Exits Code Be it ordafnsd by the City Couwn(ofthe city of Beggar. as(oYouaz THAT Chapter VII, Article 10 of the Laws add Ordinances of the City of Bangor is hereby repealed and replaced with the following: LIFE SAFETY CODE Sec. 1 Adopting Life Safety Code. In accnrdanse with Title 30, Section 2L56, Maine Revised Statutes Annotated of L964, as emended, the 'Life Safety Code 1973", 1973 edition, designated as "N.F.F.A. No. 10111, adopted on May 17, 1973, published by the National Fire Protection Association, is hereby adopted and Incorporated by reference as the m standards of construction, protection and occupancy of structures,and buildings located within the City of Bangor for the purposes of life safety from fire and like emergencies. Sec. 2 Enforcement Authority. The Zoning and Code Enforcement Administration officer,. or his authorised agent, shall have the power add duty to enforce the provisions of said Cade. Sec. 3 Enforcement Procedures. Whenever the Zoning and Code Enforecement Admi istration Officr, or his authorized te agent, determined that they Violation of any provisions of this Code, he shell give am ttteanntice of such violation to the property Owner, the lessee, occupant, or their agents. Such written notice shall (1) include a description of theeal estate in question sufficient for identification; and (2) include a description of the violation found and the citation to the pertinent provisions of this Code; and (3) specify the remedial action required for correction of said violation; and (4) order that said violation be corrected a within a reasonable time, such reasonable time to be determined by the Seeing and Cade Enfo[eement Office[ and indicate it upon Such written notice; and (5) state that an appeal it= any order, decision or other action of the Zoning and Code Enfor ement Administration Officer may be taken to the Building Code Board of Appeals by filing with the Zoning and Code Bnfax t Administration Office written request for a public hearing, within ten (10) days of receipt of said written notice. 3.1 Appeals. An appeal may be taken from any order, decision or other action of the Zoning and Code Enforcement Administration Office[ to the Building Code Board of Appeals (hereinafter referred to as the "Board") established by Chapter IF, Section 127 Of the Laws and Ordinances of the City of Bangor. The appeal must be filed _n writing with the Zoning and Cade Enforcement Administration Officer within tea (10) days of receipt of $aid written notice. The Board may interpret this Code and thereby affirm ormodify such order{ o may grant exceptions therefrom when practical d-fficulties or unnecessary hardships exist, and it is clearly ev _dent that reasonable safety would thereby be secured. The fictions of the Board shall be governed by the provisions of Chapter IX, Section 127. Failure of the Board to issue a written notice of its decision within thirty (30) days of the filing of an appeal, constitutes a denial of said appeal. 3.2 Appeal to the Superior Court. Further appeal from the decision of the Building Code Board of Appeals may be made to the Superior Court in accordance with the Maine Rules of Civil Procedure. Sec. 4 Prosecution of Violation. Upon the expiration of the reasonable time stated in the written notice provided for in Section 3 of this Article, and the faller¢ to comply with any and all orders, the Zoning and Code enforcement Administration Officer may institute appropriate proceedings at law or in equity to compel the property Owner, Lessee, occupant and/or their agents, to comply with the provisions of this Article. In addition, the Zoning and Cade Enforcement Administmatton Officer may file a criminal complaint in the District Court of the State of Maine Low purposes of enforcing the penalty provisions contained in Section 5 of this Article. Sec. 5 Penalties. Beery person, firm, partnership, ass ociation or corporation who shall violate any provision Of this Article shall, at the expiration of such reasonable t Its as stated in the written notice, be guilty of a misdemeanor, and upon conviction thereof, be punished by arfine of not more than $100 for each violation.
