THAT the City Manager is hereby authorized and directed to execute an
agreement, a copy of which is attached hereto and aside a part hereof, providing
for the granting of certain easements on the City of Bangor property described
therein to the Banger Hydro Electric Company.

DEED OF EASEMENTS
KNOW ALI, MEN BY THESE PRESENTS, That the CITY OF BANGOR, a municipal corporation in
the County of Penobscot, State of Maine, in consideration of One dollar (t) and other
valuable considerations paid to the Grantor herein by BANGOR HYDRO -ELECTRIC COMPANY, a
Maine corporation having its legal location and principal place of Raciness at Bangor,
County of Penobscot, State of Maine, the receipt whereof is hereby acknowledged, does
hereby give, grant, sell and convey to said Banger Hydro -Electric Company, its successors
and assigns forever, the rights, privileges and easements hereinafter set forth which shere
to hec
e sed upon and with respect to the following described parcel of lend be lies
within the bounds of premises located at Banger, Maine and described in deed of the Urban
Renewal Authority of the City of Bangor to the Grantor herein dated January 29, 1994 and
recorded at the Penobscot County Registry of Needs in Volume 2436, Page 1533 via:
Beginning in the southeasterly bound of Columbia Street at the westerly corner
of said premise conveyed to the City of Beragor by the Urban Renewal Authority of the
City of Danger thence S68o35'24"E along the northeasterly bound of land now
r formerly of Ida B. Goldsmith, also being the southwesterly board of said
premise conveyed to the City of Bangor, a distance of 94.56 feet to a point
n the northwesterly bound of land now or formerly of Alen -Lewis Co., Inc.;
thence N200402211E along the said northwesterly bound of Alan -Lewis Co., Inc.
and along the northwesterly bound of land now or formerly of Annie A. Knapp
and Lester I. Knapp, Jr., a distance of 53.68 feet to the northerly corner of
the aforesaid land of Knapp at al.; thence S68029'19"E along the northeasterly
bound of the aforesaid land of Knapp at al., a distance of 10.52 feet to the

of land conveyed by the said Urban Remwal Authority of the
City of Border to Murray W. Finned and William G. Firmed, trustees of Bangor
Main Street Trust, by deed dated January 7, 1994 ap recorded at said registry
n Volume 2428, Page 7; thence N20040'22"E along the northwesterly bound of
aid land conveyed to Finard et al. and the northwesterly bound of land n or
formerly of Day's Inc., e distance of 171.02 feet to the southerly bound of
Haimnond Street; thence S84 29'53"W along the southerly bound of Herself Street
to a point which is 15 feet northwesterly of and measured perpendicularly from
the said northwesterly bound of land of hay's Inc.; thence S20e4012211W on
corse parallel to and 15 feet northwesterly of the northwesterly boards of
theaforesi.d lands of Deyts Inc. and Fingrd at al., a distance of 102.6 feet;
thence deflecting right at an angle of 23 40' and proceeding a distance of
26.2 feet; thence deflecting left at an angle of 23040' and proceeding on e
couree of S20 4022"W, a distance of 65.70 feet; thence deflecting right at
an angle Cf 450 and proceeding a distance of 14.14 feet, more or less, to a
point which is 15 feet northeasterly of and measured perpendicularly from the

The right,:, privileges and easements hereby conveyed in respect to said parcel herein-
before described a s follows: to lay, c nstructn maintain operate, repair and reme
fines of underground wires, cables, conduits, ducts, impedes, and other apparatus u ed or
useful 1'er the transmission of electricity; and the right to transmit electricity over

through said wires, cables, conduits, ducts, manholes, and other apparatus at any or all

lawful Incentives and for all lawful purposes.
Together with the right to install, construct, maintain, operate, and repair wires,
ea Rtes, conduits, ducts, switching equipment, and above -ground Ladmount transformers, as
called, with the foundations for said transformers; and the right to transmit electricity
mid through said vires, cables, conduits, duct, switching equipment and transformers,
upon or above the following described portion of the aforesaid parcel; vis:
Beginning at the westerly corner
of the premises conveyed to Murray W. Finard
and William' G. Funded, trustees of reopen Main Street Trust, by deed of the
Urimn Renewal Authority of the City of Banger dated January 7, 1994 and
corded at the Penobscot County Registry of Deeds in Volume 2428, Page 7;
thence N68 27119"W along the northeasterly bound of land now or formerly of
Amlie A. Knapp and Lester I. Knepp, Jr., and the ncrtlowesterly extension
thereof, a distance of 10 feet; thence N20040'22"E on a course parallel to
the northwesterly bound of said premises conveyed to Pinard at al., a distance
of to feet; thence S68 27'19"E, a distance of 10 feet to a point in the
northwesterly bound of said premises conveyed to Finard at al.; thence
52004022"W along the said northwesterly bound of land of Firmed at al.
to the point of beginning.
With the further right to enter upon said premises at any. time for any of the store -
said purposes and to assign to others the foregoing rights, privileges and easements, in
whole or in part.
The Grantor covenants and agrees net to construct or erect or permit the erection o
maintenance of buildings or structures of any kind within the said parcel, without written
permission from an executive officer of the Graffi i excepting an shooting retaining wall
located in the westerly part of said premises, and the collision and footings to he located
for an elevated parking deck as said wall, columns and footings are shown on the plan
attached hereto and made a part hereof. It is also specifically understood that the
Grantor shall retain its rights to operate and maintain an existing sanitary sewer and
sturn sewer subsection as now located within the bounds of said parcel.
The Grantee covenants and agrees to restore all pavement or other surfaces disturbed
in regard to the aforesaid construction and maintenance with material of at least equal
quality.
