ORDERED,
TUT the City Treasurer is hereby authorized and directed to execute
a right-of-way agreement between the City of Bangor and Congregation Beth
Istael and Congregation Beth Abraham, a copy of said agreement being attached
hereto and made a part hereof, for purposes of providing a non-exclusive right-
of-way to certain lands located north of the public burial grounds on Mount
Hope Avenue.

GRANT OF RIGHT OF WAY
THIS INDENTURE rade this 26th day of march , 1914 by
and between the CITY OF BANGOR, a municipal corporation located in the
County of Penobscot, State of Maine, Grantor, and CONGREGATION BETH
ISRAEL and CONGREGATION BETH ABRAHAM, both of Bangor, County of Penobscot,
State of Maine, Grantees.
WEARERS, the Grantor is the owner of a certain parcel of land
located on the northerly side of Mount Hope Avenue in said Bangor, designated
as City of Bangor Public Burial Grounds on a plan on file in the office of
the City Engineer, City Hall, Bangor, Maine, end entitled 'Plan of public
Grounds, Mount Hope Cemetery", dated March, 1940; and
WHEREAS, there fa a private read shown on said Plan and designated
as 'Eastern Avenue", running from Mount Hope Avenue to the northerly boundary
of said burial grounds; and
WHEREAS, Grantees are the owners of Certain parcels of land
abutting said burial grounds and as shown on said Plan: and
WHEREAS, Grantees desire access to said lands over said Eastern
Avenue, and
WHEREAS, the Grantor has agreed, in consideration of the sum of
One ($1.00) Dollar and ether valuable considerations, to grant to the Grantees
a right-of-way over said Eastern Avenue for purposes of gaining access to
said lands of Grantees,
WITNESSETH:
THAT pursuant to said agreement and in crosideration of the sum
of Due. ($1.00) Dollar and other valuable considerations paid by the Grantees
to the Grantor, the receipt whereof is hereby acknowledged, the Grantor
hereby granary to the Grantees, their successors and assigns, as follows:
(1) Full and free right and privilege, subject to
the conditions contained herein, for Grantees,
their members, servants, agents, visitors and
licensees, in with all ethers having the
like right, all retired
hereafter, with o
without vehicles of any description, for all
purposes
oected with the use and enjoyment of
said lands of the said Grantees, to hass and
repass along the traveled portion of said Eastern
Avenue for purposes of going it= Mount Hope
Avenue to said lands, or vice ve tsa.
(2) Grantees hereby agree to pay all damages which may
arise be om the exercise
of the rights herein
granted, Ord briery wear and rear to said Eastern
Avenue excepted.
(3) Grantees further agree, in the a of the
rights herein granted, to not uhreasonably
interfere o obstruct the O of said Eastern
Avenue by Grantor, its inhabitants or all others
having the like right.
TO HAVE AM To HOLD the right of way hereby granted unto the
Grantees, their successors and assigns, as app-rttetknt to the said land
of the Grantees.
IN WITNESS WHEREOF, the City of Bangor has authorized the
eacautaun of this Instrument by Sohn G. Field, its Treasurer, this 36th
day of March 1974.
