). 111M[ 1: Informal Discussion on housing for the handicapped The Board held an informal discussion with Mr. Wayne Johnson, Mr. Michael. Kelley and Mr. David Halite of Robert Charles Associates of Boston, Masa. The group presented a few sketches they have on a project designed especially for handicapped individuals. The project would include approximately 150 units and would be located near the Husson, College Campus where they would be able to use same of the Hanson facilities for recreation and rehabilitation. Mr. Imbibe, the architect in charge of the project showed the board various sketches and indicated that they would be coming in for a sone change request for land in the Husson area 1n the near future. Due to a malfunction in the taping equipment the three Public hearings held this evening could not be transcribed word for word -------following is a transcript of the motions and vote of the Hoard. ITEM 2: C. 0. 109AH - Union Street - Change from Am. & RA to Gen. bus. -D. Sanborn Mr. Rudman: With all due respect to the effort and patience Mr. Sunburnhasshown, 1 move that w end against the change from Agricultural and Residence A Tone to General Busin s Zane for the reason that the proliferation of the general business zone a n that a will have an adverse effect on the existing residential aresto and it vould act appreciably solve existing traffic problems and other land use problems in the area. The notion was seconded by Mrs. McEvoy and carried 4 to 1 with Don Soucy opposing the motion. = 3: C. 0. 122AH - Capehart - Chance from Park & mat. to RA & RB Mr. Sou I move that we recomemend that the Council approve the zone change request as requested --(from Park & Institutional to Res. A & Res. H). The Spend voted unanimously to approve the motion. ITER 4: C. o. 125AH - Amending Chapter MI, Art. 8 of zoning ordinance Paul Rudman: The problem results from residential uses in the General Business Zone. The ordinance as drafted says in a general business zone that you can have local business uses as hareintofore set out. If you defer to local business uses, x have Residence C u m the general business zone they say see Note 1, nota 1 xrs cads "Residential u shall comply with the requirements of the residential zone in which the u rclassified, but what I suggest we do i insert o emend Note 1 by deleting the period at the end and inserting therefore a and after the comes the following words: xcept withine an urban r az renewal project a approved by the City Council in which area the requirements of the plan so approvedazhall control." - (� /2 D r'W Mr. Rudman: I would move, in view of the persuasive language in the proposed Council order, that the PlanningHeard recommend the seeing ordinance be amended to achieve the desirable results outlined in the order; however,the proposed language does not, in the view of the Planning Hoard, achieve the noble and which the Council Order seeks to achieve and would suggest rather than amending Art. 8, Sen. IHEM 5: Zonim ordinance The Chairman discussed with the board some of the problems which bad ariBen n the proposed ordinance while attending meetings of the Code Review Committee. He proceeded to get a consensus of the Hard on the problem of Site Plan Review. The meeting adjourned at 10:15 P.M. The next meeting is scheduled for May 6, 1974.
