HomeMy WebLinkAbout1974-05-29 179 AB ORDINANCE119 AB Introduced by COu"cilor Ballou; May 29, 1974 r.(i CITY OF @ANWGOR ry�pp1 (TUTEE,) i1bilEMWFy V1f Amending Chapter VIII oftheOrdicances of the City of Saviour - Shcreland Be it ordaieud by the City Consent of the City ofBanyor, estbUowe: THAT Chapter VIII of the ordinances of the City of Sargon is hereby amended by adding the following Article 12-A: Article 12-A Shoreland Zoning Pursuant to the authority granted to the City of Bangor Sy virtue of 12 RISA 664811 et seq., the "State of Raine Guidelines for Municipal Shoreland Zoning Ordinances", dated December 15, 1973, as adopted by the Speed of Environmental Protection and the Land Use Regulation Commission for the State of Raine Pursuant to the Adeninietrative Direction of the State Plannipg Office, are hereby adopted by reference, with the same force and effsct as stated herein, except as follows: The following designated sections are hereby deleted and replaced with the following: - Section 3. Effective Date. The effective date of this yrdinance is June 30, 1973. A certified copy of this Ordinance shall be filed with the Penobscot County Register of Deeds, according to the requirements of State law. Section 5. Amendments. Thin Ordinance may be amended by a mejcrity vote of the City Council inaccordance with all other requirements for amendment of the Zoning Ordinance. Me Planning Office sha_1 be notified by certified mail, of amendments to this Ordinance, Prior to the eY_ective date of such amendments. A file of return receipts from such mailing steel- be maintained as a permanent record. Section 6. Districts. Me areas to which this Ordinance is applicable are hereby divided into the following districts: (1) General Development District. All areas of the City of Bangor subject to the provisions of this Article, one provided n Section 2 herein, except those ar of the City of Repair included in the Resource Protection District and the Limited Residential -Recreational District. (2) Limited Residential -Recreational District. Those Areas of tfie City of Bongos, that fall within the area subject to the provisions of this Article which should have only limited, low density development, as defined on the "Shorelend Zoning Maps" of the City of Hunger dated May 20, 1974, a Copy of which is on file in the office of the City Clerk. (3) Resource Protection District. These areas of the City of Bangor, that fall within the a subject tothe provisions of this Article in which developmentwouldadversely effect water quality, productive habitat, biotic systems, o and natural values, as defined on the "Shorelend CuringnMaps" of the City of Bangor dated MAY 2D, 1974, a copy of which is on file in the office of the City Clerk. The Planning Record considered the proposal, the requirements of the Statutes, the arm and zones that would be implemented,ae well as the relationship. of this proposal to both the existing and proposed zoning ordinance. After discussion the Planning Hoard voted (4-1) to recommend the following action. Hearing in mind that the approach is perhaps inappropriate to Hanger in that it does not deal with the program in its entirety but at this point we are faced with a decision to the extent that if we do not adopt what we have been offered, we Are left with nothing. We thick it incumbent upon the Planning Hoard and the Council in its consideration of the n zoning ordinance to s broaden the a of the Shoreland Zoning to c not onlT the limit of 250 ft. but those areas which directly affect the shore- line of Bangor whether it be 25o ft. or 2,500 ft, from the natural /th / edge of e shore. We don't think at this point that we can go �O f beyond the present lined without drastically cut aging the mature of the Council Order.
