Whereas, the proper operation of democratic government
requires that public officials be independent and impartial
n their judgment and actions; that government decisions and
policy be made in the proper channels of the governmental
structure; that public office not be used for personal gain;
and that the public have confidence in the integrity of its
government and public officials;
Whereas, the realization of these ends is impaired
whenever there exists, or appears to exist, an actual or
potential conflict between the private interests of a
government official and his or her public duties; and
Whereas, the public interest requires ethical standards,
beyond purely legal imperatives, with respect to official
conduct;
NOW, THEREFORE, Be It Resolved by the City Council of
the City of Bangor:
That, it is a Councilor's duty to
1. Respect the American ideals of government, the rule
of law, and ethical conduct in the performance of one's
public duties;
2. Represent and work for the common
n good of the
people of the City of Bangor and not for private interest,
assuring fair and equal treatment of all persons, claims,
and transactions coming before one in one's official
capacity;
3. Refuse personal gifts in every instance where one
has reason to believe the gift would not have been extended
except for o n
official position, where one has reason to
believe the giver's interests are likely to be a£feetd by
official actions, or where the gift is or may be
reaonably considered to be designed to influence one's
official actions;
4. Prepare oneself for all items scheduled for
presentation to the Council;
5. Faithfully perform the duties of a Councilor to
attend all sem
of the Council and of its committees
o£ which one isaa ember, unless unable to do so for some
compelling reason or disability;
6. Maintain the highest standards of ethical conduct
by refusing to approve breaches of public trust or improper
attempts to influence legislation and by being willing to
vote to c otherwise discipline any Councilor who
willfullyviolatesthe duly established rules for Councilors;
J. Disclose to the full Council any substantial conflict
of interest, pecuniary or personal, with one's duties as a
Councilor; disclose the nature and extent of o interest
as an officer, agent, member, or owner
of any business entity
or other association which i subjectto regulation by the
City; and refrain from voting or debating as a member of the
Council when such interest is in substantial conflict with
one's public duties,
8. Refuse to represent private interests before city
agencies or against the City in the courts, except as may
be one's duty toward constituents, such service to be
rendered without compensation; and refnseto accept o
engage in any employment incompatible with one's public
duties;
9. Refrain from disclosing confidential information
concerning the city government;
And That, any conduct allegedly in
conflict with this
Code of Ethics shall be presented to thefull Council for
its consideration and disposition.
