Menever in this ordinancer the following terms a used, they shall have the meanings ascribed to them in this Section. 1.1 Bicycle. The word "bicycle" shall Oman every device propelled by human power upon which a person may be riding, having two tandem wheels either of which is more than twenty inches in diameter. 1.2 Dealer in Bicycles. The words "dealer in bicycles" shall man any person, firm of corporation, within the City of Bangor, engagingin the retail or whole- sale or trade of new or used bicycles. 1.3 License Plate. The words "license plate" shall mean a metal tag iae had by the City Clerk bearing a license number. 1.4 RentaL Agent_ The words IreataL agent" shall man any parson, firm or corporation, within the City Of Bangor, engaging in the business of offering for rental and renting, bicycles to the public. 1.5 Ride. Theword 'side' day farm r tense thereof, shall mean the using, putting into action o causing to function of a bicycle by a person mounted theroon Sec. 2 Registration and License Requirements. 2 2.1 License Required. No Pers an who resides within the City of Bangor, shall ride or propeL a bicycle o any street, sidewalk, bicycle path, or any other way, unless such bicycle has been duly licensed, and a valid license plate is attached thereto. 2.2 Application. Application for a bicycle license shall be made upon the form provided by and aubmitted to the City Clerk. If the bicycle was not purchased it= a dealer in bicycles, the n and address of the person from whom it sea obtained shalt also be stated. 2.3 License Plate. Upon receipt of a costpleted application for bicycle license, the City Clerk shall issue t the owner, a bicycle registration card and a license plate. The City Clerk shall record on the application, the number of the license plate and the date Issued. The license plate shall bear the license comber Assigned to the bicycle, the words '1M1e City of Boner", and the expiration date thereof. 2.4 Term of License. A license shall remit in force until April lst next after the date of its issuance. 2.5 Sourced at of License. Uponthe sale, destruction or other dis- position of a bicycle hereunder licensed, the owner shall immediately surrender to the City Clerk, the license plate issued therefor together with the registration card orthe faceof which, shall be written the come and address of them Any such transferee shall be required to apply for a new license far the bicycle so transferred. The number of any license surrendered shall not be reissued. 2.6 Loss of License Plate. The owner shall report 1®edfately to the City Clerk, the toss or destruction of the license plate issued to the Owner.With the approval of the Chief Of Police, the City Clerk shall issue another license plate to the Sec. 3 6 uipm nt. 3.1 Stakes. Every bicycle shall be equipped with a brake which shall enable the rider to step the bicycle within a reasonable distance. 3.2 Bell or Horn. Every bicycle Shall be equipped with a bell r horn, in good working order, audible at a distance of fifty feet when sounded. 3.3 Riding at Wight. Every bicycle ridden during the period of time between k hour after sunset and y hon before mise at other times when motor vehicles arere- quired t0 display headlights, shell be equipped with and have lighted, a lamp on the front of the bicycle which shall emit a white Light visible from a distance of at least 200 feet in the front, and a red reflector which shall be visible from the xax of the bicycle, for a distance of at least 200 feet. Bicycle pedals shall beer reflector strips, and bicycle handlebars shall bear reflector tapes. Sec. 4 Rules and Regulations. 4.1 Traffic laws Apply. Any person riding a bicycle on a public way is to be granted all the rights and to be subject to all the duties applicable to a driver of a motor vehicle, by the laws of the State of Maine and the Ordlnances.of the City of Bangoracept those provisions of those said Laws and ordinances which, by their nature, have no application to bicycles. 4.2 Traffic Control Devices. Any person operating a bicycle sbaLL obey, the instructions of all traffic control signals, signs and other control devices applicable to motor vehicles, unless otherwise directed by a police officer. Whenever authorized signs indicate that no right turn. left turn, or s u -turn, is permitted, no peron riding a bicycleshall disobey the direction of such sign, providing however, such pare on may dismount the bicycle and proceed as a pedestrian. 4.3 Riding on Roadways. Every parses riding a bicycle shall ride said bicycle as far as practicable, to the right side of the roadway at all times, except when making a left turn. 4.4 Riding Abreast. when more than two persons areoperating bicycles In roadway, in the vicinity of each other, they shall ride in a single file, except when passing each other. 4.5 Extra Passengers. No bicycle shall be used to carry more pets one at one time than the number for which it is designed and equipped. No bicycle shall carry another person on the handlebars of said bicycle. 4.6 Safe Riding. No perm on Shall, while operating a bicycle, indulge rengage in any kind of trick o unsafe riding. No person riding abicycle sha1L carry any package, bundle or other 4 article which prevents each rider from keeping at least one hand on the handlebars. 4.7 Speed. No person shall tide a bicycle at a speed greater than is reasonable and prudent under the conditions then exfsting. 4.8 Riding on Sidewalks. Bicycles may be ridden on sidewalks in public packs and in residential areas, but in single file only. Under all circumstances, the rider shall yield the right of way to pedestrians using the side- walks, add due and proper care shall at all times be exercised by the rider for the pedestrian. When approaching a pedestrian n the sidewalk, the speed of the bicycle shall be reduced to speed which 1e no greater than ary to continue the operation of the bicycle without the operator dismounting, and shall not be increased until the pedestrian has passed. No bicycle shall be operated upon any sidewalk In the Central Business District of the City of Bangor. Sec. 5 Reserved. Sec. 6 Rental Agency. 6.1 Licenses Required. it shall be unlawful far any rental agent to rent, or offer to rent, any bicycle without first complying with the provisions of Section 2 of this Article relating to the licensing of bicycles. 6.2 a ug ipment. Bicycles offered for rent bye ental agency shall be equipped for riding at night and with such other equipment required by Section 3 of this Article. Sec. J Dealers in Bicycles. Any dealer in bicycles located within the City of Bangor is hereby required to make a written report to the Chief of Police at the end of each moral, or more often an may be requested by the Chief of Police. Such reports shall contain the following Information: (a) The Name and address of each person to whom a bicycle was sold, purchased or traded by such dealerr v bicycles during the period covered by the report} and (b) no description of the bicycle involved in each reported transaction including the name of the manufacturer and the manufacturer a serial umber appearing on the frame. Sec. 8 Other Provisions, 8.1 Removal of Serial Number. It shell be unlawful for any person to willfully or maliciously remove, destroy, mutilate or alter the manufacturer's serial number appearing on any bicycle. The Chief of Police is hereby authorized to &tamp ambers on the frame of a bicycle in a Legible manner fox identification purposes, upon which no nvfacturer'd serial number appears or upon which the manufacturer's serial number is illegibleor Insufficient for identification purposes. 8.2 Bicycle without Serial Number. It Shall be unlawful for any Pere on residing in the City of Bangor, or any dealer in bicycles to purchase, receive in trade or otherwise acquire any bicycle upon which does not appear fl nufacturer'aial amber, without first reporting such lack of manufacturer's serial amber to the Chief of Police. Sec. 9 Penalties, Any person of the age of 17 years or older who violates any provision of this Ordinance shall, upon conviction be punished by a fine of not mote than $10.
