CITY OF BANGOR
(TITLE.) MYilnata, Adopting National Electrical Erne
Be n ordaiand by Ns aft Coumofl of the City ofBmnsan as follows:
(1) TEAT Articles 3 and 4 of Chapter VII of the Laws and Ordinances of the
City of Bangor are hereby repealed in their entirety.
(2) THAT Chapter VII, Article 9 of the Laws and Ordimmes of the City of
Bangor is hereby repealed and replaced with the following:

Sec. 1 Adopting National Electrical Cade. In accordance with Title 30,
Section 2156, Maine Revised
Statutes Annotated of 1964, as nuanced, the 'National Electrical
Code 19)1", 1971 edition, designated as N.F.P.A. No. 70-19711
adopted in May, 1971 and published by the National Fire Protection
Association, is hereby adopted and incorparated by reference, a
the mintmum standards for electrical installations in the City of
Bangor.
Sec. 2 Enforcement Authority. The Electrical Inspector established under
Chapter II, Article 17, Section 4, or his
authorized agents, Shall have the power age duty to enforce the
provisions of said Code.
Sec. 3 Written Complaint to State Electrical Inspector. Npm the discovery
Of electrical
installations which de not amply with this Care, the Electrical
Impactor, or his authorized agents, may stake a written complaint to
the State Electrical Inspector in accordance with 32 MRSA 11104.
Sec. 4 Enforcement Procedure. Whenever the Electrical Inspector or his
authorized agents determine there is a
violation of any provisions of said Code, be shall give written
notice of such violation to the property core=, lessee, occupant
or their agents. Such written notice shall:
(1) include a description of the real as tate in question
sufficient for identification; and
(2) include a description of the violation found and
the citation to the provisions violated, of said
Code; and
(3) specify the remedial action required for correction
of said viodaoton; and
(4) order that said violation be -corrected within a
reasonable time, such reasonable time to be determined
by the Electrical Inspector and indicated upon Such
written notice; and
(5) state that an appeal from any order, decision Or other
action Of the Electrical Inspector may be taken to the
Building Code Board of Appeals by filing with the
Zoning and Case Enforcement Administration Officer, a
written request for a public hearing, within ten (10)
days of receipt Of Said written notice.
4.1 Appeals. An appeal may be taken from a order, decision o
Other action of the Electrical Inspector t0 the
Building Code Board of Appeals (hereinafter called the "Board")
established by Chapter IT, Section 127 of the Laws and Ordinances
of the City of Bangor. The appeal must be filed 1n writing with
the Zoning and Code Enforcement Administration Officer within
ten (10) days of receipt of said written notice. The Board may
interpret this Code and thereby affirm or modify such order; o
may grant axceptions thtrefrom when practical difficulties o
unnecessary hardships exist, and it is c early evident that
reasonable safety would thereby be secured. The actions Of the
Board shall be governed by the provisions of Chapter I%, Section
127. Failure of the Board t0 issue anotice of its
decision within thirty (30) days Of the '_ilingOf the appeal,
constitutes a denial Of said appeal.
4.2 Appeal to Superior Cour[. Further appeal £runs the decision of
the Board Of Appeals may be made to
the Superior Court in accordance with the Me" Rules of Civil
Procedure.
Sec. 5 Prosecution Of Violation. Upon the expiration of the reasonable time
stated in the writ -en notice provided for
in Section 3 Of this Article, and the failure to comply with any and
all orders, the Zoning and Code Enforcement Administration Officer

visions of this Article. In addition, the Zoning and Case Enforcement
Administration Officer may file a criminal complaint in the District
Court of the State of Maine for purposes of enforcing the penalty
provisions contained in Section 6 of this Article.
Sec. 6 penalties. Every person, firm, partnership, ass ociation Orcorporation
who shall violate any provisions of this Code, shall, at the
expiration of Such reasonable time as stated in the written notice, be
guilty of a misdemeanor, and upon conviction thereof, be punished by a
fine of not more than $100 for each violation. Each day that Such violati an
continues
to exist efts the expiration of such stated reasonable time,
shall be issued separate offenses.
